JOHN R. STRUTNER (TOWN MANAGER), POST OFFICE BOX 255, LAKE LURE, NORTH CAROLINA 28746-0255 has applied for a Department of the Army (DA) permit TO DREDGE SAND AND SEDIMENT FROM THE MOUTH OF LAKE LURE HARBOR IN AN AREA SOUTH OF THE CONFLUENCE OF THE BROAD RIVER AND LAKE LURE IN RUTHERFORD COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show an approximately 600 foot long and 200 foot wide area to be dredged at the entrance of the Lake Lure Harbor where it joins the main navigation channel in Lake Lure. The approximately 3 acre dredge site is situated in an area of high sediment deposition due to its' proximity to the mouth of the Broad River. An eight inch hydraulic dredge owned by the town is to be used to establish a depth of approximately 4.5 feet below the normal low pool elevation contour of the lake. The dredging work is to generate 17,800 cubic yards of silt and sand, all of which will be pumped to an approximately 3 acre diked dredged material disposal basin located to the west of the work site. The purpose of the proposed project is to reestablish safe boating access to and from Lake Lure Harbor. The completed work will also enable a concessionaire authorized by the Town to continue the operation of a boat tour service from docking facilities within the Harbor. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would be performed in accordance with Federal, State, and local permits and regulations governing such activities at the time the maintenance is undertaken. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. , ~ " -2- The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b) (1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the publici Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Environmental Management (NCDEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management (NCDEM), Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. ENVIRONMENTAL SCIENCES !,",';'.'!^U Charles Koontz North Carolina Department of Environment, Health and Natural Resources 59 Woodfin Place Asheville, North Carolina RE: SEDIMENT DEPOSIT ON BEIO PROPERTY ADJACENT TO LAKE LURE CAMPGROUND Dear Mister Koontz: The sediment that has been deposited on site Number One, in the Town of Lake Lure, to date is already starting to flow due to the recent rains we have had. According to the plan McGill Engineering submitted to DEHNR for a permit, there is supposed to be a rip-rap ditch along the west side of the property to direct flow to the river. This has not been done. There is also a seam in the silt fence that is open creating a potential problem. There is another place in the silt fence on the south side of the property where runoff is running under the silt fence filling up one of the drainage ditches with sediment. There is a third place on the southeast side where the silt fence has been taken down to allow for sewer line repairs as requested by the property owner and this also has not been put back in place, It appears that this silt fence is not heavy enough or properly placed to contain the material that is being deposited on this property. This unstable sediment is not being compacted according to the McGill. No silt fence will hold back the flow created by a light rain. If the permit for this site was approved based on the plan submitted by McGill Engineering, it certainly is not being followed. When I talked with you today you stated, and I quote, "Nothing can be done to prevent the problem of sediment runoff. As long as they have a silt fence up they are in compliance Use Easy Text entries to save a signature block, a special notice, some initials, or any information that you usually type often with the permit requirement". It seems a silt fence is the key to all erosion problems, in your opinion. It is my opinion that a silt fence will not hold back that amount of unstable "micaceous" muck that has been deposited, even if it is piled at a 2: 1 slope. These consequences are precisely what I was concerned about when I first contacted you back in October, and referred to in my first correspondence, dated October 14, 1996, as well as all subsequent conversations and correspondence. According to the SEDIMENT A nON POLLUTION CONTROL ACT OF 1973 (As amended through 1993) of the North Carolina General Statutes Chapter I13A Article 4, G.S.I13A-60(c) provisions are available for review of local government's enforcement of the permitted erosion and sediment program. The Town of Lake Lure approached the land owner of this ./ Page 2 dump site for permission to use this property and despite all of our voiced concerns prior to the initiation of this project, prevailed until she agreed, whereupon they paid for all of the land preparation. We experienced a devastating flash flood, September 4, 1996, which did more that $150,000 worth of damage to our property/business in addition to two months lost revenue because of this disaster. We have worked all winter repairing and rebuilding our park to prepare of the 1997 tourist season. On March 28 we plan to reopen for the season and the MESS deposited beside us is going to have a definite impact on returning customers and especially new customers as they approach our park and enter on our west side. I have no doubt that there will be a sizable economic impact on our business this year. To