This letter is in response to the Notice of Violation (NOV), dated 12 October 2018, issued to Ann's House
of Nuts (the Facility), a TreeHouse Foods company, located at 201 E. 3,d Street, Robersonville, NC. The
NOV was received on 24 October 2018 and was issued for an illicit discharge of peanut oil into waters of
the State. It was determined that peanut oil from the Facility was discharged via the storm drain to an
unnamed tributary of Flat Swamp.
Spill Notification and Response
On 9 October 2018, the Facility was notified that an oily and milky substance was found in a ditch to
which stormwaler from the Facility is discharged, in accordance with Part III, Section E.7. of the Facility's
NPDES General Permit No. NCGO6000, the Facility notified the Department of Water Quality Regional
Office on 10 October 2018, within 24 hours of discovering the spill. The Facility also notified the National
Response Center on 10 October 2018.
The Facility contracted Eastern Environmental to remove the oily water from the unnamed tributary.
Eastern Environmental arrived onsite 10 October 2018. They removed approximately 15,000 gallons of
water from the ditch within a 1,500 square fool area, including the additional areas identified by NC DEQ
during their 11 October 2018 site visit. The clean-up activities ended on 12 October 2018. In addition, the
facility conducted a housekeeping event on their entire roof and the wash water was also removed by
Eastern Environmental. The facility flushed stormwaler lines leading to Outfall OD2 and recovered the
waters.
A written report was submitted to NC DEQ on 18 October 2018.
Incident Investigation
The internal investigation determined the source of the spill was peanut oil and sanitation chemicals
discharged to the roof through the stacks and ventilation fans. These materials were discharged via the
roof stormwaler drains. The facility determined the amount of oil and sanitation chemicals deposited on
the roof via the stacks and ventilation equipment may have increased due to a change in sanitation
practices and the temporary addition of an exhaust fan with a higher flow.
Preventive Measures
The Facility has implemented several preventive measures to prevent a recurrence, including:

inside the Facility's property line.
Facility is currently evaluating process to capture wash water for proper disposal when pressure
washing the roof.
TreeHouse Foods is committed to regulatory compliance and supporting our facilities with implementing
compliant, efficient, and safe EHS programs. The Facility has experienced a significant amount of change
in both the business and staffing. With the support of Corporate EHS and Engineering, we are reviewing
our EMS program and associated operational controls (both equipment and documentation such as the
SPCC-SWPPP) to identify opportunities for improvement to ensure we maintain a compliant and
sustainable environmental compliance program.

This letter is to notify you that the Washington Regional Office of the Division of Water Resources is considering
forwarding a recommendation for enforcement action to the Director of the Division of Water Resources for
violations of North Carolina General Statute 143-215.1.
The investigation of the discharge of peanut oil into waters of the State, Incident No. 201803039, is
occurring from Ann's House of Nuts, located at 201 E. 3rd Street, Robersonville, North Carolina. This
discharge entered a storm drain which flowed to an unnamed tributary of Flat Swamp.
This office requests that you respond to this Notice, in writing, within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, repeated occurrences, and impacts to public health. Other factors considered in
determining the amount of the civil penalty are the violator's history of non-compliance, the cost of rectifying
the damage, whether the spill was intentional and whether money was saved by non-compliance.

CauselObservation :
At 12:43 PM on October 9, 2018. calter left message reporting that a
strong smell is coming from a ditch which is located downstream of
Ann's House of Nuts in Robersonville.
Action Taken:
At 2:00 PM on October 9, 2018, DWR staff Allen Clark called and
spoke with Robersonville's Town Manager Libby Jenkins and Public
Works Director Stacy Scott about the complaint. Mr. Scott stated that
he would go investigate the complaint. On the morning of October 10,
2018. Town of Robersonville staff and Envirolink (Environmental
ConsuRing Contractor) representatives met with Ann's House of Nuts
representatives to discussed the complaint. An unknown milky
substance from Ann's House of Nuts had entered the Town's sewer
system and reached the WWTP.1n addition, this unknown milky
substance had also entered a ditch which leaves the Ann's House of
Nuts property. At 4:00 PM on October 101h, James Pittman of
Envirolink (the WWTP and Collection System ORC) called with an
update about the situation. Eastern Environmental Contracting
Company was on -site cleaning up the unknown liquid from the ditch.
Mi. Pittman also stated the WWTP has been seeing this unknown
substance coming into the WWTP for the past 2 days. Pittman
reported that liquid has a pH of 8.2.

