In accordance with your letter requesting general permit coverage for your Rocky Mount Rip Track Maintenance Area
received on March 14, 2000 we are forwarding herewith the subject certificate of coverage to discharge under the subject state -
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983.
The permit previously held by CSX Transportation for this site, NCS000317, is rescinded immediately upon issuance of this
new Certificate of Coverage for the NCGO80000 general stormwater permit. The NCGO80000 general stormwater permit did not
cover railroad maintenance at the time that CSX Transportation received their initial individual permit. However, the general permit
was reissued to include this type of activity on September I, 1997, allowing your Rocky Mount site coverage.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have
the right to request an individual permit by submitting an individual permit application. Unless such demand is made, this certificate
of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality.
The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local
governmental permit that may be required.

Response to Notice of Violation (REF: NOV-2008-OC-0003, BIMS Incident #200800445)

Dear Mr. Smith:
This letter serves as a response to the Notice of Violation dated March 12, 2008 referencing a compliance
evaluation inspection (CEI) on 20 February 2008 at the CSXT facility located at 2501 SW Main Street in
Rocky Mount, ded below is a brief discussion of each of the compliance evaluation inspection
findings under CGO80639. or clarity, we are using the numbering scheme provided in your March 12, 2008
correspondence.
Item 4(13)(1): Review of the stormwater pollution prevention plan (SP3) revealed that it does cover the OWS
and miscellaneous other areas/activities at the yard, such as locomotive sanding and the storage yard to the
south of the fueling station. However, the SP3 does not cover the railcar maintenance area/activity as required
in the permit. This activity/area must be incorporated into the SP3 and SDOs and drainage areas for the
railcar maintenance area must be identified and monitored for both analytical and qualitative parameters, as
well as incorporated into each SP3 component as required in the permit.
Corrective Action/Response: Activities performed at the Car Shop (i.e. railcar maintenance area/activity) is
managed under the current SP3. This area is included in "Drainage Area 02", which is described in the text of
the plan and shown on the facility drawing. Railcar maintenance activities are performed in a designated
maintenance area under cover. The maintenance area is located in the middle of the railyard and surrounded by
track ballast. Storm water from this area typically puddles in place and evaporates or infiltrates through the
ballast. In order to further clarify activities associated with the car shop, Table 2-4 (Pollutant Source
Identification) is amended to include "Railcar and Vehicle Maintenance" activities with management practice
descriptions.
Item 4(B)(2): The car spotter in the railcar maintenance area was observed to be leaking excessive amounts of
oil, or other petroleum products, on the ground beneath it and had no drip pan or other containment device to
capture the leaking fluids. The car spotter is stored outside and exposed to precipitation; hence the leaking
fluids are carried off by stormwater runoff. A Best Management Practice (BMP) must be developed to stop this
source of pollution.

Correction Action/Response: The car spotter is utilized to move railcars in and out of the Car Shop. Actions
were taken to clean the area using adsorbent pads and the car spotter has been taken out of service. A new car
spotter is being used. In addition, Table 2-4 of the SP3 has been amended to include BMPs for railcar
maintenance activities.
Item 4(B)(3): The SP3 mentions the storage yard that is located just south of the fueling station, but
observation of the yard revealed that there are some items stored there, such as railroad cross ties and
transformers, that have a pollution potential and should either be moved to inside storage or kept covered with
rainproof covers at all times when not in use. This is a BMP that should be added to the SP3 and it also
applies to any other areas of the yard where products with pollution potential are stored.
Correction Action/Response: Materials observed during the CEI have been scheduled for removal from the
facility. Typically, cross -ties are temporarily staged at the facility for off -site disposal, reuse, or cogeneration.
Indoor storage or covering of these used cross -ties is not a standard industry practice. Cross -ties are used in
outdoor service and have been shown to not adversely impact stormwater. The SP3 addresses new and/or used
material storage and states that these storage areas are periodically inspected and corrective actions taken as
necessary.
Item 4(B)(4): The site plan for the SP3 did not include an accurate latitude/longitude for SDO 001 and its
drainage area was not clearly delineated on the plan. This also must be corrected. Again, the site map must
also be updated to include the drainage areas and SDOs, with accurate latitudes/longitudes, for the railcar
maintenance area.
Correction Action/Response: The latitude/longitude for SDO 001 has been added to the SP3 drawing. The
drainage area for SDO 001 is clearly defined as "Drainage Area 01". The WWTF receives drainage from a
series of catch basins located near the locomotive refueling area. The drawing shows this in addition to the
approximate location of the underground pipe that directs flow to the WWTF prior to discharge. Drainage Area
02 also depicts an additional location of industrial activity. As previously discussed, storm water from this area
typically puddles in place and evaporates or infiltrates through the ballast.
Item 4(B)5: In light of the diesel fuel spill that occurred on 13 February, it is strongly suggested that both CSX
and CEVA examine the fueling operation and make the changes necessary to prevent future spills of this
nature, including any structural or non-structural BMPs that would improve the fuel transfer process and the
containment structure(s) in and around the fueling station.
CSXT and CEVA are in the process of evaluating the existing structural and non-structural BMPs and will
address this item further under a separate cover.

