This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG100000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of Stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. The more significant changes in the General Permit since your last COC was issued are noted either in the Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.orp/web/wq/ws/su/current- notices), or in the Response to Comments/ Summary of Changes and Technical Bulletin documents that are posted on the Stormwater Permitting Unit's website with the new General Permit. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (0&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than 30 days from the date the facility receives the sampling results from the laboratory. Also note that existing permittees do not need to submit a renewal request prior to expiration unless directed by the Division. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. The information contained in this response is based on our knowledge of site operations and information provided by Mr. Young. Mr. Young appreciates the opportunity to respond to the NOV and we have attempted to respond to the items in your NOV in the order that they were presented. The facility is in violation of all aspects of the stormwater permit Mr. Young has informed me that they have always operated with careful attention to potential pollutants, spill prevention and in accordance with a facility Stormwater Pollution Prevention Plan (SPPP). In fact, Mr. Young has indicated that he has routinely performed inspections of his yard to insure materials were properly handled and that nothing was discharging onto the ground, adjacent properties or into the adjacent water bodies. A new SPPP was prepared for the facility and implemented in February 2008. This includes the required sampling, monitoring and inspections, etc. outlined in the permit. Although Young's employees could not produce records indicating that the SPPP had been implemented during the recent site visit, they were in fact on site. Mid -Atlantic Associates, Inc. (Mid -Atlantic) has been working with Young's employees to make sure they understand the permit and implementation of the SPPP_ Copies of applicable records for 2008 are attached to this response and have been filed on site with the SPPP. Response to Notice of Violation dated July 24, 2008 August 13, 2008 Young's Auto Center and Salvage Page 2 Benson, North Carolina NC G 100172 Implementation of the SPPP The new SPPP for the facility was implemented by Young's in February 2008 as evidenced by the attached training log, inspection forms, qualitative monitoring forms, discharge monitoring report, etc. Mr. Young has instructed the appropriate employees to make sure these forms are filed with the SPPP upon completion. Stained Soil Noted at Outfall 5 Mr. Young observed the area of stained soil noted in the vicinity of Outfall 5 and indicated that the dark material on the surface appeared to be tar. Mr. Young did not know how or when this material was spilled/deposited or the quantity. He indicated that based on his visual observation, the amount of material appeared small. This area did not appear to be a result of runoff leaving the site. The small drainage depression which drains this area was free of noticeable stains, as evidenced by the photographs included in your letter. Each of Mr. Young's employees that handles oil is trained in the proper storage of oil as it is captured/removed from the cars. Procedures for On -Site Vehicles Incoming vehicles are inspected and taken to one of several vehicle storage areas prior to dismantling. Most vehicles brought onto the site do not contain fuel in the automobile fuel tanks or antifreeze in the radiators. Vehicles that contain fuel and/or antifreeze are drained and the fluids stored in 55-gallon barrels prior to being transported off site for disposal. Vehicles are moved to the dismantling area where parts are removed. The majority of the dismantling occurs inside the garage structure. Recovered parts are either stored inside the parts building on concrete slab or outside on racks, pallets and on the ground. Vehicles are then stored at various areas on the site until crushed. A mobile crusher is used on site to crush the vehicles. Once the vehicles are crushed they are stored on the yard until they are transported off site for sale as scrap metal. The car crushers have internal drains that catch fluids that may be released from the car during the crushing operation. The fluid that drains into the drip pans is either emptied back into the vehicle where it is absorbed into the vehicles upholstery/carpet or transferred into 55-gallon barrels for disposal off site. Corrective Actions to Prevent Further Discharges As stated earlier, Mr. Young instructs employees on the importance of spill prevention and proper handling of vehicle fluids. This attitude, along with Young's implementation of the SPPP will help prevent a future discharge of oil or other fluids at the site. The volume of material spilled at Outfall 5 appeared to be less than five gallons. Containment of Spill and Disposal of Waste According to Mr. Young, the area of stained soil was dry and confined to the visible area of staining. The stained soil was excavated and stored in a 55-gallon drum(s) which will be properly disposed of. Documentation Documentation associated with implementation of the SPPP is attached to this letter. We appreciate the opportunity to respond to the NOV. The recent inspection has clarified the importance of spill prevention, pollution prevention, implementation of the SPPP and general permit compliance at the facility. Based on Mr. Young's commitment to compliance with his general permit, as witnessed by this response to the NOV, Mr. Young does not feel any additional action is warranted with respect to this matter. This facility is in violation of all aspects of your permit. The main violations occur in Part II: Monitoring, Controls, and Limitations for Permitted Discharges, Section A: Stormwater Pollution Prevention Plan, Section B: Analytical Monitoring Requirements, and Section C: Qualitative Monitoring Requirements. 2. While this facility has a Stormwater Pollution Prevention Plan, however, this office has concerns with respects to the implantation of the pollution prevention requirements of the permit. This Plan was up dated in -February 2008 by.Mid-Atlantic Associates, Inc. 3. The pictures below were taken during the inspection of the outfall 005. Young, Owner Young's Auto Center & Salvage 2500 NC Highway 242 South Benson, N.C. 27504 Subject: NPDES General Stormwater Permit NCG/0000 Permit Number NC*100172 Representative Outfall Status Request Young's Auto Center & Salvage Johnston County Dear Mr. Young: The Raleigh Regional Office staff have reviewed your request dated March 04, 2006 for a determination that stormwater discharge outfall (SDO) 005 be granted representative outfall status (ROS) for stormwater outfalls 001, 002, 003, 004, and 006. Based on the compliance evaluation inspection conducted by Vicki Webb on ,tune 12, 2008, the Raleigh Regional Office cannot approve your request at this time. According to Ms. Webb, there are no past or present records showing that the Stormwater Pollution Prevention Plan has been implemented. Analytical and qualitative records were not available for the inspection. Ideally a minimum of eight (8) to ten (10) analytical and qualitative samples are needed to support the assertion of similar or less stormwater pollution potential in the sub -drainage areas to be represented. When evidence supports ROS after eight (8) to ten (10) analytical and qualitative sample events, you may request ROS consideration from this office. Stormwater currently discharges off site at six outfalls (See Attached Drawing 2.1). Potential pollutants associated with stormwater discharges at each outfall include oils, greases, petroleum, vehicle fluids, metals and suspended solids. Based on our recent evaluation of the site and its stormwater outfalls, it appears that the stormwater discharge from Outfall 5 is representative of discharges from each outfall at the site. In the specific case of Young's Auto Center & Salvage in Benson, a Notice of Violation was mailed in November 2002 notifying you of the need to apply for a permit. A certified mail receipt shows that letter was delivered, but we still have no record of a permit application. The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water Act (1972) and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES Phase I permitting program for stormwater discharges was established in 1990, Phase focused on site and operations planning to reduce pollutant sources. Two of the industries that Phasel regulates through NPDES permits are Used Motor Vehicle Parts, SIC Code 5015 and Auto Wrecking for Scrap, SIC Code 5093. A General Permit (No. NCG 100000) became effective August 1, 1994, The discharge of stormwater from a Salvage site to waters of the State without a permit is a violation ofNCGS 143-215.1(a)(1). This office is considering recommending to the Director of the Division of Water Quality that civil penalties be assessed against your company for Operating the Benson Auto Center & Salvage site without a permit. NCGS 143-215.6 provides that violations of 143-215.1 may incur civil penalties up to $25,000 per violation per day. Any response submitted to this office within 10 days of receipt of this letter will be considered when making the recommendation.
