In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://Portal.ncdenr.org/webZwg/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
Part ll:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit_a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. if you have any questions regarding this permit

The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to

The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to
the permittee.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an
approved TMDL, may not be eligible for renewed coverage under the General Permit.
• Part 11 Section B Table 1 — An increased sampling frequency from once per year to twice per year.
• Part 11 Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of
the option to avoid sampling based on cutoff concentrations.

Part II Section B — New provisions requiring the permittee to execute Tier One and 'bier Two response
actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark
exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -
per -year monitoring, until three consecutive monitoring events show no benchmark exceedences.
Part 11 Section B — A new provision that four exceedences of any particular benchmark will trigger increased
DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the
permittee to apply for an individual permit, or may direct the implementation or installation of specific
stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to
comments can be found at littpa/iicwaterquaIity.org/su/gcneraIpermitiiifo.litm. Some comments resulted in permit
modifications, others are addressed in the response document or Fact Shect. A few specific requests for
clarification are addressed below.
I . What is the deadline for having a revised SI'PP that reflects the provisions of the neiv General Permit?
DWQ will require that the permittee have a revised, complete SPPP no later than six months after the date of
issue of that permittee's new Certificate of Coverage.
2. Must analytical results be by a certified lab? What about 141 ineasurennents? All analytical results obtained
to satisfy NPDES permit requirements must be by EPA approved methods. DWQ certification is not required
forstornnvater analytical results. Analytical results for tivastewater analyses are required to be by DWQ
certified labs or analysts. Field pH measurements are subject to the same requirements as to EPA method
(stormwater and wastewater), and as to certification (wastewater only).
Your coverage under the General Perrnit is transferable only through the specific action of DWQ. The Division may
require modification and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does
it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule,
standard, ordinance, order, judgment, or decree.

On behalf of Young's Auto Center II, Mid -Atlantic Associates, Inc. requests representative outfall
status for the above referenced site. The facility is permitted to discharge stormwater under the
North Carolina Department of Environment and Natural Resources, Division of Water Quality,
General Permit NCG100000. Stormwater currently discharges off site at four outfalls (See
Attached Drawing 2.1). Potential pollutants associated with stormwater discharges at each outfall
include oils, greases, petroleum, vehicle fluids, metals and suspended solids. Based on our recent
evaluation of the site and its stormwater outfalls, it appears that the stormwater discharge from
Outfall 4 is representative of discharges from each outfall at the site. It also appears that the
discharge at Outfall 4 would be the "worst -case" discharge of the four. We appreciate your

I am sorry for the slow response to your letter dated February 8, 2007.
Thank you for giving me the additional time to answer your request.
I have sent the results of our water testing to NCDENR/DWQ back in April.
The results appeared OK.
The following is a brief description of how we are handling our automotive wastes:
1- Gas
a. Customers are fined for bringing cars in with gas tanks. There is an
additional
charge if the tank has fluid or gas in it.
b. The flanks that we remove before crushing are drained into barrels and the
tanks
are allowed to air before we crush them. The tanks after crushing are
allowed to
air for several months and then we take them to the shredder in Smithfield,
NC.
c. Non-ferrous and plastic tanks are drained and allowed to air. They are
carried
to the county landfill. (The large piles that we had were removed once we got
permission from the landfill to take them.)
d. The bad gas is disposed of by Noble Oil Company in Sanford, NC.
2- Oil and misc. auto fluids
a. We have oil catchers under the car crusher to catch oil or any other fluid
that
runs out. Any oil that accumalates in the crusher is scooped up and not
allowed
to go on the ground.
b. Disposal of any accumulated f luids is by Noble Oil also.
I
3- Batterys
a. Stored in pickup beds and covered until removal by North State Battery Co.
of Wilson,
NC. They usually pickup when we have around 100 batterys.
b. We discourage customers from bringing in batterys, but presently do not
charge
a fine for doing so.
4- TIRES
a. We have reduced the large pile of tires we had. All tires are removed f rom
rims and
disposed of with Central Carolina Tire Disposal of Cameron, NC. The size
of the piles
varies with the flow of autos we are processing, but we have made an
effort to keep
the piles low.
I have emphasized the importance of keeping our yard clean with the employees.
Every person
involved with crushing has been versed on our procedures. I have also told them
that not
being diligent with our policys will adversly affect their pay or could result in
termination.

