Discharge Elimination System (NPDES) Electronic Reporting Rule in December 2015. Kenneth Harper, the current supervisor was not aware of the permit conditions that would keep the company in compliance with the stormwater permit. A copy of the Compliance Inspection Report is enclosed for your review. Mr. Kenneth Harper, Plant Foreman, was also present during the inspection and his time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG070000 under Certificate of Coverage NCG070176. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as an unnamed tributary to Pocket Creek, a Class C water in the Cape Fear River Basin. As a result of the site inspection, the following permit conditions violations are noted: 1) Stormwater Pollution Prevention Plan (SPPP1 A Stormwater Pollution Prevention Plan (SPPP) for the facility has not been developed, recorded or properly implemented. Secondary containment is not provided around bulk storage of liquid materials (admixture tanks) in accordance with permit requirements. 2) Qualitative Monitoring Qualitative monitoring has not been conducted and recorded in accordance with permit requirements. Other Observations: Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Requested Response: You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your written response should include a reasonable explanation as to why the aforementioned violations have occurred as well as a Plan of Action to prevent these violations from recurring. FRO DEMLR; arrived onsite' to conduct a Multimedia Inspection of Blackwelder Tank Service located in Moore County. The inspection was conducted to determine compliance with the facility's air permit as well as coverage under the NPDES NCGO70000 General Stormwater Permit. I met with the facility contact, Kenneth Harper, Plant Foreman, at the plant, which was not operating at the time of inspection. Mr. Harper stated there had been no changes to the facility and was not aware of any dust related complaints from the surrounding area. Mr. Harper relayed that about two months ago there was some dusting coming out of the tanker truck during a silo fill. Mr. Harper stated that he had the tanker truck driver shut down and fix the issue before resuming and that the dusting lasted approximately five to ten minutes. Regarding maintenance, Mr. Harper stated that he performs quarterly inspections of the baghouse. According to his maintenance log, the most recent inspection/maintenance was conducted on 14 February 2017 and the previous inspection was conducted on 11 August 2016 where four bags were replaced. This facility uses a water truck to wet suppress the haul roads and other plant grounds as needed. I observed no excessive dust on the entry road or perimeter of the site. VI. PERMIT STIPULATIONS: A.2 2Q .0304 — PERMIT RENEWAL AND EMISSIONS INVENTORY REQUIREMENT — The permittee shall submit permit renewal application and emission inventory at least 90 days prior to expiration of current permit. SPECIFIC CONDITIONS AND LIMITATIONS 1. Any air emission sources or control devices authorized to construct and operate above must be operated and maintained in accordance with the provisions contained herein. The Permittee shall comply with applicable Environmental Management Commission Regulations, including Title 15A North Carolina Administrative Code (NCAC), Subchapter 2D .0202, 2D .0515, 2D .0521, 2D .0535, 2D .0540 and 2D .0611. 2. PERMIT RENEWAL AND EMISSION INVENTORY REQUIREMENT - The Permittee, at least 90 days prior to the expiration date of this permit, shall request permit renewal by letter in accordance with 15A NCAC 2Q .0304(d) and (f). Pursuant to 15A NCAC 2Q .0203(i), no permit application fee is required for renewal of an existing air permit (without a modification request). The renewal request (with AA application form) should be submitted to the Regional Supervisor, DAQ. Also, at least 90 days prior to the expiration date of this permit, the Permittee shall submit the air pollution emission inventory report (with Certification Sheet) in accordance with 15A NCAC 2D .0202, pursuant to N.C. PARTICULATE CONTROL REQUIREMENT - As required by 15A NCAC 2D .0515 "Particulates from Miscellaneous Industrial Processes," particulate matter emissions from the emission sources shall not exceed allowable emission rates. The allowable emission rates are, as defined in 15A NCAC 2D .0515, a function of the process weight rate and shall be determined by the following equation(s), where P is the process throughput rate in tons per hour (tons/hr) and E is the allowable emission rate in pounds per hour (lbs/hr). E = 4.10 * (P) "' for P <= 30 tons/hr, or E = 55 * (P) "' - 40 for P >30 tons/hr 4. VISIBLE EMISSIONS CONTROL REOUIREMENT - As required by 15A NCAC 2D .0521 "Control of Visible Emissions," visible emissions from the