NC Products Corporation -Fayetteville, Certificate of Coverage-NCG070073 NPDES Stormwater General Permit-NCG070000 Cumberland County Dear Mr. Stevens: On June 24, 2015, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources conducted a site inspection for the NC Products Corporation -Fayetteville facility located on 3960 Cedar Creek Road, Cumberland County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. John Baker, Plant Manager was also present during the inspection and his time and assistance is greatly appreciated, The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG070000, Certificate of Cove rage-NCG 070 073 Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as the Cape Fear River, a Class WS-IV waterbody in the Cape Fear River Basin. As a result of the inspection, the facility was found to not be fully in compliance with the conditions of the NCG070000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that Violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. The Stormwater Pollution Prevention Plan (SPPP) was available for review. Only Qualitative Monitoring is required since the used diesal fuel is contained in 2 double -walled AST's with a locked safety valve, is not being used on the site and is transported off -site by another company. There are several components of the SPPP which were not noted and should be included in the SPPP. Please refer to the Compliance Inspection Report for this information. Employee training was last documented in 2013 and should take place on an annual basis. Qualitative monitoring has taken place annually instead of semi-annually per year (as required by General Permit NCG070000) at one of the two outfalls on the site. The outfall near the Cape Fear River needs to also be monitored on a semi-annual basis. There is a potential for a Notice of Deficiency or Notice of Violation if the Qualitative monitoring practices are not modified. There is a pile of crushed concrete near a diversion ditch on the site which should be relocated further away from the diversion ditch to prevent possible contaminated stormwater runoff. Manufactured products storage is located at the southern end of the property. The facility is surrounded by forested area to the north, south and east. The site is bordered by residential and undeveloped property to the northeast and east. Monsanto Chemical Corporation borders the site to the northwest. The facility is not restricted by a fence, but a locking gate at the Cedar Creek road entrance is used when the plant is closed. The Cape Fear River is located to the west. A railroad spur is located at the north east corner of the property. The facility drainage is provided by a network of storm pipes to ditches around the perimeter of the facility and direct runoff from the storage area. The ditch network discharge and the southwestern portion of the site drain directly to the Cape Fear River. Storm water in the southeastern portion of the site is collected in a pipe and discharged to a small creek located near the main entrance access easement. The Iarge diameter concrete pipe plant, known as Vander B, is a circular building located to -the southwest of the administration office. A cement silo is located directly above the production building and a fly ash silo is located on the northeast side of the building. The concrete mixer is located inside the building that supports mixing operations for the Vander B plant. N.C. Products — Vander A & B Fayetteville Plant 2 SPCC Plan Update 2014 DAA PN R14111N-01G The small diameter pipe and utility box concrete plant, known as Vander �^ A, is a metal -frame building located to the northeast of Vander B. A cement silo and concrete mixer are located on the northern side of the building that supports mixing operations for Vander A. Vander A is currently "mothballed" and not thought to be utilized in the foreseeable future. 1.3 Bulk Storage Containers There are currently eleven (11) containers consisting of aboveground storage tanks (AST's) and drums located on site. The containers include the following: ` a. 1,000 gallon pre-engineered Convault double wall, concrete coated AST located at Vander A just outside the maintenance shop. A dispenser pump and 2 inch diameter fill port are located on top of the AST. The AST contains No. 2 diesel fuel used to fuel onsite machinery such as fork lifts and front end loaders. The diesel fuel is supplied and delivered by ItHeritage Crystal Clean. The diesel fuel is delivered approximately once a month. Itb. 500 gallon pre-engineered Convault double wall, concrete coated AST located at Vander A just outside the maintenance shop. A dispenser pump itand 2 inch diameter fill port are located on top of the AST. Also, an electric pump is connected to the AST to pump hydraulic oil into the plant. The AST contains hydraulic oil which is supplied and delivered by Heritage Crystal Clean c. 280 gallon single -wall AST. The tank is located inside the Vander B hydraulic room within a secondary containment. The tank contains hydraulic oil su lied and delivered by Pugh_Lubricants. N.C. The tank is located in the fabrication area of Vander B. The tank is located in the hydraulic room of Vander B. The tank contains hydraulic oil. f. (2) 55 gallon single walled drum located in the hazardous materials area of Vander B. The drums contain used motor oil. The motor oil is stored in these drums until it is collected by Heritage Crystal Clean which disposes the oil in an environmentally safe mariner. The drums are located on a spill containment pallet. g. (2) 55 gallon single walled drum located in the hazardous materials area of Vander B. The drums contain used motor oil/absorbent. The motor oil is stored in these drums until it is collected by Heritage Crystal Clean which disposes the oil in an environmentally safe manner. h. 50 gallon reservoir tank located on the Vander A coring machine. The coring machine is located opposite of the maintenance shop. i. 30 gallon single walled drum located in the maintenance shop. The drum contains petroleum naphtha (parts washer fluid). The parts washer fluid is supplied by Heritage Crystal Clean. j. Various 5 gallon buckets of Motor Oil on containment pallet in Hydraulic Room of Vander B. Submit the results to NC DWQ on the monitoring report forms pro- vided. ► NCG110000 allows stormwater discharges asso- ciated with activities classified as Treatment Works treating domestic sewage or any other sewage sludge'or wastewater treatment device or system, used in the storage, treatment, recycling, and recla- mation of municipal or domestic sewage, with a de- sign flow of 1.0 million gallons per day or more, or facilities which are required to have an approved pretreatment program under Title 40 CFR §403, in- cluding lands dedicated to the disposal of sewage sludge located within the confines of the facility. ► NCG130000 allows stormwater discharges asso- ciated with activities classified as establishments primarily engaged in: wholesale trade of non-metal waste and scrap (hereafter referred to as the non- metal waste recycling industry, a portion of standard industrial classification (SIC) 5093); similar activi- ties. Excluded: wholesale trade of metal waste and scrap, iron and steel scrap, and nonferrous metal scrap; waste oil recycling; and automobile wrecking for scrap. Best Management Practices The SPPP should include the use of Best Management Practices (BMPs) to control discharge of pollutants from a facility's storm - water outfalls. BMPs include a variety of things that the industrial facility can do to minimize the potential for pollutants to get into the stormwater draining from a facility. There are different types of BMPs: Non -Structural BMPs ♦ Non-structural BMPs include practices or activities such as: • Eliminate exposure of materials and equipment by moving ma- terials and equipment to indoor locations. • Practice good housekeeping on -site. Keep materials handled and stored at the facility or- derly. • Exchange hazardous materials for non -hazardous ones wher- ever possible. • Establish routine leak and maintenance checks to mini- mize the chance of spills. • Establish storage tank proto- cols that minimize the risk of spills during loading and unloading. • Store used pallets and process waste dumpsters inside or un- der a roof where water cannot flow on or around them. Can I be exempted from an NPDES stormwater permit? Possibly. A facility with any in- dustrial activity subject to the NPDES Stormwater regulations that eliminates all potential storm - water exposure may be eligible for a No Exposure Exclusion from a stormwater permit. Please see our website for more details. Can I monitor fewer outfalls? You must test samples from all outfalls associated with vehicle maintenance. However, you may request approval of "Represent- ative Outfall Status" (ROS). ROS allows analytical monitoring at fewer outfalls. Submit the form to the DWQ Regional Of- fice nearest your location (see map below) with all necessary supporting documentation. Monitoring under all NPDES per- mits must be conducted in accor- dance with test procedures ap- proved under federal regulations in 40 CFR §136. All labs certified by North Carolina perform analy- sis in accordance with those pro- cedures.
