DID NOT KNOW WHERE TO COLLECT WATER. DURING OUR INSPECTION MS
MELISSAJOYNER FROM THE FAYETTEVILLE REGIONAL OFFICE WAS VERY HELPFUL
IN LOCATING OUTFALLS FOR US'IN WHICH I DID GO ONTO COMPUTER AND
SUBMITTED THESE NEW OUTFALLS FOR &REPORTING. FROM THIS DAY FORWARD
OUR COMPANY WILL STRIVE TO DO ALL THAT IS REQUIRED OF US TO KEEP OUR
PERMITT, WE WILL PERFORM ANALYTICAL MONITORING, INCLUDING QUALITIVE
MONITORING, WE WILL MAKE ALL CORRECTIONS ON OUR SITE MAP DESCRIBING
NEW OUTFALLS AND WORK PERFORMED AND WHERE, MR SCHANTZ IS ALSO ON
A DAILY BASIS DISPOSING OF ANY PARTS THAT ARE NOT UNDER SHELTER.

On November 14, 2017, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR), conducted a site inspection for the Ed's Auto Service and Salvage
facility located at 1238 Slocomb Road, Cumberland County, North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. Michele. Faircloth, Administrative Assistant, was also present
during the inspection and her time and assistance is greatly appreciated. The site visit and file review
revealed that the subject facility is covered by NPDES Stormwater General Permit NCG100000 under
Certificate of Coverage NCG10164. Permit coverage authorizes the discharge of stormwater from the facility
to receiving waters designated as a UT to the Cape Fear River, a Class C waterbody, in the Cape Fear River
Basin. — .
As a result of the site inspection, the following permit conditions violations are noted:
1 j Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit requirements.
2) Analvtical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.
Other Observations:
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made
during the inspection.
Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your
written response should include a reasonable explanation as to why the aforementioned violations have
occurred as well as a Plan of Action to prevent these violations from recurring.
Thank you for your attention to this matter. This office requires that the violations, as detailed above, be
properly resolved. These violations and any future violations are subject to a civil penalty
assessment of up to $25,000 per day for each violation.

Inspection Summary:
Melissa Joyner met with Mr. Ed Schantz, President and Ms. Michele Faircloth, Administrative Assistant, at Ed's Auto
Service and Salvage facility located on 1238 Slocomb Road. The facility had received a Notice of Violation (NOV) previously
on June 13, 2007 for not having a Stormwater Pollution Prevention Plan (SPPP) and not conducting semi-annual Qualitative
and Analytical monitoring in accordance with the permit conditions of the NCG100000 General Permit. In response to the
NOV, a SPPP had been developed which was reviewed during the inspection. The annual update of the SPPP with the
recertification that the stormwater outfalls have been evaluated for non-stormwater discharges was not noted. The annual
re-evaluation of the Best Management Practices utilized at the facility was also not observed. The site map should have
more detail, including all information as specified under Section AA (d) of the NCG100000 General Permit. Records of the
facility inspections and employee training were reviewed and contained the required information. The records for 2013 and
2014 were not available for review as they had been stored in a different building which had been impacted by Flooding. In
regards to the Spill Prevention and Response Procedures, facility personnel responsible for these procedures should be
identified in a written list which is signed and dated by these individuals.
The Qualitative and Analytical monitoring had not been conducted at the outfalls on the property because the facility was
unsure of the location of these outfalls, therefore the correctly completed Qualitative and Analytical monitoring forms were
not available for review. A Solvent Management Plan may be developed which waives the requirement of monitoring for Total
Toxic Organics. Please refer to Section A:10 Solvent Management Plan, in the NCG 100000 General Permit for guidance
about the preparation of this'plan. Monitoring forms were given to the facility by Ms. Joyner during the inspection. The
Annual Summary Data Monitoring Report does not need to be submitted to the Division of Energy, Mineral and Land
Resources, but should be actively maintained and updated annually in the SPPP.
A tour of the facility was conducted by Mr. Schantz. There was gravel installed on the majority of the facility grounds, as .
well as natural vegetation. Mechanical parts were observed under covered roofs, on concrete floors or on shelves. There were
a few rusty parts noted on the ground in one location which should be relocated. The secondary containment area appeared
in good condition. Mr, Schantz said that all fluids were removed from the cars under a covered location, which was observed,
and that the fluids were fully recycled. On the west side of the site, broken concrete and asphalt waste debris was observed
in piles. If more than 1.0 acre is being or will be disturbed by this activity, a sedimentation and erosion control plan will need
to be submitted to this office. Al the base of the slopes some erosion was noted.. It is recommended that silt fence be
installed in these locations. -
The facility has 3 outfalls which were identified during the inspection. Outfall 1 (no active discharge) is adjacent to Slocomb
Road and is a well -grassed diversion Swale. Outfalls 2 and 3 (both with active discharges) on the southeast and southwest
sides of the site are natural drainage channels which lead to the Cape Fear River. No issues were noted with the condition of
the outfalls or the Stormwater discharges.