Event Description: Caller reported a diesel fuel spill of approx. 1,000 gallons due to a possible valve failure while a tanker truck was refueling a
locomotive at a refueling station in RM rail yard. Originally reported as 100 gallon spill, but amount changed and confirmed with Mr. Brinski when
NRC report was sent. Company personnel have placed booms and pads to contain the spill. Hepaco is enroute for cleanup. It is unknown at this
time if any water sources were affected.

Ron Boone, of the North Carolina Division of Water Quality (DWQ), Raleigh Regional Office (RRO), Surface Water
Protection Section (SWP), investigated a diesel fuel spill at the subject site on 13 February 2008 and subsequently
conducted a compliance evaluation inspection (CEI) at the site for the subject permit (NCG080639) on 20 February
2008. The assistance and cooperation of Mr. Mike Gregory, CSX's Supervisor Environmental Field Services, was
greatly appreciated.
The facility is located at 2501 SW Main Street, in Rocky Mount, Edgecombe County, NC. The NCG080639 permit,
as it applies, allows the discharge of stormwater from point source discharges associated with activities classified as
Rail Transportation [Standard Industrial Classification (SIC) 40], which include vehicle maintenance areas and/or
oil/water separators (OWS). NCG080639 authorizes the discharge of this stormwater to receiving waters designated
as an unnamed tributary to Little Cokey Swamp, which is currently classified as Class C, nutrient sensitive water
(NSW) in the Tar -Pamlico river basin. The single stormwater discharge outfall (SDO) currently identified by CSX
(SDO 001) under NCGO80639 is located at approximate latitude/longitude 35°55'27.34"N, 77°47'47.62"W.
3. This permit effectively covers the OWS located at the fueling station where the above -mentioned diesel fuel spill
occurred, as well as the railcar maintenance area located near the center of the rail yard and south of the fueling
station. The discharge from the OWS flows to an industrial wastewater treatment facility that was formerly used to
treat industrial wastes produced by processes that have since been discontinued and for which the old NPDES

discharge permit has been rescinded. This facility is.iocated-on the northeastern edge of the yard, just east of the
fueling station. It is now simply used as a storage/holding basin for the OWS effluent before being discharged. OWS
effluent first flows to a pump tank and is then pumped into one of two large circular storage basins. It then flows to a
second OWS before it is discharged through the SDO.
4 VIOLATIONS
A. DIESEL FUEL SPILL:
1. Based upon observations made on 13 February 2006 by both Mr. Boone and DWQ specialist Mr. Mack
Wiggins, a diesel fuel spill of approximately 1,800 gallons occurred at the Rocky Mount CSX Transportation
yard. Upon arrival at the site, environmental clean up contractor Hepaco was in the process of containing and
cleaning up the spill. The majority of free product had already been contained or recovered, but there was
still a fair amount of free product and sheen on the ground and it is estimated that several tons of soil had been
contaminated. On site representatives for Hepaco and CSX stated that the fuel had not contaminated any
surface water supplies.
2. This diesel fuel spill is a violation of North Carolina G.S. 143-215.83(a), Unlawful Discharges, which states
that it shall be unlawful for any person to discharge oil or other hazardous substances into or upon any waters
or lands within the state. The NC Division of Waste Management, UST Section, will address this violation
by separate correspondence.
B. STORMWATER COMPLIANCE EVALATION INSPECTION, NCG080639:
Review of the stormwater pollution prevention plan (SP3) revealed that it does cover the OWS and
miscellaneous other arcas/activities at the yard, such as locomotive sanding and the storage yard to the south
of the fueling station. However, the SP3 does not cover the railcar maintenance area/activity as required in
the permit. This area/activity must be incorporated into the SP3 and SDOs and drainage areas for the railcar
maintenance area must be identified and monitored for both analytical and qualitative parameters, as well as
incorporated into each SP3 component as required in the permit.
2. The car spotter in the railcar maintenance area was observed to be leaking excessive amounts of oil, or other
petroleum products, on the ground beneath it and had no drip pan or other containment device to capture the
leaking fluids. The car spotter is stored outside and exposed to precipitation; hence the leaking fluids are
carried off by stormwater runoff. A Best Management Practice (BMP) must be developed to stop this source
of pollution.
3. The SP3 mentions the storage yard that is located just south of the fueling station, but observation of the yard
revealed that there are some items stored there, such as railroad cross ties and transformers, that have a
pollution potential and should either be moved to inside storage or kept covered with rainproof covers at all
times when not in use. This is a BMP that should be added to the SP3 and it also applies to any other areas of
the yard where products with pollution potential are stored.
4. The site plan for the SP3 did not include an accurate latitude/longitude for SDO 001 and its drainage area was
not clearly delineated on the plan. This also must be corrected. Again, the site map must also be updated to
include the drainage areas and SDOs, with accurate latitudes/longitudes, for the railcar maintenance area.
5. In light of the diesel fuel spill that occurred on 13 February, it is strongly suggested that both CSX and CEVA
examine the fueling operation and make the changes necessary to prevent future spills of this nature,
including any structural or non-structural BMPs that would improve the fuel transfer process and the
containment structure(s) in and around the fueling station.