date we have counted ten outflow sites of liquid muck draining from the bottom of the enormous mound of sediment that has been deposited on this site. As the weather gets warmer, since this material is always wet, we are facing mosquito infestation, vial odors and the presence of vultures feeding on the decomposing substances contained within, and all this in close proximity and full view of North Carolina Scenic Highway 64/74A. This is certainly not conducive to a pleasant touring or camping experience in beautiful Hickory Nut Gorge. We would appreciate your intervention in this matter. As stated in G.S.I13A-51, Preamble to the previously referenced Article, "Control of erosion and sedimentation is deemed vital to the public interest and necessary to the public health and welfare.....". In reference to the Public Notice from the Department of Army Corps of Engineers where the town of Lake Lure has applied to dredge silt from Lake Lure at a site of where the Rocky Broad enters Lake Lure, In the past the tax payers of Lake Lure have heard promises from the town council. concerning a plan to drop the lake level sixteen (16) feet. which was supposed to have taken place last year (llJ95) to remove the large sedimentation build up with heavy equipment/that has accumulated where the Rocky Broad River enters Lake Lure, The town of Lake Lure and consequently the lake front owners of Lurewoods Landing (north shore) and Mark Twain /Seton Road (south shore) arc having a serious problem as a result of silt build up in the lake The plan as submitted does not address the larger problem of silt build up west of the proposed dredgi ng site, It does seem awfully short sighted to dredge such a small channel to only address the problem of running the tour boat and access to the town basin. I hope you will delay issuing a dredging permit until the town of Lake Lure defines a long term plan that addresses all the problems and spells out where the dredge material will be deposited, what properties and wet land will be affected and what the long term goals and expected results will be, Sincerely. . STRUTNER (TOWN MANAGER), POST OFFICE BOX 255, LAKE LURE, NORTH CAROLINA 28746-0255 has applied for a Department of the Army (DA) permit TO DREDGE SAND AND SEDIMENT FROM THE MOUTH OF LAKE LURE HARBOR IN AN AREA SOUTH OF THE CONFLUENCE OF THE BROAD RIVER AND LAKE LURE IN RUTHERFORD COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show an approximately 600 foot long and 200 foot wide area to be dredged at the entrance of the Lake Lure Harbor where it joins the main navigation channel in Lake Lure. The approximately 3 acre dredge site is situated in an area of high sediment deposition due to its' proximity to the mouth of the Broad River. An eight inch hydraulic dredge owned by the town is to be used to establish a depth of approximately 4.5 feet below the normal low pool elevation contour of the lake. The dredging work is to generate 17,800 cubic yards of silt and sand, all of which will be pumped to an approximately 3 acre diked dredged material disposal basin located to the west of the work site. The purpose of the proposed project is to reestablish safe boating access to and from Lake Lure Harbor. The completed work will also enable a concessionaire authorized by the Town to continue the operation of a boat tour service from docking facilities within the Harbor. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would be performed in accordance with Federal, State, and local permits and regulations governing such activities at the time the maintenance is undertaken. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. , -2- The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b) (1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the publici Federal, State and local agencies and officialsi Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Environmental Management (NCDEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management (NCDEM), Salisbury Street, Archdale Building, Raleigh, North Carolina. I SUBJECT: U.S. Army Corps of Engineers Public Notice No. 199600631, Application by Town of Lake Lure to dredge material from Lake Lure Harbor, Rutherford County. The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by the U.S. Army Corps of Engineers, and our biological field staff is familiar with the project site. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.c. 661- 667d.). The applicant proposes to dredge a 600-foot long by 200-foot wide area at the entrance of the Lake Lure Harbor where it joins the main navigation channel in Lake Lure. The 3-acre dredge site is an area of heavy sediment deposition due to its proximity to the mouth of the Broad River. An 8-inch hydraulic dredge owned by the town will be used to establish a depth of 4.5 feet below the normal low pool elevation contour of the lake. Dredging will generate approximately 17,800 cubic yards of silt and sand that will be pumped to a 3-acre diked disposal basin located west of the work station. The purpose of the project is to reestablish safe boating access to and from Lake Lure Harbor. Biological staff of the NCWRC believe that this project will have minimal adverse impacts to fisheries and wildlife resources; therefore, we have no objection to the issuance of this permit.
