In response, we have made the following adjustments to stormwater testing processes and procedures. + Violation 1, Stormwater Pollution Prevention Plan (SPPP): After Mr. Michael Lawyer's first visit in 2013 in which he explained all the storm water requirements, we had a misunderstanding for the need of a written plan versus implementing an action plan. After Mr. Layover's second visit in 2019, a SPPP was written and submitted to on February 7, 2019. Recommendations and comments provided by Mr. Lawyer on February 11, 2019 were amended within the document. The SPPP will be maintained and updated as necessary. • Violation 2, Qualitative Monitoring: The Qualitative Monitoring of the run-off ponds were being observed and checked on a semi-annual basis, but we failed to document the monitoring process and results. Moving forward, the qualitative monitoring will be done at the same time as the analytical monitoring frequency and documented. • Violation 3, Analytical Monitoring: Analytical Monitoring was only being performed once a year through 2017, and was a due to a misunderstanding of the requirements, which we now understand to be required semi-annually. The failure of monitoring in 2018 was due to a severe increase in operational responsibilities on Mr. Alan Darr, and the 2018 testing failed to be performed. Calendar reminders for analytical testing have been implemented to ensure that the semi-annual testing is completed moving forward. • Other Improvements: As per Mr. Lawyer's recommendations, we have fuel absorbent material available at the fuel island so spills can be contained before reaching the oil -water separator. Additionally, we are locking out the containment wall so only authorized personnel can access the area as needed. Please do not hesitate to contact me with additional questions. Ezzell Trucking -Sampson, Certificate of Coverage NCGO80331 Sampson County Dear Mr. Ezzell: On January 30, 2019, Mike Lawyer, Environmental Program Consultant from the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR), conducted a site inspection for the Ezzell Trucking -Sampson facility located at 11535 Taylors Bridge Highway in Sampson County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Mr. Alan Darr, Safety Manager, was also present during the inspection and his time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG080000 under Certificate of Coverage NCG080331. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Quewhiffle Creek, a Class C;Sw waterbody in the Cape Fear River Basin. As a result of the site inspection, the following permit conditions violations are noted: Stormwater Pollution Prevention Plan (SPPP) At the time of inspection, a Stormwater Pollution Prevention Plan (SPPP) had not been developed as required by the NCGO80000 permit. Inspection conducted on January 30, 2019 as a follow-up to the inspection conducted on December 20, 2013, which resulted in the issuance of a Notice of Violation. Met with Mr. Alan Darr, Safety Manager, who provided the facility's analytical monitoring records from the time period after the previous inspection to this inspection for review. Records indicate that monitoring results consistently met the benchmark values contained in the previous permit cycle, however sampling was conducted and recorded only once per year from 2014 to 2017 instead of semi-annually as required by the permit and there were no monitoring records for 2018. Qualitative monitoring, which is also required to be conducted semi-annually, was conducted and recorded only once for 2014 and once for 2015 with no records for 2016 to 2018. At the time of inspection, -a Stormwater Pollution Prevention Plan (SWPPP) for the facility could not be provided for review. After the records review, observations of site conditions were made to include the facility's fueling station, oil/water separator, above ground fuel tanks with secondary containment structure, stormwater pond and discharge outfall. Facility appeared to be well operated and maintained. A copy of a SWPPP dated February 7, 2019 was provided to the inspector by Mr. Darr via e-mail on February 8, 2019 as agreed upon during the inspection. A review of the SWPPP was conducted and while it contains the basic components as required by the NCG080000 permit, some recommendations and comments were sent by the inspector to Mr. Darr via e-mail on February 11, 2019. Spill prevention and Response Procedures — List what procedures will be followed at your facility if there is a spill and what equipment will be used. All personnel should be aware of your spill prevention and response procedures. Absorbent pads are used to clean up oil spillage. Absorbing material is kept in water tight container on the fuel island. 6. Storm water management — What measures are in place to control storm water? Also, material handling areas shall be inspected for evidence of, or the potential for, pollutants entering the drainage system. EPA is phasing in the requirements of the rule over a 5-year period. The first phase required regulated entities to submit Data Monitoring Reports (DMRs) electronically starting on December 21, 2016. Mr. Lawyer explained the permit conditions to Mr. Alan Darr, Ezzell Trucking Safety Manager. Until this inspection, Ezzell Trucking was unaware of the requirements and actions the permit requires, Ezzell Trucking has made arrangements with Environmental Chemists, Inc. which monitors our drinking water to also analyze the stormwater after the bi-annual collection. After the permit review a walk through site inspection was done. Mike observed and explained to Alan the various visual inspection points of collection, drainage, filtering, and discharge point. Also a collection point and collection method was established. Environmental Chemists sent collection bottles for testing TSS, Oil & Grease, & pH and Ezzell Trucking purchased a sensor probe from Milwaukee Instruments for timely and accurate testing pH, qualitative monitoring, and analytical monitoring. Additionally, Ezzell Trucking obtained a storage container by Environmental to maintain the collection bottles on ice until the courier picks them up the same day samples are collected. The water sample analysis monitoring reports will be kept on file along with our Storm Water Pollution Plan (SWPP). Ezzell Trucking will be using the template from the website of the US Environmental Protection Agency for our SWPP.