On Thursday, October 11, 2018. DWR staff Robbie Bullock and Scott
Vinson met with Robersonville Public Works Director Stacy Scott and
Town Manager Libby Jenkins. DWR staff then met with Ann's House
of Nuts Plant Manager Jeff Novak, Maintenance Manager Sieve
Hollingsworth. Environmental Health Specialist John Forrestal, and
Facility Maintenance Supervisor Steve Edwards. The investigation
determined that a large amount of peanut oil was released into a
storm drain which entered an unnamed tributary of Flat Swamp. The
release generated NOV-201 a-DV-0287.

Inspection Summary:
I explained to Ricky Cooke, Facility Manager [phone], while on site Monday 10/21/2013, and then by phone on
Friday 10/25/2013, as confirmation (following WaRO Staff discussions), that compliance is to be obtained. I explained
that improved operating practices (house keeping), adequate measures (BMP's), and a thorough on and off site cleanup,
are required.
I stated that I was to be presented all steps required to hopefully prevent future occurances, the time required for
implimentation, and the completion date for the cleanup.
Mr. Cooke assured that the operation will quickly become compliant, and that I will receive the details and timeframe
ASAP.
I visited Zane Pinckney, General Manager [phone] Ext. 381, again on Friday 11/9/2013, and was assured that the
resolution will promptly be completed. Later that day, I received 2 emails providing additional assurance, and other facility
contact information.
Monday 1114/2013, Ricky Cooke called to report that a purchase order for resolution, had been obtained.
Tuesday 11/5/2013, Mr_ Cooke emailed the contracted schedule to install an Over Under Dike, and to complete the clean
up by 11/27/2013.

prompted a site visit to investigate.
Robbie Bullock, WaRO - DWR [phone] opened the incident number following his
preliminary site visit. Mr. Bullock was directed to turn the project over to DEML.R for
resolution (The facility is permitted via NPDES General SW Permit number:

This letter is to notify you that the Washington Regional Office of the Division of Water Resources is considering
forwarding a recommendation for enforcement action to the Director of the Division of Water Resources for
violations of North Carolina General Statute 143-215.1.
The investigation of the discharge of peanut oil into waters of the State, Incident No. 201803039, is
occurring from Ann's House of Nuts, located at 201 E. 31d Street, Robersonville, North Carolina. This
discharge entered a storm drain which flowed to an unnamed tributary of Flat Swamp.
This office requests that you respond to this Notice, in writing, within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, repeated occurrences, and impacts to public health. Other factors considered in
determining the amount of the civil penalty are the violator's history of non-compliance, the cost of rectifying
the damage, whether the spill was intentional and whether money was saved by non-compliance.

Directions :
At 12:43 PM on October 9, 2018, caller left message reporting that a
strong smell is coming from a ditch which is located downstream of
Ann's House of Nuts in Robersonville.
Action Taken :
At 2:00 PM on October 9, 2018, DWR staff Allen Clark called and
spoke with Robersonville's Town Manager Libby Jenkins and Public
Works Director Stacy Scott about the complaint. Mr. Scott stated that
he would go investigate the complaint, On the morning of October 10,
2018, Town of Robersonville staff and Envirolink (Environmental
Consulting Contractor) representatives met with Ann's House of Nuts
representatives to discussed the complaint. An unknown milky
substance from Ann's House of Nuts had entered the Town's sewer
system and reached the VW TP. In addition, this unknown milky
substance had also entered a ditch which leaves the Ann's House of
Nuts property. At 4:00 PM on October 10th, James Pittman of
Envirolink (the WWTP and Collection System ORC) called with an
update about the situation. Eastern Environmental Contracting

On Thursday, October 11, 2018, DWR staff Robbie Bullock and Scott
Vinson met with Robersonville Public Works Director Stacy Scott and
Town Manager Libby Jenkins. DWR staff then met with Ann's House
of Nuts Plant Manager Jeff Novak, Maintenance Manager Steve
Hollingsworth, Environmental Health Specialist John Forrestal, and
Facility Maintenance Supervisor Steve Edwards. The investigation
determined that a large amount of peanut oil was released into a
storm drain which entered an unnamed tributary of Flat Swamp. The
release generated NOV-2018-DV-0287.

