APPROVAL of 401 Water Quality Certification and ADDITIO -NAL CONDITIONS

Dear Mr. Butler:
You have our approval to place fill material and flood about 1.75 acres of wetlands or waters for
the purpose of constructing an irrigation pond at 1335 Hollandtoa-n Road, as you described in your
application dated 14 December 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. 11:11 certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of l--n-iueers.
This approval is only valid for the purpose and design that vru described in your application. It you
change your project, you must notify us and you may be required 10 send us a new application. For this
approval to tY valid, you must follow the conditions listed in. the attached certification. The planned
height of the dam (13 feet) shall he lowered to the elevation of the uppermost edge of the northernmost
existing pond to reduce the extent of flooding into the tributaries , )d their adjacent wetlands. In
addition, you should get any other federal, state or local permits h:fore you go ahead with your project.
If you do not accept any of the conditions of this certification. you may ask for an adjudicatorv
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing. send
a written petition which conforms to Chapter 150B of the North (- rolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611--447. This certification and its
conditions titre final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environtneutal Management under Section 401

Quality Certification involving filling of
wetlands associated with pond expansion,
Salemburg, Sampson County, North Carolina. DEM
ID: 951286.
The Wildlife Resources Commission has reviewed the
subject request for Water Quality Certification. A site
visit was made on January 11, 1996. Our comments are
provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et. seq.).
The applicant proposes to consolidate 3 small ponds
totaling 0.75 acre into a single pond by constructing a dam
across a tributary of Little Coharie Creek in 0.24 acre of
wooded wetlands. Project wetlands provide high quality
riparian habitat for raccoon, muskrat, mink, oppossum, and a
variety of songbirds. We recommend that the area of wetland
impact be reduced by shifting the orientation of the dam to
the south to align with and include the existing lowermost
pond dam. Such an alignment would appear to reduce
encroachment on wetlands.