emission sources, manufactured after July 1, 1971, shall not be more than 20 percent opacity when averaged over a six -minute period, except that six -minute periods averaging not more than 87 percent opacity may occur not more than once in any hour nor more than four times in any 24-hour period. However, sources which must comply with 15A NCAC 2D .0524 "New Source Performance Standards" or .1110 "National Emission Standards for Hazardous Air Pollutants" must comply with applicable visible emissions requirements contained therein. NOTIFICATION REQUIREMENT -As required by 15A NCAC 2D .053 S, the Permittee of a source of excess emissions that last for more than four hours and that results from a malfunction, a breakdown of process or control equipment or any other abnormal conditions, shall: a. Notify the Director or his designee of any such occurrence by 9:00 a.m. Eastern time of the Division's next business day of becoming aware of the occurrence and describe: i. the name and location of the facility, ii. the nature and cause of the malfunction or breakdown, iii.. the time when the malfunction or breakdown is first observed, iv. the expected duration, and V. an estimated rate of emissions. b. Notify the Director or his designee immediately when the corrective measures have been accomplished. This reporting requirement does not allow the operation of the facility in excess of Environmental Management Commission Regulations. 6. FUGITIVE DUST CONTROL REQUIREMENT - As required by I SA NCAC 2D .0540 "Particulates from Fugitive Dust Emission Sources," the Permittee shall not cause or allow fugitive dust emissions to cause or contribute to substantive complaints or excess visible emissions beyond the property boundary. If substantive complaints are received or excessive fugitive dust emissions from the facility are observed beyond the property boundaries for six minutes in any one hour (using Reference Method 22 in 40 CFR, Appendix A), the owner or operator may be required to submit a fugitive dust plan as described in 2D .0540(f). "Fugitive dust emissions" means particulate matter that does not pass through a process stack or vent and that is generated within plant property boundaries from activities such as: unloading and loading areas, process areas stockpiles, stock pile working, plant parking lots, and plant roads (including access roads and haul roads). FABRIC FILTER REQUIREMENTS including cartridge filters, baghouses, and other _dry filter particulate collection devices - As required by 15A NCAC 2D .0611, particulate matter emissions shall be controlled as described in the permitted equipment list. a. Inspection and Maintenance Requirements - To comply with the provisions of this permit and ensure that emissions do not exceed the regulatory limits, the Permittee shall perform, at a minimum, an annual (for each 12 month period following the initial inspection) internal inspection of each particulate collection device system. in addition, the Permittee shall perform periodic inspections and maintenance as recommended by the equipment manufacturer. b. Recordkeeping Requirements - The results of all inspections and any variance from manufacturer's recommendations or from those given in this permit (when applicable) shall be investigated with corrections made and dates of actions recorded in a logbook. Records of all maintenance activities shall be recorded in the logbook. The logbook (in written or electronic format) shall be kept on -site and made available to DAQ personnel upon request. ANNUAL FEE PAYMENT - Pursuant to 15A NCAC 2Q .0203(a), the Permittee shall pay the annual permit fee within 30 days. of being billed by the DAQ. Failure to pay the fee in a timely manner will cause the DAQ to initiate action to revoke the permit. 4. EQUIPMENT RELOCATION -In accordance with 15A NCAC 2Q .0301, anew air permit shall be obtained by the Permittee prior to establishing, building, erecting, using, or operating the emission sources or air cleaning equipment at a site or location not specified in this permit. 5. REPORTING REQUIREMENT -In accordance with 15A NCAC 2Q .0309, any of the following that would result in previously unpermitted, new, or increased emissions must be reported to the Regional Supervisor, DAQ: a. changes in the information submitted in the application regarding facility emissions; b.' changes that modify equipment or processes of existing permitted facilities; or c. changes in the quantity or quality of materials processed. If appropriate, modifications to the permit may then be made by the DAQ to reflect any necessary changes in the permit conditions. In no case are any new or increased emissions allowed that will cause a violation of the emission limitations specified herein. Permit No. 08454R04 Page 6 6. In accordance with 15A NCAC 2Q .0309, this permit is subject to revocation or modification by the DAQ upon a determination that information contained in the application or presented in the support thereof is incorrect, conditions under which this permit was granted have changed, or violations of conditions contained in this permit have occurred. In accordance with G.S. 143-215.108(c)(1), the facility shall be properly operated and maintained at all times in a manner that will effect an overall reduction in air pollution. Unless otherwise specified by this permit, no emission source may be operated without the concurrent operation of its associated air cleaning device(s) and appurtenances. 