In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (htt ortal.ncdenr.or web w ws su current -
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections 8, C: A lower TSS benchmark of 50 mg/1 for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

March 2, 2005. This inspection was conducted to determine if the facility is operating in compliance with the
conditions and requirements specified in NPDES General Permit Number NCG100057.
Please find attached a copy of the Industrial Stormwater Inspection Report, which indicates the findings
of the inspection and a summary of compliance issues.

INDUSTRIAL STORMWATER INSPECTION REPORT
FACILITY: Odum's Garage
LOCATION/ADDRESS: 491 Queens Creek Road, Swansboro, NC 28539

ADEQUACY OR SWPPP: No plan has been developed.
VEHICLEIEQUIPMENT MAINTENANCE AREA: This area was free of standing
liquid contaminants. The area where vehicle and equipment maintenance is being
performed is inside the building.
VEHICLEIEQUIPMENT WASH AREA: The wash area is directly behind the garage.
There is no method for containing the wash water. The washing operations are performed
on a pervious surface. Attempts should be made to prevent wash water from running off
the site and into surface waters of the state. There were no surface waters in close
proximity to the washing area. The washing procedures and attempts to prevent wash
water from reaching surface waters should be specifically noted in the SWPPP.
TEMPORARY STORAGE OF WASTE MATERIALS: The temporary storage of waste
materials are being stored appropriately, however all waste drums must be clearly marked
showing any hazardous characteristics and contents should be identified on the labels.
Once the drums are full, they should be dated and moved to a satellite storage area that
provides secondary containment or is protected from the elements.
OUTDOOR STORAGE OF MATERIALS: A large waste oil drum is located behind the
garage which provides secondary containment. Be sure to inspect the containment basin to
be sure it can structurally contain any spills from the storage tank. The container should
be labeled.
SPILL RESPONSE AND CLEANUP PROGRAM: There are procedures that the
employees are to practice in responding to and cleaning up spills. No procedures are
formally written. This needs to be implemented in your SWPPP. Training should be
provided once per year to all employees.
EROSION CONTROL ON SITE: The area should be inspected for erosion problems and
remedies determined and implemented. One area of erosion was noticed at the back side of
the property boundaries. The contour of the land slopes to a low area. Sheet flow looked
apparent. To prevent another stormwater discharge point from developing in this area,
attempts should be made to minimize the channelizing of stormwater through this area into
one discharge point from the property. If a discharge point does occur, samples will need
to be taken to ensure no contaminants from the salvage yard area are leaving the property
via stormwater runoff.
ILLICIT DISCHARGE ELIMINATION: No illicit discharge was observed.
WASTEWATER TREATMENT FACILITIES: Not Applicable
STREAM IMPACTS/RESULTS OF SAMPLING: No sampling was conducted as there
was no stormwater runoff at the time of the inspection. The receiving stream (ditch) at the
front of the property line did not appear to have any contamination in it that would result
from runoff from the property.
DISCHARGE OUTFALLS: There appears to be one discharge point at the front and
North side of the drive ways entering Odum's Garage. Please be sure to take your
stormwater samples from this discharge outfall.
SAMPLING REQUIREMENTS: To date, the facility has not taken any stormwater
samples for analysis. The owner was informed that during the next stormwater event,
samples should be taken and sent for analysis. Please contact me at 910-395-3900 Ext. 215
should you have any questions pertaining to the required analyses.
INSPECTION SCHEDULE: None have been developed.
SUMMARY: The SWPPP has not been developed. The plan must cover all areas of
concern listed in General Permit NCG100000.

It has come to the attention of the North Carolina Division of Water Quality that Clayton Logging
has not obtained a Stormwater Permit for the site at 1052 Harvest Street in Durham, North Carolina.
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act (1972) and then delegated to the Division of Water, Quality for
implementation in North Carolina. The NPDES Phase I permitting program for stormwater
discharges was established in 1990. Phasel focused on site and operations planning to reduce
pollutant sources. One of the industries that Phasel regulates through NPDES permits is Used
Motor Vehicle. Parts,_SIC-Cod e-5.0.15,--and-Automotive -Wreck ing__for_Scrap,-SIC_Code_5093..--A___
General Permit (No. NCG100000) became effective September 1, 1992.
The discharge of stormwater from a Used Motor Vehicle site to waters of the State without a permit
is a violation of NCGS 143-215.1(a)(1). This office is considering recommending to the Director of
the Division of Water Quality that civil penalties be assessed against your company for these
violations. NCGS 143-215.6 provides that violations of 143-215.1 may incur civil penalties up to
$25,000 per violation per day. Any response submitted to this office within 10 days of receipt of
this letter will be considered when making the recommendation.
On April 11, 2003 Mr. Joe Albiston conducted a site visit at Clayton Logging. Stained areas with oil
and other vehicle fluids throughout the site constitute a direct violation of North Carolina General
Statute 143-215.83, which states in part that it is unlawful to discharge oil or other hazardous
substances onto or upon any waters or lands of the state. General Statute 143-215.84 requires the
person having control over the oil or hazardous substance discharged shall immediately undertake
to collect and remove the discharge and to restore the area affected by the discharge as nearly as
possible to the condition existing prior to the discharge.

If any parts, measurement frequencies or sampling requirements contained in this permit are
