1) The City Of Durham is not responsible for goods delivered or services performed without authority of its written order.
2). In this purchase order, the term "goods" includes "goods" as that term is used in the Uniform Commercial Code (N. C. version), apparatus,
materials, supplies, and equipment.
3) E-Verify Compliance. The contractor represents and covenants that the contractor and its subcontractors comply with the requirements of
Article 2 of Chapter 64 of the North Carolina General Statutes (NCGS). The City is relying on this E-Verify Compliance section in entering into
this contract. The parties agree to this section only to the extent authorized by law. If this section is held to be unenforeceable or invalid in whole
or in part, it shall be deemed amended to the extent necessary to make this contreact comply with NCGS 160A-20.1(b).
4) Do not overship or substitute. Ship exactly as ordered. If unable to fill this order exactly in accordance with description unit and price
thereon communicate at once with the Purchasing Division for instructions. The City reserves the right to reject and return at shipper's expense
any and all goods delivered which do not conform to our description or specification. All goods received subject to inspection and acceptance
by the City of Durham.
5) All shipping charges must be FULLY PREPAID TO POINT OF DELIVERY, unless otherwise arranged for and expressly stated on this
order. Store -Door deliveries are not acceptable.
5) Include itemized packing slips with all shipments or deliveries. Show name of DEPARTMENT of the City for which delivery is intended.
7) Invoices in duplicate, should be mailed to the address listed on the purchase order. Invoices must reference the purchase order number.
The City pays State and local sales tax; please add State and Local (when applicable) sales tax to your invoice.
8) CASH DISCOUNT TERMS: Time in connection with discount offered will be computed from date of delivery of the goods at destination, or
when final inspection and acceptance is made, if the latter date is later than the date of delivery.
9) If there is any part of this order you cannot fill promptly or within the time specified, notify the Purchasing Division at once. In case of
unreasonable delay in delivery or delivery of goods inferior to those specified, or in case of any other default of the vendor, the Purchasing
Division shall have the right at its option to cancel this order in whole or in part, and the City may procure the goods, or services from other
sources, and hold the vendor responsible for the EXCESS COST, EXPENSE AND DAMAGES occasioned thereby.
10) Warranties and Indemnification. In addition to other warranties made in this transaction, Vendor represents and warrants that all of the
goods furnished under this purchase order, the process by which those goods are made, and their use will not infringe any patent, trademark, or
other rights of any other person, firm, or corporation, and Vendor shall defend, indemnify, and hold harmless City and its officers, officials,
agents, contractors, and employees from and against any and all claims, judgments, costs, damages, losses, demands, liabilities, obligations,
fines, penalties, royalties, settlements, and expenses (including interest and reasonable attorney's fees assessed as part of any such item)
arising out of any (i) actual or alleged infringement of any such patent, trademark, or other rights, or (ii) (except to the extent that the personal
injury, death, or property damage is caused solely by negligent or intentional acts or omissions of the City) personal injury, death, or property
damage allegedly caused by or resulting from the delivery to the City of, or the manufacture, construction, design, formulation, development of
standards, preparation, processing, assembly, testing, listing, certifying, warning, instructing, marketing, selling, advertising, packaging, or
labeling of any goods furnished to the City under this purchase order. Without reducing,City's rights under this section, Vendor, in case of an
actual or threatened claim, may at Vendor's option and expense procure for City the right to continue using the goods furnished under this
purchase order. (The preceding sentence does not pertain to part "(6)" of the first sentence of this section.)
11) The workmanship, quantities or qualities of goods delivered or services performed which are to be paid for hereunder shall be to the
satisfaction of the City and before final acceptance by the City all matters of dispute must be adjusted to the mutual satisfaction of the City and
the vendor. Determinations and decisions, in case any questions shall arise, shall constitute a condition precedent to the right of the vendor to
receive any money thereof, until the matter in question is settled.
12) The individuals appearing to execute this purchase order on behalf of the Vendor warrant jointly and severally that they have authority to
execute this purchase order on behalf of the Vendor.
13) This purchase order shall be deemed made in Durham County, North Carolina, and shall be governed by and construed in accordance
with the law of North Carolina. The exclusive forum and venue for all actions arising out of this purchase order shall be the North Carolina
General Court of Justice, in Durham County. Such actions shall neither be commenced in nor removed to federal court. This section shall not
apply to subsequent actions to enforce a judgment entered in actions heard pursuant to this section.
14) THE CITY OF DURHAM OPPOSES DISCRIMINATION ON THE BASIS OF RACE AND SEX AND URGES ALL OF ITS CONTRACTORS
TO PROVIDE A FAIR OPPORTUNITY FOR MINORITIES AND WOMEN TO PARTICIPATE IN THEIR WORK FORCE AND AS
SUBCONTRACTORS AND VENDORS UNDER CITY CONTRACTS. During the performance of this Contract the Vendor agrees as follows: (a)

