Hi Dave,
We've received NOls for two existing facilities in your region:
NCG080920 — Noble Oil Services in Lee County. This site discharges stormwater at three points to Little Buffalo Creek
(Class Q. The N01 is attached. I know you're already familiar with this facility, and there aren't any surprises with their
application.
NCGO80921— Vitran Express in Durham County. This site discharges stormwater at two points to an unnamed tributary
to Northeast Creek (Class WS-V;NSW). This particular segment of Northeast Creek is not on the 303(d) list, but the
segment downstream is shown as impaired due to copper, low DO, FC, and turbidity. The NOI is attached.
Please let me know if the Raleigh Regional Office has any concerns about issuing these COCs. Please also let me know of
any potential impacts to wetlands. If we don't receive any objections, we'll issue the COCs in 30 days.

Hi Chan,
Thank you for sending this additional information. After reviewing this information and conferring with our regional
staff, staff in the NPDES Wastewater Unit, and looking into permits for other facilities with similar activities, we can now
recommend that the appropriate permit for the Noble Oil Services facility is the NCG08 general stormwater permit.
Since there is no discharge from the secondary containment area, a wastewater permit is not required. We feel
comfortable covering this facility under the NCG08 permit since it addresses the stormwater constituents we'd be most
concerned about (TSS, non -polar oil and grease/TPH). With that being said, if a problem were to arise in the future, we
will retain the authority to require an individual permit for this facility.

It was nice talking to you earlier. You indicated that you had not received my first email following our site visit, so I am
re -sending it (see attachment).
After I sent my first email, it came to my attention that an NPDES stormwater permit may be needed in addition to the
NPDES point -source discharge permit, at least temporarily. The point -source permit would cover Outfalls #1 and #2
which capture discharges from the secondary containment area. Discharge from Outfall #3, nearest the "boneyard"
area, would not be included in the point -source permit, and therefore would need to be covered under a stormwater
permit. The most appropriate stormwater permit in this scenario is the NCGO8 general permit.
Our thinking is that this facility needs coverage under both of these permits in the near term, but that you may be able
to request rescission of your NCG08 permit once work is completed to re -grade the site, essentially eliminating Outfall
#3.
I'd like to get your thoughts on this. Please feel free to contact me or Joe Corporon if you have questions about either of

Based on our conversation this morning, I understand that the applicant's ASTs are surrounded by bermed areas
[secondary containment for fuels > 1 million gallons), but that the applicant contends all trapped stormwater is
collected, tanked, and recycled at a permitted facility off -site — i.e., there is no discharge from the bermed area.
The NPDES Unit therefore concludes that no individual NPDES permit is required.

We are now using, "Non -polar Oil and Grease by EPA Method 1664 (SGT-HEM)" with a stormwater benchmark of 15
mg/L.
This test measures a smaller subset of the previous O&G method. We understand that the current method targets the
petroleum hydrocarbons, but excludes the animal/vegetable FOG that the previous method measures.
Which makes sense to us — we're concerned about petroleum materials originating from vehicle maintenance, and most
folks don't use much tung oil, olive oil, or lard any more in truck engines.

Mr. Chung,
Thank you for taking the time to meet with DWQ staff yesterday to discuss permitting options for the Noble Oil Services
facility in Sanford. I brought all the information we gathered back to our permitting staff for consideration. I had
initially believed the facility could be covered under one of our NPDES stormwater permits, either general or individual.
But through discussions with permitting staff, I learned that because the amount of above -ground petroleum bulk
storage capacity on the site exceeds one million ,the facility would not qualify for a stormwater permit. Instead,
it will need to be covered under an individual NPDES pc in# -source discharge permit.
NPDES point -source permits are handled by our Point Source Branch. I'd recommend you get in touch with Joe

Additional Information for Question 14d.
Non Bulk (drummed) hazardous waste is stored in a box trailer as part of our 10-day temporary
storage prior to transport to an approved TSD facility. The box trailer is located in the flood
plain, but can be relocated to higher ground as needed. NCDENR - Division of Hazardous Waste
has inspected the trailer as part of its own inspection of the facility as a large Quantity
Generator and as a 10-day Hazardous Waste Transporter. Bulk hazardous waste is rarely kept
on site but would be stored in tanker trailers located in the facility parking areas but can be
relocated as needed.

