Skvarla, fli Secretary On April 30, 2014, Dave Parnell, of the Raleigh Regional Office of the North Carolina Division of Energy, Mineral and Land Resources (DEMLR), conducted a compliance evaluation inspection (CEI) at the above referenced facility. The site lies in the watershed of an unnamed tributary (UT) to Chunky Pipe Creek, Class WS-IV, NSW waters, which lies in the Neuse River Basin. The following observations were noted during the NCGO80079 DEMLR inspection: This facility processes restaurant greases, cooking down the grease mixture in order to separate the food materials, grease and water. The food material and water is placed on wood chips which, in turn, produces a rich soil mixture. The refined grease is shipped to another facility for further refining to be used as fuel. Approximately 10% of the original grease mixture results in the food material/water which is periodically place on the wood chips. Thank you for your assistance during the inspection, it was appreciated. The inspection began in your office, where a thorough review of the Stormwater Pollution Prevention Plan; as well as the qualitative monitoring results, was conducted. The Stormwater Pollution Prevention Plan has been implemented. As was discussed during the inspection, improvements to your stormwater program could be realized if employee training and documentation of the Stiormwater Pollution Prevention Plan annual update were provided. Page: 2 Parnell, David From: Pickle, Ken Sent: Friday, May 09, 2014 12:53 PM To: Parnell, David Cc: Bennett, Bradley; Georgoulias, Bethany Subject: RE: Carolina Biodiesel - Durham (NCG080079) Hi Dave, I don't remember this discussion about Carolina Biodiesel, and we don't have any paper record that I can find about NCGO8 vs NCG06. I see that in 1993 Unity Oil was permitted under NCGO8 at this site. So, I guess they were a heating oil distribution company, which makes sense for NCGO8. Wait.... Maybe this is the one that started off taking in the grease/oil, straining it, and otherwise processing it a minimum amount to clean it up and re -sell it still as essentially non-food grade oil (only suitable for French -frying at CharGrill). But they had plans to make bio-diesel or other products as the market developed. Does that correspond with the correspondence you saw in their file? If so, t think we left it at that time that when/if the NCG08 ever became insufficient to address the stormwater pollution risk, we could consider what type of permit coverage to replace it with. I think the choice at that time was whether to just switch owners of the NCGO8, or whether to issue a new NCG06 or an NCS. 1 think we chose the low -effort path, and just processed a Name/Ownership change for this green/recycling start- up business (at the time.) Dave, unless you fee! that these folks are a stormwater risk that should be addressed by a permit change now, l think we would see processing their new permit application os low priority for us over the next several months. We probably will want to re-evaluate their permit coverage someday, but not now unless you see a significant risk. if there is no immediate significant risk, then I think we would be content to consider that they are under permit with us, they are on the RRO inspection schedule, they have to implement a SPPP, and they have to do visual monitoring. Food materials -> mulch, grease -> drummed for re -sale, Process water -> probably discharged: I hope you mean to the POTW. If there is a surface water discharge of the process water then they need a wastewater permit from our brothers and sisters in NPDES (or they need to cease and desist immediately.) Let us know what you think about this. If you would copy us on your inspection report, I'll file it to serve as a refresher when/if we pull this file to investigate alternative permit coverage. The facility did fairly well during their inspection, SPPP, Qualitative was compliant. Their observation monitoring point was not in an all encompassing point — and we addressed that. They did not have a copy of the permit — but had paid their annual fees. As l reviewed their documents, I saw some correspondences from September 2010 concerning moving them to a permit that fits their process better - NCG06 — or possibly an individual. Do you recall any resolution to this or is the NCGO8 the proper permit for them? They collect used grease from restaurants and cook it down to separate the food materials, grease and water. The food material is applied to mulch, which turns to rich "soil', and the grease is put in drums and se.nt off to be reused as fuel. The water discharges, I think — not sure. Any thoughts? They may be fine, just waiting for your input before writing their letter. This site does not perform any vehicle maintenance and does not use 55 gallons of new motor oil when averaged over a calendar year. Therefore, analytical monitoring associated with vehicle maintenance not required. 4. Qualitative monitoring is required. The facility failed to conduct qualitative monitoring. Monitoring will be performed by the site Manager. 5. The facility does provide secondary containment. 6. The Stormwater Pollutibn Prevention Plan is updated once per year, and include employee training. The plan addresses all items as required by Part II Section A with the exception of Part 11 Section A 2 (a) Feasibility Study.
