Dear Mr. Brame:
1, Mitch Hayes, of the Raleigh Regional Office conducted a Compliance Evaluation Inspection at the
subject facility on July 12, 2012. Yours and John Keen's assistance with this inspection was greatly
appreciated. Please find the attached Basinwide Information Management System (BIMS) checklist
summarizing the inspection. Below is a list of findings and recommendations developed from the inspection:
1. The General Permit NCG080000 was issued November 01, 2007 and will expire October 31, 2012.
Request for permit renewal was mailed out from the Central Office in March 2012. Please continue
to operate under the last issued permit until a new permit is issued.
2. The facility consists of a covered truck fueling depot, truck maintenance shop, truck wash, covered
gasoline fueling depot, various storage buildings, various restaurants and outparcels, truck and car
parking lots situated on approximately 29.4 acres.
3. Approximately 14 acres are non -pervious. The rest of the land is grassed and includes three
stormwater retention ponds. There are stormdrains located throughout the parking lot to convey
stormwater runoff to the three stormwater retention ponds in series. The two upper ponds, situated
in a north south configuration, are connected by a pipe to maintain a constant water level. The
southern upper pond has an overflow pipe that discharges waterto the third smaller pond which is at
a lower elevation than the upper two ponds. According to the Division of Land Resources, the third
smaller pond discharges to a level spreader below the lower pond. Water in all three ponds
appeared clear with no sheen noted.
4. Absorbent booms are place in the receiving northern upper stormwater retention pond. There is an
oil water separator for the fuel line that discharges to the stormdrain and an oil water separator for
the shop that discharges to the Town of Kenly wastewater collection system. Nobile Oil pumps out
the oil water separators as needed. There is no secondary containment for the fueling pad area
however; oil absorbent pads and booms are readily available in case of spills. Water forthe truck
wash is reused and eventually discharged to the Town of Kenly wastewater collection system.
5. A current stormwater permit was not available for the inspection. A copy of the general permit
NCG080000 was given to you during inspection. Please be sure to read and follow all permit
requirements. Failure to follow permit NCGO80054 conditions is subject to enforcement action and
penalties up to $25,000 per day. A Stormwater Pollution Prevention Plan was available. It is well

written and contains all permit requirements.
6. You stated your facility uses over 55 gallons of oil per month when averaged over 12 months.
Please follow the analytical monitoring requirements and schedule as listed in Section B, Table 1
and 2. The discharge outfall listed on site map will require analytical monitoring and qualitative
monitoring. Analytical and qualitative monitoring forms are available on the Division of Water
Quality's web page http://portal.ncdenr.or-q/web/wg/ws/su/npdessw#tab3 under the monitoring

page.

Inspection Summary:

Your facility is currently covered for stormwater discharge under General Permit NCG080000. This permit expires
on August 31, 2(I)2. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002- Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit. you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage: To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater frorn your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10.000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 I categories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed

In accordance with your application for an NPDES discharge permit received on
November 17, 1992 by the Division, we are herewith forwarding the subject Authorization
to Construct for the construction and operation of a stormwater basin with an oil/water
separator and sand filter for fueling area run-off with discharge of treated stormwater into
an unnamed tributary to the Little River in the Neuse River Basin. This Authorization to
Construct is issued pursuant to the requirements of North Carolina and the US
Environmental Protection Agency Memorandum of Agreement dated December 6, 1983
and as subsequently amended.
This Authorization to Construct is issued in accordance with Part -In, Paragraph 2
of NPDES Permit No. NCG080000, and shall be subject to revocation unless the
wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NCG080000.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.
The Raleigh Regional. Office, telephone number (919) 571-4700, shall be notified at
least forty-eight (48) hours in advance of operation of the installed facilities so that an in -
place inspection can be made. Such notification to the regional supervisor shall be made
during the normal office hours from 8:0.0 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct
may subject the Permittee to an enforcement action by, the Division of Environmental
Management in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.

Dear Mr. Lowe:
In accordance with your application for an NPDES discharge permit received on
November 17, 1992 by the Division, we are herewith forwarding the subject Authorization
to Construct for the construction and operation of a stormwater basin with an oil/water
separator and sand filter for fueling area run-off with discharge of treated stormwater into
an unnamed tributary to the Little River in the Neuse River Basin. This Authorization to
Construct is issued pursuant to the requirements of North Carolina and the US
Environmental Protection Agency Memorandum of Agreement dated December 6, 1983
and as subsequently amended.
This Authorization to Construct is issued in accordance with Part III, Paragraph 2
of NPDES Permit No. NCG080000, and shall be subject to revocation unless the
wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NCG080000.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.
The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at
least forty-eight (48) hours in advance of operation of the installed facilities so that an in -
place inspection can be made. Such notification to the regional supervisor shall be made
during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct
may subject the Permittee to an enforcement action by the Division of Environmental
Management in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.

complying with any and all statutes,. rules, regulations, or ordinances which may be
required by the Division of Environmental Management or permits required by the Division'
