Dear Mr. Elliott:
Staff of the North Carolina Division of Water Quality, Surface Water Protection Section, Raleigh
Regional Office, conducted a stormwater compliance evaluation inspection of Elliott's Auto Salvage;
1010 Harvest Street, Durham, on July 31, 2012. Your assistance was very helpful and appreciated
during the inspection process.
The following observations were made during the stormwater inspection:
1. . Elliott's Auto Salvage is a private company that provide a full range of services such as
Foreign Auto Parts, Federated Auto Parts, Salvo Auto Parts, Used Car Parts and Nissan
Auto Parts.
2. The Stormwater Pollution Prevention Plan for this facility contained all the components
required by NCG100000 with the exception of a narrative description of practices, outfall
locations and drainage areas on the site map, employee training, responsible party list and
documentation of annual plan review and update.
3. All vehicle fluids are drained and secondary contained with the exception of the two fluid
drums in the left rear in back of the office building.
4. Qualitative and Analytical monitoring was not performed as required by General Permit
NCG100000. Qualitative monitoring was not performed during the analytical storm event.
The last analytical storm event was during the first period on January 26, 2011. The facility
tailed to perform Qualitative and analytical monitoring during the second period of2011
and during the first period of 2012. The facility does the sampling. Enco conducts the
analyticals.
The facility has one outfall. The outfall was assessable for sampling at the time of the
inspection. Please continue to keep vegetation growth at a minimum at the sampling site.

1. Requirements and recommendations:
1. The facility failed to performed Qualitative and Analytical monitoring as required by NCG 100000,
Qualitative and Analytical monitoring must be performed twice a year. Qualitative and Analytical
monitoring must be performed at the same monitoring event in the first and second period of each year
(January I to June 30=first period, July 1 to October 31 =second period). Please conduct qualitative
and analytical monitoring as required during the second period of 2012. Send the sampling results on
the forms we provide to the DENR, Surface Water Protection Section, Raleigh Regional Office, 1628
Mail Service Center, Raleigh, NC 27699-1628.
2. Your Stormwater Pollution Prevention Plan must include the following:
A. Site map to include stormwater drainage areas and outfall location.
B. Include a narrative description of practices.
C. Provide and document employee training.
D. Please show documentation to include a signature that the plan is reviewed and updated annually.
3. Please provide secondary containment for the two fluid drums (One containing anti -freeze) in the
left rear in back of the office building.
Please respond to items Part I, 1 through 3 within 30 days of receipt of this letter with the specific
actions of compliance that you plan to make. Please be sure to follow/adhere to the stormwater permit
conditions. Violations of your permit conditions are subject to Civil Penalty Assessment of up to
$25,000 per violation. If you have any questions regarding your permit please do.not hesitate to

Regional Office conducted a site visit to Elliott Auto Salvage, 1010 Harvest Street
on August 4, 2008. The assistance and cooperation of your son Mr. Ray Elliott
was very helpful and appreciated.
The facility had the following violations of Stormwater Permit No. NCG100000
(NCG100151) and observations were as follow:
" 1. The Stormwater Pollution Prevention Plan has not been created as required by
the General Permit No. NCG100000 (Certificate of Coverage No.,

2. Qualitative monitoring had not been conducted as required by General Permit

6. All engine parts must be removed from the floor (See attached photos) and
stored in an area where fluids from the parts could not possibly go into the
floor drains.
Part III Standard Conditions for NPDES Stormwater General Permits, Section A:
Compliance and Liability, No. 1. Compliance Schedule of your General Permit
states that for new facilities all requirements, conditions, limitations and controls
contained in this permit become effective immediately upon issuance of the
Certificate of Coverage. Elliot Auto Salvage was issued a new permit with an
effective date of June 27, 2003. You are required to immediately implement your
stormwater pollution prevention plan and achieve compliance with all requirements
of your stormwater permit.
It is requested that you respond in writing to this Notice of Violation within 15 days
of receipt of this correspondence. Your response should address all items 1 through
6. We are attaching a copy of General Stormwater Permit NCG 100000, monitoring
forms and a list of private certified labs. If you should have any questions regarding

In response to your renewal application for continued coverage under stormwater General Permit NCGl 00000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The foilowing information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG100000
• A copy o1 a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to famfliarize yourself with all
the chancles in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the Generaf Permit.
• Part II Section B Table 1 — An increased sampling frequency from once per year to twice per year.
• Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part Il Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to comments can be
found at http://newaterquality.org/su/industrialgpinfo.htm. Some comments resulted in permit modifications, others are
addressed in the response document or Fact Sheet. A few specific requests for clarification are addressed below.
1. What is the deadline for having a revised SPPP that reflects the provisions of the new General Permit? DWQ will require
that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permtee's new
Certificate of Coverage.
2. Must analytical results be by a certified lab? What about pH measurements? All analytical results obtained to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's Laboratory Section Certification Branch. This includes field pH measurements.

Dear Ms. Elliott:
It has come to the attention of the North Carolina Division of Water Quality that Elliott's Auto
Salvage, Inc. has not obtained a Stormwater Permit for the site at 1010 Harvest Street in Durham,
North Carolina.
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal (:lean Water Act (1972) and then delegated to the Division of Water Quality for
implementation in North Carolina. The NPDES Phase I permitting program for stormwater
discharges was established in 1990. Phase I focused on site and operations planning to reduce
pollutant sources. One of the industries that Phase 1 regulates through NPDES permits is Used
Motor Vehicle Parts, SIC Code 5015, and Automotive Wrecking for Scrap, SIC Code 5093. A
General Permit (No. NCG100000) became effective September 1, 1992.
The discharge of stormwater from a Used Motor Vehicle site to waters of the State without a permit
is a violation ofNCGS 143-215.1(a)(1). This office is considering recommending to the Director of
the Division of Water Quality that civil penalties be assessed against your company for these
violations. NCGS 143-215.6 provides that violations of 143-215.1 may incur civil penalties up to
$25,000 per violation per day. Any response submitted to this office within 10 days of receipt of
this letter will be considered when making the recommendation.
On April 11, 2003 Mr. Joe Albiston conducted a site visit at Elliot's Auto Salvage, Inc. Stained
areas with oil and other vehicle fluids throughout the site constitute a direct violation of North
Carolina General Statute 143-215.83, which states in part that it is unlawful to discharge oil or other
hazardous substances onto or upon any waters or lands of the state. General Statute 143-215.84
requires the person having control over the oil or hazardous substance discharged shall immediately
undertake to collect and remove the discharge and to restore the area affected by the discharge as
nearly as possible to the condition existing prior to the discharge.