solicitations or advertisements for employees placed by or on behalf of the Vendor, state that all qualified applicants will receive consideration
for employment without regard to race, color, religion, sex, national origin, political affiliation or belief, age, or handicap. (c) The Vendor shall
send a copy of the EEO provisions to each labor union or representative of workers with which it has a collective bargaining agreement or other
contract or understanding. (d) In the event of the Vendor's noncompliance with these EEO provisions, the City may cancel, terminate, or
suspend this contract, in whole or in part, and the City may declare the Vendor ineligible for further City contracts. (e) Unless exempted by the
City Council of the City of Durham, the Vendor shall include these EEO provisions in every purchase order for goods to be used in performing
this contract and in every subcontract related to this contract so that these EEO provisions will be binding upon such subcontractors and

As a result of a recent stormwater audit you conducted at Durham's Department of Solid
Waste Facility, we have corrected your findings as follows.
1. Stormwater SDO003 was mentioned in our Stormwater Pollution Prevention Plan.
Please locate, validate and verify stormwater outfall SDO 003 at the solid waste site
and implement sampling and monitoring as required. The SDO 003 was a typo. The
plan has been updated to reflect two outfalls at the permitted location; each
have been validated and verified. Outfall SD0001 receives water runoff from.
the truck wash area, and Outfall SD0002 is located at the NE point at the end of
the drive way across from the employee parking lot.
2. Please clear vegetation, brush and debris from stormwater outfall SDO 002 to make
assessable for stormwater sampling and monitoring at the facility, The debris has
been cut and will be maintained as needed.
3. Collect and perform analytical qualitative sampling as required by part 11, Section B
of General Permit No. NCGO80000. Records show that outfalls are being monitored
once a year and not as required. All outfall sampling will take place by permit
twice a year. Since vehicle maintenance activities are no longer performed • at
this facility, ,the analytical monitoring required by the permit is not triggered.
We will only perform qualitative monitoring going forward.
4. Please include all stormwater outfalls with directional flows on the site map within
the stormwater pollution prevention plan. This has been created and placed into
the plan. Flow direction arrows have been added to the SWPPP.
5. BMPs should be placed at each stormwater yard drain. Recommend BMPs such as
pig tail sediment booms with sediment basket catch material in each yard drain. The
required storm drains were wrapped with mesh in an effort to keep sediment
and rocks out of the stormwater drain. Each drop inlet will be inspected.

6. The Stormwater Pollution Prevention Plan need to address Part 11 Section A, (2)
feasibility study. A feasibility study has been added to the SWPPP. The
feasibility study includes both base line and site specific BMPs.

