On June 8, 2016, a site inspection was conducted for the Mountaire Farms Lumber Bridge Plant facility located at 17269
NC Hwy 71 North Robeson County, North Carolina, A copy of the Compliance Inspection Report is enclosed for your
review. Beth Sise was also present during the inspection and her time and assistance is greatly appreciated. The site visit
and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG060000, Certificate
of Coverage NCG060295. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters
designated as Big Marsh Swamp, a Class C;Sw waterbody in the Lumber River Basin.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCGO60000 permit.
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the
inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty

B. SITE HISTORY AND CHARACTERIZATION
1. Non -UST Information:
The Mountaire Farms site is located at 17269 NC Highway 71 North in Lumber Bridge, Robeson County,
North Carolina (Figure 1). On September 17, 2014, during refueling of a 30,000-gallon diesel fuel AST
by Cape Fear Transport, a fuel hose ruptured. The released fuel was mostly retained by the AST's dike
and concrete pad. However, some of the fuel was spilled on the ground surrounding the AST pad and
into a nearby storm drain. The storm drain travels 350 feet west under Chicken Plant Drive and
discharges into a lined retention pond. Fuel entered the retention pond, which was filled with heavy
organic sludge.
2. Historical Information:

3. Comprehensive Description of the Release;
On September 17, 2014, a fuel hose ruptured on a tanker truck refueling a 30,000-gallon diesel fuel AST.
The rupture caused the release of approximately 75 gallons of diesel fuel, of which approximately 30
gallons was retained by the AST concrete pad and dike and 45 gallons entered a nearby storm drain. The
storm drain discharged into a lined retention pond. The spill site is an approximately 10' by 50'
rectangular area outside the AST's dike, adjacent to a storm drain. The storm drain discharges into an
approximately 300' by 550' rectangular retention pond (Figure 2). The release was to the surface of the
AST's concrete pad, the surrounding soil, storm drain and a lined retention pond. No ground water or
other surface water bodies were, affected by the release.
4. Description of the Site Characteristics:
The site is a poultry processing plant Iocated in Robeson County, North Carolina. The area is primarily
agricultural with a sparse mixture of residential and commercial properties.
5. Summary of Initial Abatement Actions, Assessment Activities, and Corrective Actions:
Environmental Hydrogeological Consultants, Inc. (EHC) removed approximately 575 gallons of water
and product with a vacuum truck following flushing of the storm drain, Subsequently, GRI supervised
the excavation of petroleum contaminated soils at the site by Cape Fear Transport on September 17, 2014.
Excavation was conducted in the spill area immediately outside the dike. Soil was removed to
approximate depth of 2 feet. Suspect soils were loaded by an excavator directly into truck for transport to

a permitted disposal facility. All encountered soils exhibiting petroleum odors were removed. Areas
adjacent to the AST containment dike and at the drain pipe outfall were excavated. A series of absorbent
booms were deployed to recover trace petroleum from the storm drain outfalls. Following excavation,
soil samples were collected from the base of both excavations.
6. Contaminated Soil and Water Storage/Treatment and/or Disposal:
Based on the invoice provided by EHC, a total 575 gallons of petroleum contaminated fluid was
recovered and transported to a permitted disposal facility. A disposal manifest for the liquids has not
been provided to date. Approximately 20.36 tons of petroleum contaminated soils were excavated and
transported to S & R Landfarms, LLC, a permitted disposal facility located " Pair Bluff, North Carolina.
Copies of the soil disposal manifests are provided as Appendix A.
C. SOURCE INVESTIGATION
1. Investigation Performed To -Date to Determine the Source of the Releaset
Not applicable. The source of the release was a ruptured hose on a tanker truck.
2. Excavation and Sampling
Two soil samples were collected from the base of the excavation area and two samples were collected
along the base of the excavation in the retention pond. The collected soil samples were placed into
laboratory -supplied glassware and immediately placed on ice for transport to the laboratory for analyses
for total petroleum hydrocarbons - gasoline -range and -diesel range organics (TPH-GRO and TPH-DRO)
using EPA Methods 3550/5030/8015C. Additional analyses of volatile organic compounds (VOCs) by
EPA Method 8260, semi-VOCs (SVOCs) by EPA Method 8270 and volatile and extractable petroleum
hydrocarbons (VPH and EPH) by MADEP Methods (risk -based analyses) were requested on any soil
sample with reported TPH-DRO and/or TPH-GRO concentrations exceeding the regulatory action levels
(RALs). Concentrations of TPH-DRO that exceeded the RAL were reported in samples DI-1 and DI-2.
Therefore, these samples were further analyzed by EPA Methods 8260 and 8270 and MADEP VPH and
EPPI. No concentrations of contaminants of concern that exceeded the soil -to -water maximum soil
contaminant concentrations (MSCCs) were reported in either sample, Copies of the laboratory analytical
reports are provided as Appendix B.

D. SUMMARY AND CONCLUSIONS
• On September 17, 2014, approximately 75 gallons of diesel fuel were released when a fuel hose,
ruptured on a tanker truck refueling an 30,000 gallon AST.
• Approximately 20.36 tons of petroleum affected soils were removed from the site on September
17, 2014 and, transported to S&R Landfarms, LLC.
• 575 gallons of petroleum affected water was removed from the site by EHC on September 17,
2014.
• Concentrations of TPH-DRO that exceeded the RAL were reported in samples DI-1 and DI-2;

therefore, risk -based analyses were conducted on those samples. No concentrations of
contaminants of concern that exceeded the soil -to -water MSCCs were reported in either sample.
• Based on the sampling results, no further action is warranted,

This report has been prepared for the exclusive use of Cape Fear Transporting for specific application to
the referenced spill site in Lumber Bridge, Robeson County, North Carolina. Site activitics were
conducted in accordance with generally accepted standards of environmental practices; available
information, and our professional, judgment. No other warranty is expressed or implied.
The data presented in this report is indicative of conditions that existed at the precise locations sampled
and at the time the samples were collected. In addition, the data obtained from samples would be
interpreted as being meaningful with respect to parameters indicated in the laboratory report. No
additional information can logically be inferred from this data. Although the accuracy of this data cannot
be verified, for the purpose of this report, GRI assumes that it is correct.