In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://Portal.ncdenr.orglweb/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections A C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in.the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: if the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

On June 13, 2007, Chad Turlington from the Fayetteville Regional Office of the Division of
Water Quality, conducted an inspection for the Ed's Auto Service and Salvage facility located at 1238
Slocomb Rd. in Linden, Cumberland County, North Carolina. A copy of the inspection report is
enclosed for your review. I met with Johnny Schantz during this inspection and his time and assistance
during this inspection is greatly appreciated. Stormwater from the facility drains to an UT to Cape Fear
River, a Class C waters located in the Cape Fear River Basin. This inspection revealed that the subject
facility is covered by NPDES Stormwater General Permit-NCG100164.
Accordingly, the following observations and/or permit conditions violations were noted during
the Division of Water Quality inspection:

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act and then delegated to the Division of Water Quality for implementation in
North Carolina. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities thatTall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual pennit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There are
currently 19 active general stormwater permits in North Carolina. One condition that is applicable to
both the general permits and individual stormwater pen -nits is the requirement to develop and implement
site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to
include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent
pollutant discharge.

monitoring forms, and a Notice of Intent [which is the application of for coverage under a NPDES
General Stormwater Permit] can be found at this web site.
The following items are a subset ofpermit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said;
please see the above -mentioned web site in order to obtain a copy of the permit such that you may fully
comply with all the conditions therein. Failures to properly comply with conditions of the permit,
like those bulleted below, constitutes violations and are subject to a civil penalty assessment of up

• Industrial facilities that fall into one of the subject ten categories are required to obtain permit
coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the .
Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered
by the General Permit. That is, the permittee is authorized to discharge stormwater, process
wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit
expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most
of the permits have following condition requirements (you must read your entire permit to ensure
full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility
along with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring
results shall also be maintained on -site. The Permittee shall retain records of all
monitoring information, including all calibration and maintenance records and all original
strip chart recordings for continuous monitoring instrumentation, and copies of all reports
required by this general permit for a period of least 5 years for the date of the sample
measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the
general permit. In order to receive automatic authorization to discharge beyond the
expiration date, the permittee shall submit forms and fees as are required by the agency
authorized to issue permits no later than 180-days prior to expiration date. Any permittee
that has not requested renewal at least 180 days prior to expiration, or any permittee that
does not have a permit after the expiration and has not requested renewal at least 180
days prior to expiration, will be subject to enforcement. Failure to renew your permit is
a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is
not transferable to any person expect after notice to and approval by the Director. The
Director may require modification or revocation and reissuance of the Certificate of
Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change -- Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of
Water Quality views changes of name or ownership as a modification that requires the
Director's approval and reissuance of the permit. Name and ownership changes required
you to complete a Name/ownership Change Form from the Division and mail it back to
the Division of Water Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

herewith the subject certificate of coverage to discharge under the subject state — NPDES general permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated May
9, t994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality, The Division of Water Quality may require modification or revocation and reissuance of the
