On August 17, 2011, 1 made a follow-up inspection to the one made on April 7, 2011. As before, your
help was greatly appreciated. A Stormwater Pollution Prevention Plan (SP3) was available, and
improvements had been made at the 550 gallon used oil storage tank. The tank had a water -tight
concrete block secondary containment with a roof over it. By design, the tank had no drain.
Modifications to the oil removal piping are planned for the near future to more easily allow emptying of
the tank by an oil recycler. At the back of the yard where remnants of a few trucks are stored, steps had
been taken to cover an engine with a tarp and to cap a saddle tank to eliminate those potential sources of
pollution. This facility is exempt from analytical sampling because the volume of used oil motor oil is
below the threshold of 55 gallons per month.
A few minor improvements to the Stormwater Plan are suggested:
1. A more detailed spill response plan is needed, to include a list of responders and -their telephone
numbers, a clear description of where spill kit materials are located, and instructions for disposal
of cleanup materials.
2. A list of responsible parties for your company should be listed, with contact information, near
the front of the plan.
3. The two fuel pumps are idle right now, but when they are put back into service, please follow
through with plans to remove the hold-down devices so that drivers are required to stay with the
nozzle during refueling.
4. The form on which employee training will be recorded can be improved by providing a line or
two for noting what topics were covered during the training, and what materials (DVD,
PowerPoint, flip chart) were used. This is optional, but other trainers comment that it is helpful
to be able to look back at that information in order to decide what to use in the next session(s).

On April 7, 2011 Mr. Myrl Nisely of the Raleigh Regional Office made an inspection of your site under the above
stormwater protection permit. Your help was greatly appreciated. It was determined that none of the actions
required by the permit had been carried out; specifically, development of a Stormwater Pollution Prevention Plan
(SP3) and activities such as monitoring (testing;) of discharged stormwater, employee training and preparation of a
spill response plan (this is not a complete list of what the plan requires),
A tour of your facility showed the presence of a used oil tank with evidence of oil on the ground and no secondary
containment. You will find a section of the permit that addresses containment. Two fuel pumps with a potential
for accidental release of the fuels should be considered when performing the feasibility study of your site (Part 11
Section A(2)(a). To your credit, a few small empty drums against a fence had been turned upside down to prevent
the entry of rain or standing water on the lids. Vehicle fluids were properly handled in the maintenance building.
Around the perimeter of the yard was a clutter of numerous items, some of which need to be evaluated for
potential to pollute. It was observed that a saddle tank was open to rainwater.
When the permit was issued to you on November 1, 2007, it granted a 12 month period for development of the
SP3. Failure to have it is a violation of the permit. You are directed to respond in writing to this office within 30
days of receipt of this letter with a schedule for when you will have the plan developed.

Inspection Summary:
This trucking company was unaware of their stormwater permit beyond paying the annual fees. The permit was issued in
2007. There was no Stormwater Pollution Prevention Plan, nor any record of stormwater monitoring. A tour of the site
revealed an equipment "boneyard" with many kinds of item scattered about, including a fork lift and two retired tractors,
one with a saddle tank filler hole open to the rain. The owner was encouraged to consider removing metals and tires.
Several drums along a fence were empty and turned upside down, a good BMP.
A copy of the permit text was provided. Mr Bailey was cooperative and committed to correcting this situation. DWQ
should make a.return visit in about 4 to 6 months for an update.

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS §143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least I80 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.