In accordance with your application for a discharge permit received on September 12,
2013, we are forwarding herewith the subject certificate of coverage (COC) to discharge
under the subject state — NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except upon
approval of the Division of Energy, Mineral, and Land Resources. The Division of Energy,
Mineral, and Land Resources may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may
be required by the Division of Energy, Mineral, and Land Resources, the Coastal Area
Management Act, or any other federal or local government permit that may be required.
Per the requirements of the Tar -Pamlico Riparian Buffer Rule, all stormwater
drainage to stream buffers, from portions of this site that have been constructed after January
1, 2000, must be discharged through a correctly designed level spreader or another device
that meets diffuse flow requirements per 15A NCAC 2B .0259. Diffuse flow requirements
are described in Chapter 8 of the North Carolina Stormwater BMP Manual, available at:

CauselObservation :
�At 12:43 PM on October 9, 2018, caller left message reporting that a
strong smell is coming from a ditch which is located downstream of
Ann's House of Nuts in Robersonville.
Action Taken :
At 2:00 PM on October 9, 2018, DWR staff Allen Clark called and
spoke with Robersonville's Town Manager Libby Jenkins and Public
Works Director Stacy Scott about the complaint. Mr. Scott stated that
he would go investigate the complaint. On the morning of October 10
2018, Town of Robersonville staff and Envirolink (Environmental
Consulting Contractor) representatives met with Ann's House of Nuts
representatives to discussed the complaint. An unknown milky
substance from Ann's House of Nuts had entered the Town's sewer
system and reached the WWTP. In addition, this unknown milky
substance had also entered a ditch which leaves the Ann's House of
Nuts property. At 4:00 PM on October 10th, James Pittman of
Envirolink (the WWTP and Collection System ORC) called with an
update about the situation. Eastern Environmental Contracting
Company was on -site cleaning up the unknown liquid from the ditch.
Mr. Pittman also stated the WWTP has been seeing this unknown
substance coming into the WWTP for the past 2 days. Pittman
reported that liquid has a pH of 8.2.

On Thursday, October 11, 2018. DWR staff Robbie Bullock and Scott
Vinson met with Robersonville Public Works Director Stacy Scott and
Town Manager Libby Jenkins. DWR staff then met with Ann's House
of Nuts Plant Manager Jeff Novak, Maintenance Manager Steve
Hollingsworth, Environmental Health Specialist John Forrestal, and
Facility Maintenance Supervisor Steve Edwards. The investigation
determined that a large amount of peanut oil was released into a
storm drain which entered an unnamed tributary of Flat Swamp. The
release generated NOV-2018-DV-0287.

Inspection Summary:
I explained to Ricky Cooke, Facility Manager [phone], while on site Monday 10/21/2013, and then by phone on
Friday 10/2512013, as confirmation (following WaRO Staff discussions), that compliance is to be obtained. I explained that
improved operating practices (house keeping), adequate measures (BMP's), and a thorough on and off site cleanup, are
required.
I stated that I was to be presented all steps required to hopefully prevent future occurances, the time required for
implimentation, and the completion date for the cleanup.
Mr. Cooke assured that the operation will quickly become compliant, and that I will receive the details and timeframe ASAP.
I visited Zane Pinckney, General Manager [phone] Ext. 381, again on Friday 111112013, and was assured that the
resolution will promptly be completed. Later that day, I received 2 emails providing additional assurance, and other facility
contact information.
Monday 111412013, Ricky Cooke called to report that a purchase order for resolution, had been obtained.
Tuesday 111512013, Mr. Cooke emailed the contracted schedule to install an Over Under Dike, and to complete the clean up
by 1112712013.
A follow up inspection will occur to confirm compliance.

