Your assistance was very helpful and appreciated during the inspection process. The following observations were made during the stormwater inspection: 1. LKQ is a 14 acre facility arranged to process all model automobiles (foreign & domestic) and light trucks for the self service sale of used parts. 2. The Stormwater Pollution Prevention Plan for this facility contained all the components as required by NCG 100000 with the exception of the list of previous spills occurred within the past three years. The SPPP is currently updated annually. James Environmental Management, Inc. implements the plan for the facility. The facility must continue to aggressively implement the plan. 3. All vehicle fluids are drained and contained. 4. Qualitative and Analytical monitoring was performed as required by General Permit NCG 100000. The facility manager does the sampling. Pace Analytical conduct the analyticals. The facility has one outfall. The site includes a" u-pull'' and car "holding areas". All stormwater flows to the retention pond which outlets as outfall 001. The outfall was assessable for sampling at the time of the inspection. Be sure to properly document in your SP3 compliance with the permit condition (Part II, Section A, l.(d) listed below: A. List of significant spills or leaks of pollutants that have occurred at the facility during the three (3) previous years and any corrective actions taken to mitigate spill impacts. B. Significant spills: Includes; but is not limited to: releases of oil or hazardous substances in excess of reportable quantities under section 311 of the Clean Water Act (Ref: 40 CFR 110.10 and CFR 117.21) or section 102 of CERCLA (Ref: 40 CFR 302.4). 7. Please consider the usability of absorbent sediment traps in the yard drains near the fluid draining area. Attached is information on Wet Detention Basins including operation and maintenance. Miami Blvd, on August 1, 2008. The assistance and cooperation of Mr. Dennis Antkowiak was very helpful and appreciated during the inspection process. The following observations were made during the stormwater inspection: The Stormwater Pollution Prevention Plan for this facility contained all the components as required by NCG100000. The facility must continue to aggressively implement the plan. 2. All automotive fluids were in secondary containment. 3, Qualitative monitoring was performed at the facility as required. 4. The material review during the inspection failed to show the location where sampling was performed for 2008. As per Mr. Antkowiak, James Environmental has' conducted the monitoring and lab analysis and the results should be at the facility in the near future. The facility must provide a copy of the 2008 analytical monitoring. 5. All sample locations around the back perimeter of the salvage yard need to be more assessable for sampling. This permit expires on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued coverage under the general permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid Stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion.