7. In accordance with G.S. 143-215.108(c)(1), this permit is no by the Permittee. Future owners and operators must obtain a new air permit from the DAQ. 8. In accordance with G.S. 143-215.108(c)(1), this issuance of this permit in no way absolves the Permittee of liability for any potential civil penalties which may be assessed for violations of State law which have occurred prior to the effective date of this permit. 9. In accordance with G.S. 143-215.108(c)(1), this permit does not relieve the Permittee of the responsibility of complying with all applicable requirements of any Federal, State, or Local water quality or land quality control authority. 10. In accordance with 15A NCAC 2D .0605, reports on the operation and maintenance of the facility shall be submitted by the Permittee to the Regional Supervisor, DAQ at such intervals and in such form and detail as may be required by the DAQ. Information required in such reports may include, but is not limited to, process weight rates, firing rates, hours of operation, and preventive maintenance schedules. 11. A violation of any term or condition of this permit shall subject the Permittee to enforcement pursuant to G.S. 143-215.11.4A, 143-215.11413, and 143-215.114C, including assessment of civil and/or criminal penalties. 12. Pursuant to North Carolina General Statute 143-215.3(a)(2), no person shall refuse entry or access to any authorized representative of the DAQ who requests entry or access for purposes of inspection, and who presents appropriate credentials, nor shall any person obstruct, hamper, or interfere with any such representative while in the process of carrying out his official duties. Refusal of entry or access may constitute grounds for permit revocation and assessment of civil penalties. 13. In accordance with G.S. 143-215.108(c)(1), this permit does not relieve the Permittee of the responsibility of complying with any applicable Federal, State, or Local requirements governing the handling, disposal, or incineration of hazardous, solid, or medical wastes, including the Resource Conservation and Recovery Act (RCRA) administered by the Division of Waste Management. 14. PERMIT RETENTION REQUIREMENT - In accordance with 15A NCAC 2Q .0110, the Permittee shall retain a current copy of the air permit at the site. CLEAN AIR ACT SECTION 112Lr) REQUIREMENTS - Pursuant to 15A NCAC 2D..2100 "Risk Management Program," if the Permittee is required to develop and register a risk management plan pursuant to Section 112(r) of the Federal Clean Air Act, then the Permittee is required to register this plan with the USEPA in accordance with 40 CFR Part 68. 16. PREVENTION OF ACCIDENTAL RELEASES - GENERAL DUTY - Pursuant to Title I Part A Section 112(r)(1) of the Clean Air Act "Hazardous Air Pollutants - Prevention of Accidental Releases - Purpose and General Duty," although a risk management plan may not be required, if the Permittee produces, processes, handles; or stores any amount of a listed hazardous substance, the Permittee has a general duty to take such steps as are necessary to prevent the accidental release of such substance and to minimize the consequences of any release. Facility/Process Description Blackwelder Tank Service is an on -site cement batch plant that produces septic tanks for residential and commercial properties. Cement is brought in by transfer truck and loaded pneumatically into a silo for storage. Sand and gravel aggregates are stockpiled on the yard until needed. The required cement mixture is made when mix trucks pull under the rubber load out chute. Sand and gravel are belt conveyed into the truck, where water is also added. Cement from the silo is transferred into a weigh hopper, added into the truck, and mixed with water and aggregates. The truck mix is driven to the tank building and poured into specific molds according to customer's specifications. Once `I sufficiently cured/dried, the molds are removed and curing continues for a few days depending on specifications` 4. Inspection Conference On 11 August 2016, I Mike Thomas of FRO DAQ, met with Pam Gillis, Office Manager and Ken Harper, Plant Foreman. This was a planned meeting to assist with Emissions Inventory and Permit Renewal. We discussed the following: a) Verified the FACFINDER information. No changes are needed. b) I reviewed the bagfilter logbook which was complete with entries for routine inspections and maintenance actions. c) I assisted Ms. Gillis with entering the facility's Emissions Inventory in to AERO. I also assisted Ms. Gillis with filling out the permit renewal forms. Ms. Gillis stated that she would send them to Mr. Blackwelder for review before mailing them in. I reminder her that they had to be mailed by 1 September 2016. 