This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG100000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. The more significant changes in the General Permit since your last COC was issued are noted either in the Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current- notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are posted on the Stormwater Permitting Unit's website with the new General Permit. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not, require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than 34 days from the date the facility receives the sampling results from the laboratory. Also note that existing permittees do not need to submit a renewal request prior to expiration unless directed by the Division. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. Outfall 001 is drains the largest portion of the property including the areas where the majority of the exposed potential pollutants are stored, outside, without cover. Outfall 001 is fed by the swale and flows into the unnamed tributary that runs across the property and ultimately feeds into Smith Creek. Activities in the area of Outfalls 002, 003 and 004 are similar to those affecting Outfall 001. Contact with potential pollutants is limited and all stormwater ultimate flows to Smith Creek. Runoff to Outfalls 002, 003, 004 flows over sandy soil and Outfall 003 and 004 are surrounded by heavily wooded areas. We request that the facility be allowed to sample at Outfall 001, and that the sample collected considered representative for Outfalls 002, 003 and 004. While the above permission reduces the volume of Quantitative sampling required where you send samples away to a lab, please be aware that ALL outfalls must have Qualitative monitoring twice during the year during or immediately after a rain. Sullins, Director Division of Water Quality On July 24, 2008, Myrl Nisely from the Raleigh Regional Office of the Division of Water Quality conducted a site inspection for the tract/project known as Nine's Auto Parts located 3679 Bruce Garner Rd., Granville, North Carolina. The site drains to an unnamed tributary to Smith Creek, Class C NSW waters located in the Neuse River Basin. The help you and Jamie provided was appreciated. PIease see the attached inspection checklist. Below are some major points from our discussion: The Stormwater Pollution Prevention Plan (SP3) was current, updated by your consulting firm in April 2008. A number of improvements and changes in operating practices have been made since the last inspection in 2006. The pile of engine cores had shrunk greatly and are now stored on concrete. A large area of concrete has been added to the yard, reducing erosion. The concrete pad in front of the shop was clean, a big improvement from the oil and dirt there last time. Batteries are now stored inside. A recently purchased dismantling table is in use, making it easy to capture fluids released during work on engines and transmissions. 2. There are plans for erecting a roof over the outside lift and core storage area behind the shop. Car crushing takes place immediately behind the shop on concrete, as well. There has been no semi-annual Qualitative Monitoring done yet this year. Likewise, the last Quantitative Monitoring was done in 2007. Your permit was renewed in November of that year, and now requires monitoring twice per year, instead of once. The newest SP3 manual stated that four outfalls exist, and that Outfall 001 has representative status for the other three. A check with DWQ records failed to find a request for that status, but your consultant supplied proof that a letter of request had been mailed in May 2007. To respond to that request, this office is studying maps and photographs, and may make another visit to the facility, to decide whether Outfall 001 can represent the entire site. We will contact you soon concerning this decision. 4. Removing all fluids from cars as they enter the site remains a goal. This idea is shown well in the new SP3 manual as Figure 3a, compared to the practice of storing them on the yard with fluids in them, Figure 3. The potential for polluting the ground or stormwater is greatly reduced when all cars placed in the yard have no fluids left in the radiators, crankcases, transmissions and gas tanks. The last two annual updates of the SP3 by James Environmental have resulted in information being spread through at least two binders. Their field representative stated that he will consolidate the plan into just one binder during his next visit to your facility. Once that is accomplished, that binder should be the location of all future changes. In other words, future Qualitative Monitoring reports, employee training records and any other documentation generated over time should be placed in the binder to create a running five-year record of stormwater protection. 6. During the inspection there arose a question of how to turn in mercury switches for cash. Enclosed are the details of that program. The consultant provided evidence that a request was submitted and received by DWQ in May, 2007. A decision on whether Outfall 001 can be representative will be made in the next few weeks. Page: 4 Overview of the Mercury Switch Removal Program After June 30, 2007, all vehicle recyclers or vehicle dismantlers must remove the mercury - containing capsule (commonly referred to as a "bullet") located in the hood and/or trunk fight assembly, or the entire convenience light_ assembly containing the mercury switch, in the end -of - life vehicle before that vehicle is crushed (on or off -site). This law applies to vehicle crushers, vehicle dismantlers, vehicle recyclers or vehicle scrap processing facilities who are engaged in the business of acquiring, dismantling, or destroying six or more end -of -life vehicles in a calendar year for the primary purpose of resale of vehicle parts or scrap metal. The vehicle must be marked indicating that the switches are removed and the bullet or the switch assembly must be stored safely and managed under the Universal Waste regulations. If the vehicle is damaged such that the mercury switch cannot be removed safely (where there is a risk of releasing mercury by breaking the bullet), the vehicle may be crushed and shredded, without further attempts to remove the switch. After the mercury switches have been removed, the uncrushed vehicle must be marked showing that mercury switches have been removed. • A log must be kept detailing the number of mercury switches removed and when shipping mercury switches for disposal/recycling, the date and number of switches shipped must also be recorded. It is also requested that the log note the number of vehicles in which the mercury switches could not be removed, • The mercury switches that have been removed must be safely stored in a sealed (re - sealable container, marked with the words "Universal Waste - mercury -containing equipment" and the date the first switch was placed in the container. • The switches must be managed as Universal Waste. Mercury Switch Reimbursement The Mercury Switch Removal Program will reimburse the vehicle recycler $5.00 for each mercury switch removed. You stated plans for pouring a large concrete pad in front of the Strip Shop and along the left side of the shop. In the future, fluids will be stored along the side of the building under a lean-to roof. Containers for the various fluids should also have secondary containment structures able to hold the contents of each tank Crushing of cars is carried out a few feet behind the Strip Shop. A number of cars were stacked there for crushing in August (Photo 5). Fluids are removed from cars whenever they are to be crushed or when a part containing fluid is being removed for some purpose. You stated that the car is brought to the Strip Shop for fluid removal. This location is preferable, rather than doing so in the yard where employees might release fluids to the ground. While the permit does not require it, a preferred practice for fluid control is to remove the fluids from all cars as they come onto the property. A second garage east of the Office building was clean, well organized and enviromnentally acceptable. • Soil throughout the yard appeared to be free of oil and gasoline spills, except for the immediate vicinity of the Strip Shop (Photo 1). • For a few hundred feet from the highway, the site is flat. Then it slopes to a central low point near the back. The largest volume of rainwater collects there and runs north where it joins a secondary source described next. A low point on the west collects runoff from the neighboring subdivision. This "run-on" passes through a conduit to form a stream running through the property, shown on a USGS map as a blue line tributary to Smith Creek. • On the rear west side of the lot, the ground rises in elevation from the low point described above. Cars are stored on this high point, which then slopes away to the west. This results in a second outfall for stormwater that is impacted by salvage activity. Apparently, these are the only release points for stormwater, each requiring annual sampling. A consulting firm can more completely certify the outfalls when a site map is created. You might want to consider removing the cars from the west edge of the property to eliminate the salvage yard activity in this second outfall. • Examination of release points showed no signs of petroleum or other contamination. Among other purposes, your stormwater permit is intended to bring a heightened awareness of stormwater concerns to all employees at the facility. One outcome should be a commitment by every employee to regularly carry out Best Management Practices (BMPs) that organize the handling and storage of potential pollutants. Doing things right will protect the environment and help you avoid enforcement fines.