1. On 24 January 2007, Ron Boone, of the NC Division of Water Quality (DWQ), Raleigh Regional Office (RRO),
conducted a compliance evaluation inspection at the subject site to determine your compliance with the subject
permit. Your assistance and cooperation was helpful and appreciated. An inspection report is attached *for your
records and inspection findings are listed below. It should be noted that this permit was issued in March of 2006.
Prior to that date the site was operated without a permit.
2. There is s stormwater pollution prevention plan (SP3) on site. The SP3 contained most of mite required
components, however one item that remains in question is the number of stoRmwater discharge outfalls (SDO) at
the site. Although the SP3 identifies two SDOs► a walk around the premises during the inspection nwealed that
there are at least three separate outfalls, and rely more. The actual number of outfalls is in question because of
the runoff of stormwater at multiple points along the nortb=6 western and southern edges of the property. Each
SDO must be positively identified and then documented on the general location map component of the SP3 with
accurate latitudeglongitudes. The outfalls are the points at which both analytical and qualitative monitoring must
be accomplished. Please take special note of the definition of "point source discharge of stortnwatee, in Part VI,
paragraph 19, while making the determination of how many SDOs exist at your site.
3. As of the date of this inspection, analytical monitoring had not been completed for the year 03/2006 through
03/2007. Please note that the initial analytical monitoring must be accomplished within the first year (12 months)
of permit issuance and that all analytical testing must be done by a certified laboratory. 'The only exception to this
is the pH test; this test may be run an site to avoid conflicts with sample holding times. Refer to Part II, Section B

6. The best management practices (BMP) for the handling of autotrrntive wastes such ar, gasoline, brake fluid, engine
oil, transmission fluid, batteries, etc., were not clearly understood by the inspector. Several BMPs were identified
in the SP3 as existing or proposed (feasibility study), but these BMPs were either not yet implemented (proposed
only) or the conditions at the site did not match what the BMPs indicated would be dmre. Additionally, your
verbal .explanation of how gasoline and batteries are handled did not match site conditions either. Although only a
few batteries were seen around the yard, there were several piles of vehicle gas tanks that had already been
removed from vehicles in preparation for crushing. Several of these tanks had fluids in them that smelled very
strongly of gasoline. The way the tanks arc piled up around the site, it would be very easy for the gasoline to leak
out onto the ground. Please note that every tithe such a spill of gasoline, or other concerned automotive fluids
oocurs, constitutes a violation of NC general statute 143-215.75, and is punishable by a fine of up to $5,000 per
day per violation. We strongly encourage you, as the owner of Young's Auto Center and Salvage, to read through
your permit very thoroughly and feel free to ask our inspector to clear ap any questions you may have. Your
complete familiarity with, and understanding of the permit is imperative to best assure compliance.
7. There were several proposed BMPs in the SP3. It is also highly suggested that you seriously consider
implementing these BMPs as well.
8. Please be aware that the above -mentioned issues constitute violations of your stormwater discharge permit and that
such violations may result in the asscesanent of civil penalties in an amount of up to S25,000 per day per violation.
Please provide a response to the issues identified above within 30 days of your receipt of this lctur. Your response
must include a narrative as well as a tentative schedule for you to correct the identified issues. if you or your staff

few batteries were seen around the yard, there were several piles of vehicle gas tanks that had already been
removed from vehicles in preparation for crushing. Several of these tanks had fluids in them that smelled very
strongly of gasoline. The way the tanks are piled up around the site, it would be very easy for the gasoline to leak
out onto the ground. Please note that every time such a spill of gasoline, or other concerned automotive fluids
occurs, constitutes a violation of NC general statute 143-215,75, and is punishable by a fine of up to $5,000 per
day per violation: We strongly encourage you, as the owner of Young's Auto Center and Salvage, to read through
your permit very thoroughly and feel free to ask our inspectors to clear up any questions you may have. Your
complete familiarity with, and understanding of the permit is imperative to best assure compliance.
There were several proposed BMPs in the SP3. It is also highly suggested that you seriously consider
implementing these BMPs as well.
8. Please be aware that the above -mentioned issues constitute violations of your stormwater discharge permit and that
such violations may result in the assessment of civil penalties in an amount of up to $25,000 per day per violation.
Please provide a response to the issues identified above within 30 days of your receipt of this letter. Your response
must include a narrative as well as a tentative schedule for you to correct the identified issues. If you or your staff

carried

d. The bad gas is disposed of by Noble Oil Company in Sanford, NC.

a. We have oil catchers under the car crusher to catch oil or any other fluid

Your facility is currently covered for stormwater discharge under General Permit NCG100000. This permit expires on
August 31, 2007. The Division staff is currently in the process of renewing this permit. When a draft version is
available for notice and public comment, it will be posted on our website at httr)://h2o.enr.state.nc.us/su/. Once
the permit is reissued, your facility would be eligible for continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit. Enclosed you will find a Permit Coverage Renewal Application Form. The
application must be completed and returned by March 2. 2007 in order to assure continued coverage under the
general permit. Letters confirming our receipt of the completed application will not be sent.
Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $25,000 per day.
Please note that "no exposure exclusion" is now available to all operators of industrial facilities in any of the
categories of "storm water discharges associated with industrial activity," (except construction activities). I€ you feel
your facility can certify a condition of "no exposure", i.e. the facility industrial materials and operations are not
exposed to stormwater, you can apply for the no exposure exclusion. For additional information contact the Central
Office Stormwater Staff member listed below or check the Stormwater Permitting Unit Web Site at

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
