On March 22, 2011 Mr. Myrl Nisely of the Raleigh Regional Office carried out a stormwater inspection,
as well as an investigation of a complaint submitted to the National Response Center regarding
discharges of oil to the ground and to a creek from the car crusher at your salvage yard. Thank you for
the assistance you provided. Over time there has been spillage of oil around the base of the crusher that
will need to be cleaned up. You will be contacted by the Underground Storage Tank section for
guidance on the soil remediation. There was no evidence of oil making its way to the creek. Attached is
the inspection checklist. Your stormwater program will become compliant when documentation is
routinely made of qualitative and quantitative monitoring, employee training, a record of significant
spills, and an annual review/update of the Stormwater Pollution Prevention Plan (SP3). Highlights of
our discussion were:
Regarding the NRC complaint, there is obvious soil contamination under the diesel engine, and
an area along one side of the crusher. There are catch pans under the crusher sloped to drain
fluids to one end. The fluids are routinely captured and placed in 55 gallon drums, over which a
plastic pickup bed is placed to keep rainwater from the drums. -
2. Permits have been sought for the erection of a large building to be located where the crusher is
now. The building materials are already on -site. It will have a concrete floor on which the
crusher will be placed, so the crusher will be under roof.
Discussions with six employees revealed convincing evidence that training has been given on
proper handling of fluids and batteries, along with spill response procedures.

At least once per year have the crew sign a sheet that they have been trained in topics that you
list at the top of the sheet, and insert this into the SP3.
4. Quantitative monitoring was not successfully carried out semi-annually in 2010. You stated
plans for doing four rounds this year to catch up. They must be at least 60 days apart, so it will
be important to capture nearly every rain that occurs in the remaining months of this year. Please
note: if you handle 55 gallons or more of motor oil per month on average, you are to analyze for
the parameters listed in the Vehicle Maintenance section of the permit. This included a test for
Oil and Grease.
5. In May 2010 you had submitted somewhere close to 450 mercury switches to the rebate program
offered by the Hazardous Waste Section, but had not been paid. They acknowledge their
tardiness in responding, and a check will be coming to you soon.

Inspection Summary:
This inspection was made in response to a complaint fled with the National Response Center that alledged that oil from
the car crusher was being allowed to run onto soil and into the nearby creek. There was soil contamination at the base of
the crusher that will require a cleanup, but there was no evidence of oil to the creek. The RRO UST group has been
contacted. They will provide guidance on soil remediation.
The owner is well along with plans to erect a large building over the location now occupied by the crusher, about half of
which will have a concrete floor. This is projected to be done by the end of May 2011. The crusher will be moved into this
structure and given improved fluid capturing methods, potentially stopping any further environmental impact.
All in all, the site is well organized, has effective BMPs, and employees are made keenly aware of proper handling of
fluids and batteries. The major issue is the need to document the requirements of the permit.

Overview
In Nov. 2007 RRO issued a NOV inspection letter because the facility had no SP3, had no
monitoring data, and had no documented employee training. The inspection letter pointed
out several effective BMPs and good organization of the yard. There were no problems
with the site, other than the need for documentation and sampling.
In response to the 2011 NRC complaint, a standard inspection was carried out on 3/22
before I revealed the NRC complaint to Mr. Flynn. The good BMPs were still in place, and
some progress had been made in the documentation since the 2007 inspection, yet many
elements continued to lack documentation. As for the release of oil, there was a significant
area of oil around the crusher (see pictures). However, there was no indication of oil
running from the crusher to a creek. See further commentary on the complaint below.
Details
The 3/22 inspection began with a review of a SP3 prepared by a consultant. The plan was
thorough and contained all elements needed. However, as before, several components
were undocumented. Mr. Flynn has almost daily discussions with his crew concerning the
handling of fluids, proper disposal, cleanup of any releases, but "employee training" was
undocumented. To prove that he gives employee training, he had me interview six
different workers as we walked through the facility, and all of them showed good
knowledge of spill response and BMPs. They conveyed the feeling that he badgers them
almost constantly about stormwater issues, so I was satisfied that employee training is
being done.
Similarly, observations of the single outfall are frequent, but not documented. The outfall
showed no signs of oil on the sides of the conveyance or on leaves and debris. Mr. Flynn
has erected a series of berms that shunt water away from the bare roads through the yard,
thereby avoiding erosion of the roads, and stormwater travels through large weedy buffers
on its way to the outfall and to the edges of the yard. He failed to obtain the required two
samples in 2010, but expects to do four sampling events in 2011 to catch up, at the urging
of his consultant. He knew they needed to be at least 60 days apart. He owns a calibratable
pH meter.
Conditions around the crusher are unsatisfactory, as the NRC complaint alleges. It was
placed where it is in March 2007. See pictures. It is used nearly every day. All fluid that
can realistically be removed before crushing have been taken out, yet there usually is a
small volume of transmission oil or other fluids released during crushing. The crusher sits
at the apex of a turtleback site topography, so one can hope that groundwater at that point
is deep. There maybe the possibility of removing the contaminated soil to a depth where
the oil stops without it reaching groundwater.
Mr. Flynn is working through the process of obtaining permits to erect a large building over
the site presently occupied by the crusher. The beams and other parts are on the ground
waiting to be put together. The new building will have a large concrete floor in about half
of its footprint, and the crusher will be placed in that section. During preparation for that
building, he will be instructed to dig the soil to determine the extent of impact and to
remediate before the building is erected. He expects to have the building completed by the
end of May 2011.
Mercury Switches are removed, per the payback program offered by the State. He
complained that he has turned in some 450 of them, but has not received the payment
($2250). I will contact Haz Waste Section to ask about this. (They agreed it was an
oversight, and will pay him as soon as possible.)
All in all, Mr. Flynn showed concern for the environment, and is doing many things well.
However, the functions being carried out need to be documented. As for the crusher, there
was not enough thought given to capturing released fluids, and a cleanup is now needed. It
needs to be moved and the contaminated dirt excavated. The timing for this can
reasonably be connected to the installation of the new building. Contact has been made
with the RRO UST Section for their input. Placing it inside the building and improving the
capture of releases from crushing should remove liability of environmental damage in the
future.