'd) Production: Year Yards of Concrete 2015 2,405 2014 3,000 2013 2,908 6. Inspection Summary Mr. Harper led me on a tour of the facility which was not operating. At this facility the cement silo, baghouse, and truck loadout are all one unit. Mr. Harper stated that they only receive cement about once a week right now. I inquired as to what the facility's procedure was for receiving cement. Mr. Harper said that he meets the truck driver and supervises the filling operation. He limits the driver to a fill pressure of approximately 12 psi. Mr., Harper stated that he stays with the driver as the transfer begins and the checks on the filling process periodically until it is filled. Mr. Harper also informed me that he has been more diligent with overseeing silo filling since a driver blew out the seal on the baghouse this past July. I also observed the weigh batcher and the sand and aggregate bins. I observed no problems in these areas. The facility overall was very clean and well maintained. 7. Permit Stipulations a) A.2 2Q .0304 Permit Renewal and Emissions Inventory Requirement — Entire facility subject. Submit permit renewal application and EI at least 90 days prior to permit expiration. Appeared to be in compliance — The facility is due to submit their EI and Permit Renewal by September 2016. The facility submitted the EI via AERO on I 1 August 2016. The permit renewal will follow after a quick review by Mr. Blackwelder according to Ms. Gillis. b) A.3 2D .0515 Particulates from Miscellaneous Industrial Processes, Particulate matter emissions from the emission sources shall not exceed allowable emission rates. Appeared to be in compliance — Compliance was determined during the most recent permit review based on operating the source as described in the permit conditions. No changes have been made to operations since the last permit review. c) A.4 21) .0521 Control of Visible Emissions, Visible emissions from the emission sources, manufactured after July 1, 1971, shall not be more than 20 percent opacity when averaged over a six -minute period. Appeared to be in compliance - I did not observe truck mix or silo load during this inspection. The plant was not operating. d) A.5 '2D .0535 Notification Requirement - The facility is required to notify DAQ if excess emissions occur for more than a 4-hour period caused by a breakdown or other abnormal condition. Appeared to be in compliance — The facility has had no exceedances, breakdowns, or abnormal conditions requiring notification according to Mr. Harper. e) A.6 21) .0540 Fugitive Dust Control Requirement, The Permittee shall not cause or allow fugitive dust emissions to cause or contribute to substantive complaints or excess visible emissions beyond the property boundary. Appeared to be in compliance — The facility was not operating during the inspection, however, I observed it to be very clean and well maintained. Mr. Harper stated the he is very diligent in keeping the facility clean due to receiving complaints from the neighbors several years ago. Mr. Harper stated that he has not had any complaints in the last few years regarding dust. f) A.7 2D .0611, Bagfdter Inspection and Maintenance, Particulate matter emissions shall be controlled as described in the permitted equipment list, inspected annually, and recorded in a logbook. Sullins, Director Division of Water Quality September 7, 2007 Tim Blackwelder Blackwelder Tank Service, Inc. 121 Stanton Hill Road Carthage, NC 28327 Subject: Return of your Application and Notification of fee changes Dear Mr. Blackwelder: On July 31, 2007 the North Carolina General Assembly and Governor Easley put into effect a new budget that included a 20% increase to all fees associated with Division of Water Quality annual fees, new permit applications, permit modifications, certifications, and project fees. $100 is the new permit application fee, instead of the former $80 application fee for General Stormwater permits. The Division of Water Quality attempts to operate in a fiscally responsible and efficient manner. This increase represents the first change in fees since 1999 and reflects inflationary pressures over that time. As of September 1, 2007, all permit fees collected must meet the legal requirements of these changes.