Although many permitted requirements were not specifically requested for actual evaluation during this inspection, please
continue to develop and report all requirements of the latest version of your permit text, which was reissued on 1111/2018.
This inspection report, along with the actual permit text should be used as a guide toward the permitting expectations, and
all of the actual permit requirements.
Overall, I did not observe any obvious concerns/violations during this inspection, and therefore, I do appreciate the attention
and improvement which has developed your operation more toward the actual NPDES SW permitting expectations of
compliance.
At the time of my inspection, and until I was to this point of this report, I was not aware that you had received and responded
to the NOV-2018-DV-0287 dated October 12, 2018 from WaRO-DWR (As I mentioned during the inspecition; departmental
discussions regarding the incident had prompted my site visit).
So please understand the importance in following the guidance which I have expressed within this inspection report. I do

�Vd'Aewater under the name Family Snacks of Norte Carolina, Inc. in RIMS. This manufiicturing facility k the
company's largest, but we have no record of any stormwater permits or No Exposure status. Their- 4urface

If you are inquiring about Ann's House of Nuts, they have a facility at 201 East Third St. in Robersonville with an air
quality permit originally issued in July 2002, which I believe was renewed in June of this year. The facility has had
several violations:
NOV in :2005 for operating an unpermitted source.
NOV in 2007 for late renewal & inventory.

This General Permit regulates stormwater discharges from the following industrial manufacturing activities:
✓ Food and kindred products; Tobacco products; Soaps, detergents and cleaning preparations; Perfumes, cos-
metics and other toilet preparations; Drugs; Public warehousing and storage; and like activities
What does my permit require me to do?
,,'Develop and implement a written Stormwater Pollution Prevention Plan (SPPP) (Part 11, Section A).
,,'Develop and implement an assessment of best management practices associated with off loading, handling and
spill prevention of rendered fats and oils that are stored and used at the facility (Only facilities that use or process
animal fats / byproducts) (Part 11, Section Q.
✓Provide secondary containment for bulk storage of liquid materials {Part 11, Section A).
✓Conduct semi-annual self -monitoring of the pollutant content in stormwater discharges, and report the results to
D W Q ( Part 11, Sections B and C).
✓ Conduct semi-annual visual inspections of stormwater pollutant sources, control measures, conveyances, and out
falls (Part ll, Sections A and D).
✓ Respond to monitoring results that exceed the numerical benchmarks with management actions to reduce the
level of pollutants in the stormwater discharges. The numerical benchmarks are considered as `action levels.'
Why?
✓The General Permit seeks to reduce industrial pollution in rainfall runoff from manufacturing businesses by re-
quiring site managers to be aware of, and control, the potential for polluted runoff.
✓ Federal and state laws and regulations require the control of industrial pollution in stormwater runoff.
✓Those laws and regulations reflect the public's support for providing for clean natural waters in our state and
nation.
What has changed since the last renewal in 2007?
• The required content of the SPPP has been expanded slightly and clarified in minor ways in several paragraphs.
• The permittee may now sample discharges from any measureoble storm event, rather than from a representative
event. This change should make it easier to obtain a sample from a qualifying rain event.
• The permit text now clarifies that failure to sample due to adverse weather, or due to no discharge during the nor-
mal monitoring period, may be excused. However, the permits now require additional monthly monitoring for on,
excused failures to monitor.
• Vehicle Maintenance Areas (VMA) shall be monitored for Total Petroleum Hydrocarbons (TPH) rather than Oil &
Grease (O&G).
• VMA monitoring is now triggered by the total oil usage for motor oil plus hydraulic oil. The trigger remains at a total
of 55 gallons per month, average.
• A lower TSS benchmark of 50 mg/L applies for discharges to especially protected water classifications.
• Facilities that use or process animal fats / byproducts must now complete an assessment of best management prac-
tices (BMPs) associated with off loading, handling and spill prevention of rendered fats and oils that are stored and
used at the facility (Port 11, Section E),