On March 22, 2011 Mr. Myrl Nisely of the Raleigh Regional Office carried out a stormwater inspection,
as well as an investigation of a complaint submitted to the National Response Center regarding
discharges of oil to the ground and to a creek from the car crusher at your salvage yard. Thank you for
the assistance you provided. Over time there has been spillage of oil around the base of the crusher that
will need to be cleaned up. You will be contacted by the Underground Storage Tank section for
guidance on the soil remediation. There was no evidence of oil making its way to the creek. Attached is
the inspection checklist. Your stormwater program will become compliant when documentation is
routinely made of qualitative and quantitative monitoring, employee training, a record of significant
spills; and an annual review/update of the Stormwater Pollution Prevention Plan (SP3). Highlights of
our discussion were:
Regarding the NRC complaint, there is obvious soil contamination under the diesel engine, and
an area along one side of the crusher. There are catch pans under the crusher sloped to drain
fluids to one end. The fluids are routinely captured and placed in 55 gallon drums, over which a
plastic pickup bed is placed to keep rainwater from the drums.
2. Permits have been sought for the erection of a large building to be located where the crusher is
now. The building materials are already on -site. It will have a concrete floor on which the
crusher will be placed, so the crusher will be under roof.
3. Discussions with six employees revealed convincing evidence that training has been given on
proper handling of fluids and batteries, along with spill response procedures.

At least once per year have the crew sign a sheet that they have been trained in topics that you
list at the top of the sheet, and insert this into the SP3.
4. Quantitative monitoring was not successfully carried out semi-annually in 2010. You stated
plans for doing four rounds this year to catch up. They must be at least 60 days apart, so it will
be important to capture nearly every rain that occurs in the remaining months of this year. Please
note: if you handle 55 gallons or more of motor oil per month on average, you are to analyze for
the parameters listed in the Vehicle Maintenance section of the permit. This included a test for
Oil and Grease.
5. In May 2010 you had submitted somewhere close to 450 mercury switches to the rebate program
offered by the Hazardous Waste Section, but had not been paid. They acknowledge their
tardiness in responding, and a check will be coming to you soon.

Inspection Summary:
This inspection was made in response to a complaint fled with the National Response Center that alledged that oil from
the car crusher was being allowed to run onto soil and into the nearby creek. There was soil contamination at the base of
the crusher that will require a cleanup, but there was no evidence of oil to the creek. The RRO UST group has been
contacted. They will provide guidance on soil remediation.
The owner is well along with plans to erect a large building over the location now occupied by the crusher, about half of
which will have a concrete floor. This is projected to be done by the end of May 2011. The crusher will be moved into this
structure and given improved Fluid capturing methods, potentially stopping any further environmental impact.
All in all, the site is well organized, has effective BMPs, and employees are made keenly aware of proper handling of
fluids and batteries. The major issue is the need to document the requirements of the permit.

1. Write a Stormwater Pollution Prevention Plan
We conducted our first site visit today to gather the necessary information so that we can develop
the SWPPP according to the requirements set out in General Permit NCG100000. We anticipate
that we will deliver the final SWPPP to the client no later than February 15, 2008.
As for the outfall monitoring and site inspection tasks, Mr. Flynn may contract with us to either
provide training on these activities or allow us to perform these tasks.

Your facility is currently covered for stormwater discharge under General Permit NCG 100000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

Henderson
Vance County
to receiving waters designated as unnammed tributary to Kerr Reservoir in the Roanoke River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, II, III
and IV of General Permit No. NCG100000 as attached.
This Certificate of Coverage shall become effective November 4, 1994.
This Certificate of Coverage shall remain in effect for die duration of the General Permit.