4. REOUIRED CORRECTIVE ACTIONS
A. DIESEL FUEL SPILL:
1, Provide a written report to the DWQ-SWP that explains in detail the events leading up to and causing the
spill. This report must also specify how much fuel was spilled and recovered, how much contaminated soil
was removed and how it was disposed and what actions CSX/CEVA plans to take to prevent future spills of
this nature. Also, you must provide copies of receipts or other documentation showing how the contaminated
soil was disposed.
2. It is also requested that CSX/CEVA provide copies to DWQ-SWP of any monitoring, analysis (soil) and/or
responses regarding this matter that may be requested of you by the NC Division of Solid Waste, UST
Section.
B. STORMWATER COMPLIANCE EVALATION INSPECTION, NCGO80639:
1. Provide a written report that specifies what corrective actions CSX will take to correct the discrepancies noted
above in paragraphs 4(B)(1-5). The written correspondence should specifically define all corrective actions,
as well as provide an implementation schedule for those corrective actions with an estimated completion date.
Thank you for your attention to this matter. Please note that each violation of NCGS 143-215.75 is subject to civil
penalties of up to $5,000 and violations of the NCGO80639 permit and G.S. 143-215.1 are subject to civil penalties of
up to $25,000 per day per violation. Your response to this NOV will be considered in determining whether or not
civil penalties should be assessed. We will also review your response such that the appropriateness of an individual
stormwater permit may be considered. The Division must receive your response within 30 days of your receipt of this

Information received by this office in a complaint on February 14, 2008 confirms a release or discharge of
petroleum as a result of overfilling aboveground diesel tanks. This office has determined that you are responsible
for the release. The release has resulted in specific violation(s) of North Carolina General Statute 143-215.75 et
seq., Oil Pollution and Hazardous Substances Control Act. This letter explains the violations and the associated
corrective actions that you must take to bring the site into compliance. The Division of Waste Management, UST
Section administers the required responses for petroleum releases in accordance with the General Statute
143,215.75 et 5eMc ., the Oil Pollution and Hazardous Substances Control Act, and with Title 15A NCAC
Subchapter2L, Groundwater Classifications and Standards.
The specific violations of General Statute 143-215.75 et seg., are as follows
1) G.S. 143-215.83 (a) Unlawful Discharges:
It shall be unlawful for any person to discharge oil or other hazardous substances into or upon any waters
or land within the state;
To correct the violations, the following actions are required in order to bring the site into
compliance:
1) You must cease discharging all 'oil" or other hazardous substances into or upon the waters or
land of the state;
2) You must contain and remove free product;

3) You must remove and properly dispose of all contaminated soil exceeding the soil -to -
groundwater maximum contaminant concentrations(MSCCs); and
4) You must perform soil assessment to confirm removal of contaminated soil using the procedures
and analytical methods specified in the appropriate sections of UST Section Guidelines for the
Investigation and Remediation of Soils and Groundwater.
Within 30 days of the receipt of this notice, you must complete these corrective actions and
submit an Initial Assessment Report, prepared in accordance with the most recent version of the UST
Section Guidelines for the Investigation and Remediation of Contamination from Non -UST
Petroleum Releases, which indicates the nature and the extent of the release and describes initial response
and abatement actions, including removal of free product and removal of contaminated soil and
subsequent soil sampling to confirm cleanup to the Raleigh Regional Office of the UST Section.
Penalties may be assessed for the violation(s) described within this Notice of Violation. Your
prompt attention to the items described herein is required. Failure to comply with the State's rules, in the
manner and time specified, may result in the assessment of additional civil penalties and/or the use of
other enforcement mechanisms available to the State. Each day that a violation continues may be
considered a separate violation.

NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-2 15 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983.
The permit previously held by CSX Transportation for this site, NCS000317, is rescinded immediately upon issuance of this
new Certificate of Coverage for the NCGO80000 general stormwater permit. The NCGO80000 general stormwater permit did not
cover railroad maintenance at the time that CSX Transportation received their initial individual permit. However, the general permit
was reissued to include this type of activity on September 1, 1997, allowing your Rocky Mount site coverage.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have
the right to request an individual permit by submitting an individual permit application. Unless such demand is made, this certificate
of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality.
The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local
governmental permit that may be required.

Rocky Mount
Edgecombe County
to receiving waters designated as an unnamed tributary to Little Cokey Swamp, a class C NSW stream in the Tar -
Pamlico River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set
forth in Parts 1, II, III, IV, V, and VI of General Permit No. NCGO80000 as attached.
This Certificate of Coverage shall become effective October 6, 2000.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