Frequently Asked Questions
Do 1 have to monitor all outfalls?
Yes. However, you may request ROS
(Representative Outfall Status). If ROS is
approved, this status allows analytical
monitoring at fewer outfalls. To request
ROS, submit a ROS Request Form SWU
ROS (from our website) to the DWQ
Regional Office.
What if I can't collect a storm -
water discharge in 30 minutes?
When distances separate multiple out -
falls and preclude collection within 30
minutes of each discharge event, begin
collection within 30 minutes and then
continue until all outfalls are sampled.
Documentation must be kept in the
SPPP.
Can I take more samples than
is required by my permit?
Yes. The permittee may take multiple
samples at any time while under permit
coverage. The permittee may find the
extra sampling useful to quickly identify
causes of benchmark exceedances. All
sampling for the permit parameters
must be reported to DWQ on the DMR
forms.
What if I can't sample because
of bad weather?
Adverse weather is dangerous or it may
limit access for sampling personnel.
Your documentation of adverse weather
and the reasons for not sampling must
be included in your SPPP. A substitute
sample may be taken during the next
qualifying storm event.
What if I don't address visual
monitoring problems?
If you do not respond to problems seen
in visual monitoring, DWQ may require
that you increase the visual monitoring
frequency, apply for an individual per-
mit, implement in -stream monitoring,
install or modify structural stormwater
controls, or implement other controls.
What if I forget to monitor?
DWQ may require monthly monitoring
for a specified tirne period.
Why did you replace Oil &
Grease with TPH in VM areas?
The TPH test only targets chemicals de-
rived from crude oil. The Oil & Grease
(O&G) test recovers fats from animal &
vegetable sources and chemicals from
crude oil. Because TPH is more specific,
it is a better parameter for vehicle main-
tenance areas. The TPH method we are
specifying is EPA 1664A (SGT-HEM). It is
important to note that DWQ is not speci-
fying the more expensive Gas Chromato-
graph (GC) TPH method. DWQ found lab
costs for EPA 1664A (SGT-HEM) to be
comparable to O&G test costs. To test
these parameters in stormwater, labs
must perform this test in accordance
with EPA procedures, but do not need to
be certified. Note- A lower benchmark
applies for TPH: 15 mg/I (not 30 mg/1).
Why are there two benchmark
values for TSS?
The 100 mg/L benchmark applies to
most rivers, lakes, and creeks in North
Carolina. However, some other waters
must receive special protection under
North Carolina water quality rules, and
in these two permits discharges to them
are subject to the more protective
benchmark of 50 mg/L. Those waters
classified as Trout Waters, High Quality
Waters, Outstanding Resource Waters,
and Primary Nursery Areas receive this
extra protection in these permits.

Must I use a North Carolina
certified laboratory?
No. North Carolina water quality rules
do not require that analyses of storm -
water be accomplished by a certified
facility. Please note however. federal
rules at 40CFR136 do require that test
ing far these two permits be by EPA -
approved lab methods. Analysis by a
North Carolina certified lab is often the
easiest way to insure compliance with
federal rules.
Note that pH is a special case, and
must be measured within 15 minutes
of the sample recovery. You must ei-
ther train an -site staff to conduct pH
testing, or contract with commercial
services to test pH in accordance with
EPA field testing methods.
Must a P. E. sign and stamp my
SPPP?
No. North Carolina water quality rules do
not require that the SPPP be the work
product of a North Carolina P.F.
Who inspects me, and for what?
Staff from the DWQ Regional Offices
shown below will inspect your facility.
They will typically ask to see your SPPP
and will check to see if it is complete and
up to date. They will typically ask to see
your recent monitoring results. They will
typically tour the facility with a focus on
the stormwater discharge outfalls and on
your general housekeeping as a way to
assess the potential for polluted storrn-
water discharges. Our staff will always
follow up their Compliance Evaluation
Inspection with a summary letter to you,
restating their findings and, if necessary
indicating whether enforcement action
will be considered in response to those
findings.