Withers & Ravenel (W&R) has prepared this letter on behalf of Noble Oil Services, Inc. (Noble) as a follow
up to our recent on site meeting with you, David Parnell and Tom Ascenzo of the North Carolina Division
of Water Quality (DWQ). We appreciate your willingness to meet us on site to develop a coordinated
effort for the permitting of the stormwater discharges from the Noble Oil facility. To summarize the
content of your first visit to the facility, and because we have recently obtained a topographic survey of
the site, we have prepared this letter and an attached exhibit to help DWQ better understand how
stormwater is currently managed at the facility.
We will begin with a narrative description of Noble's operations. The narrative details operations
conducted both within buildings or secondary containment structures and those industrial operations
conducted outside secondary containment structures where such operations come into contact with
precipitation and stormwater runoff.
OPERATIONS INSIDE SECONDARY CONTAINMENT OR BUILDINGS
Noble receives shipments of used oil via truck and railcar. Noble also sends its finished product in
railcars, -All loading and offloading operations have specific spill collection systems associated with those
processes.., For,the trucks, all transfer operations occur in a covered, diked concrete pad area. Any oil or
water that drips -.on the pad is collected in a sump. Railcars to be processed or loaded are placed on a
section of rail spur that has a pan style collection system. This system collects any product, used oil, or
stormwater.that may drip from the railcar and associated piping. All fluid collected from the concrete pad
area and at the railcars is pumped directly to the process area for recycling.
Noble's used oil recycling processes and above ground storage tanks are all located within a secondary
containment structure. The maintenance shop, used oil filter recycling, and truck and equipment repair
operations are all contained entirely within buildings that contain internal dikes and floor drain systems.
These floor drain systems are combined with water collected from inside the secondary containment
structure. All water streams, either produced or collected, remain entirely within the secondary
containment structure and are pumped and hauled by tanker to one or more offsite treatment facilities in
the State. This includes stormwater that has been collected either inside the secondary containment
structure, at the concrete pad area, or within the railcar containment system. None of these water
streams discharge to surface waters.

OPERATIONS OUTSIDE SECONDARY CONTAINMENT OR BUILDINGS
Currently the only operations that are conducted outside secondary containment or buildings includes the
storage of saivage equipment on an unpaved lot on the southwestem portion of the property, the parking
of tanker trailers and trucks on asphalt and concrete paved parking lots, and the storage of bins and roll -
off boxes containing drained and compacted used oil filters as scrap metal pending shipment offsite for
recycling.
Railcars with used oil that will be processed are located within the facility gates over the pan style
collection system. Railcars that are not inside the facility gates, but on Noble's property, are not
processed and remain sealed and ready to move in accordance with Federal Railroad Administration
standards. -- ' . .
Stormwater on the property discharges from the property at three outfalls as shown on the attached
Figure 1. The following paragraphs describe each outfall:
Outfall No. 9
This outfall consists of two yard inlets connected to a single 18-inch diameter reinforced concrete
drainage pipe that discharges to the north property boundary and wet weather ditch. This outfall consists
of a relatively small area of the facility, less than 5,000 square feet. No used oil handling operations are
conducted in this area.
Since the date of your site visit and to provide an additional layer of environmental protection, Noble plans
to eliminate Outfall No. 1 and convert its drainage system into a sump system. This new system will have
a dedicated pump that will pump and transfer collected stormwater from the sump directly to above
ground tanks at Noble's processing area (which is located within the secondary containment structure) for
recycling with all other used oil and water source collections or shipment to an offsite disposal facility.
This improvement to eliminate Outfall No. 1 further reduces the possibility of impacted stormwater leaving
Noble's property boundaries.
Outfall No. 2
This outfall only includes stormwater discharges to surface water from the asphalt paved parking lots,
driveways and the roofs of the buildings on the property. As previously described, stormwater in the
secondary containment structure is not discharged to surface water, but is instead processed and reused
in the recycling operation or transported via tanker to an offsde disposal facility.
Stormwater from the drainage area for the 140,000 square foot area for this outfall is routed to the area
west of the secondary containment structure on the north central portion of the property and passes
beneath the rail spur lines with four CMP pipes. The stormwater discharges are passed through two
cascading retention ponds prior discharging to a swale on the northern property boundary.

Outfall No. 3
This outfall includes the western portion of the facility. It includes the unpaved lot used for storage of
salvage equipment from the facility operations. This lot measures apprcAmately 40,000 square feet. This
outfall also includes the majority of the runoff from the concrete paved truck parking lot.
All runoff water from the paved lots used for truck and tanker parking is routed through a concrete vault
that is designed to serve as an oil water separator. Treated water from the separator discharges -to a
swale on the southeast side of the rail spur into the property. The swale joins a larger swale that .runs
from the south property boundary and generally north-northwest across the lot and crosses beneath the
rail spur in a single pipe. As such, this outfall only contains stormwater exposures from the parked tankers
and the salvage equipment yard.
DISCUSSION REGARDING STORMWATER PERMITTING
The Noble facility does not discharge process related water nor stormwater that contacts either the used
oil recycling operations or bulk storage tanks to surface waters. The facility is equipped with a secondary
containment structure and buildings with floor drain systems that collect stormwater for reuse or offsite
treatment/disposal rather than discharge such water to surface waters. As such, it appears that in the
absence of a general NPDES permit for used oil recycling operations in North Carolina the appropriate
permit under the State's current permitting authority would include an individual permit for stormwater
discharges. We respectfully request your concurrence that such an individual permit is appropriate and
required. With your permission, we will proceed in that direction.