Mack Wiggins of the North Carolina Division of Water Quality, Surface Water. Protection Section,
Raleigh Regional Office, conducted a stormwater compliance evaluation inspection of the City of
Durham Department of Solid Waste Facility on June 22, 2011, at 1833 Camden Avenue in Durham.
The assistance of Mr. Robert Williams was very helpful and appreciated during the inspection process.
The facility was found to be in Compliance with General Permit NCG080000 at the time of this inspection.
The following observations were made during the stormwater inspection:
1. The Durham Solid Waste Facility engages in the storage of recycling containers, solid waste
vehicle storage and the washing of solid waste vehicles.
2. The facility site has two outfalls (SDO 001 & 002) for stormwater runoff. The stormwater
pollution prevention plan mentioned a third outfall. Only two Stormwater outfalls were
verified at the time of the inspection. SDO 001 receives stormwater runoff from the wash bay
area, building roof drains -and grounds in front of the facility along Camden Avenue. SDO
002 receives stormwater runoff from the northeastern point of entry onto the facility grounds
and drive way area. Stormwater outfall SDO 001 was clear of free of debris and assessable
for stormwater sampling. Stormwater Outfall SDO 002 was not assessable for stormwater
sampling at the time of the inspection.
The stormwater plan did address BMPs as required. At the time of the inspection BMPS
were not in place to minimize contaminants in the stormwater runoff.
4. Qualitative and Analytical monitoring was performed at the stormwater outfalls but not as
required by NCG080000. Records revealed that sampling had been conducted once a year,
but not twice per year in accordance with Part II Section B, Table 2 of General Permit NO.

5. The Solid Waste Facility collects the stormwater samples and ENCO performs the
analyticals.
6. The Stormwater Pollution Prevention Plan contained all items as required by General Permit
NCG080000 with the exception of the feasible alternatives to current practices, spill history
documentation. The site map showing outfall locations did not show the second and third
outfalls and stormwater directional drainage flow. The plan has been implemented and is
updated -once a year.

Dear Mr. Lucas:
Mack Wiggins of the Division of Water Quality, Raleigh Regional Office, Surface Water Protection
section, conducted a Stormwater compliance evaluation inspection of the City of Durham Public Works
Operation Center, Martin Luther King Boulevard on June 20, 2011. The assistance offered by you and
Mr. Daniel Walker was very helpful and appreciated during the inspection process.
The following observations were made during the stormwater inspection:
1. Durham Public Works Operation Center keeps and maintains all public works street and
sewer maintenance equipment and vehicles..
2. The site had four outfalls. At the time of the inspection stormwater outfall SDO 001which
receives stormwater from the northern edges of the facility in a grass lined swale and
discharges to the east side, has been eliminated and can no longer discharge. An earthen
berm was created around the discharge point at SDO 001. Stormwater SDO 002 receives
stormwater from around the building, road and parking areas and from stormwater drains on
the eastern side of the building. Stormwater SDO 003 receives stormwater from around the
building, road and parking areas and from stormwater drains on the east and western side of
the building. Stormwater SDO 004 receives stormwater from the northwestern portion of the
facility and discharges to the west into a tributary of third fork creek. All outfalls were
observed and were accessible for sampling.
3. Analytical and Qualitative monitoring was performed at the stormwater outfalls as required
by NCG080000. Stormwater outfalls SDO 002 & 003 previous results were high in Total
Suspended Solids. To reduce the solids sedimentation bags were placed in the east, west and
northwestern stormwater drain outlets at the facility. The parking areas are swept weekly.

4. The maintenance shop floor drains and oil container storage and placement were inspected.
The French drains in the shop are connected to oil/water separators. The liquid goes on to
sanitary sewer and the solids are pumped out by Noble Oil.
1. Requirements:
1. Update the Stormwater Pollution Prevention Plan annually. Cover page must show current
date updated.
2. List spills occurring during the past three years if any. Update this list when the plan is
updated annually. Address if no spills occurred during the past three years when the plan is
updated annually.
3. Include the feasibility study in your Stormwater Pollution Prevention Plan.
4. All oils in the attachments A and B must be placed on secondary containment.

The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A —A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part 11 Section B Table 1 — An increased sampling frequency from once per year to twice per year,
• Part 11 Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part 11 Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part Il Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