In response to your renewal application for continued coverage under stormwater General Permit NCGO60000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (CDC)
• A copy of General Permit NCG060000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined In Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last CDC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.orglwebZwq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part ll:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C. A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

10/31/2012. The Division staff is currently in the process of renewing this permit. When a draft is available for
notice and public comment, it will be posted on our website at http://Oortal.ncdenr.org/web/wcl/ws/su/public-notices.
Please continue to check this website to review and comment on proposed changes to the permit. Once the permit
is reissued, your facility would be eligible for continued coverage under the reissued permit.
To assure consideration for continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit, Enclosed you will find a Permit Coverage Renewal Application Form. The
application must be completed and returned by May 4, 2012. Letters confirming our receipt of the completed
application will not be sent,
Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $25,000 per day.
"No exposure exclusion" is now available to industrial facilities in any of the categories of "storm water discharges
associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of
.,no exposure", i.e. the facility' industrial materials and operations are not exposed to stormwater, you can apply for
the no exposure exclusion. For additional information contact the Central Office Stormwater Staff member listed
below or check the Stormwater Permitting Unit Web Site at http://portal.ncdenr.org/web/wq/ws/su/npdessw#tab-5.
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions can be found on the bottom of the form. You will be notified when
the rescission process has been completed.

estimated to be February 22, 2010. This project, once completed will satisfy the

As I discussed with Beth several days ago, monitoring at the outfall adjacent to the entrance road should continue. I
recognize that this goes against what I wrote in my recent inspection report, but it was recently brought to my attention
that entrance/haul roads where materials and/or products are transported in and out of a facility is considered as part
of that facility's industrial activity. There is the potential for spills, leaks, etc. to occur along this road and therefore
monitoring should occur per the conditions of the general permit. A printed copy of this e-mail will be placed in our files
for the facility and I recommend that you do the same. If you have any questions or concerns pertaining to this or any
other issues in regards to the general permit, please contact me.

This letter is in response to your correspondence regarding the Stormwatcr Compliance
Evaluation Inspection which took place at our Lumber Bridge Processing Plant on February 25,
2009. Thank you for your input during the stormwater inspection.
You requested a written response for the following items: 1) revise the SPPP site map to include
the additional employee parking, 2) include an evaluation of feasible alternatives to current
practices in the SPPP, and 3) secondary containment is required for multiple containers with a
capacity of more than 1320 gallons stored outside.
As of this date, the revisions to the SPPP have been completed. Also, an assessment has been
performed on the totes and drums stored outside to determine if it would be possible to relocate
these items indoors. While we are doing our best to keep as many totes and drums inside, we
have determined that outdoor containment will be needed. This will be a capital project to
construct a concrete containment with shelter. Mountaire plans to have this project completed by
December 1, 2009.

Water Quality, conducted a site inspection at the Mountaire Farms of North Carolina facility located at
17269 NC Hwy 71N in Lumber Bridge, Robeson County, North Carolina. A copy of the Compliance Inspection
Report is enclosed for your review. Mr. Robert Jackson, Waste Water Treatment Manager, Ms. Beth Sise,
Environmental Manager, and Mr. John Wren, Director of Engineering & Environmental Services, were also
present during the inspection and their time and assistance is greatly appreciated. Stormwater from this facility
drains to Big Marsh Swamp, a Class C,Sw stream located in the Lumber River Basin. The site visit and file
review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG060295.

Inspection Summary:
Met with Mr. Robert Jackson, Waste Water Treatment Manager, Ms. Beth Sise, Environmental Manager, and Mr. John
Wren, Director of Engineering & Environmental Services. Conducted review of the facility's Stormwater Pollution
Prevention Plan (SWPPP), which contains all required components with the exception of an evaluation of feasible
alernatives to current practices. The SWPPP also needs some minor revisions to the site map concerning expansion of
the employee parking area. Facility has identified two outfalls, 001 near the entrance to the plant at the employee parking
area and 002 at the retention pond located at the rear of the facility. Qualitative Monitoring records were available for
review for both outfalls, however Analytical Monitoring at outfall 001 was missed previously and sampled just prior to the
inspection so results had not been received. Due to the nature of runoff received and discharged at outfall 001 coming
from the employee parking area, which is not considered as an industrial activity, personnel were advised that monitoring
at this location could cease, According to facility personnel, the retention pond with outfall 002 rarely.discharges and
records have been submitted indicating 'No Flow', which were also available for review. During the site evaluation, a
couple of areas were observed where numerous totes and barrels are stored without secondary containment. Personne!
were advised of the secondary containment requirements in the general permit for storage areas with multiple containers
with a capacity of more than 1,320 gallons, A written response should be submitted to the regional office concerning the
aforementioned revisions to the SWPPP and plan of action regarding the provision of secondary containment around all
outside storage areas of liquid materials.

In response to your renewal application for continued coverage under stormwater General Permit NCG060000 the Division of
Water Quality (DWO) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG060000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes iri the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part II Section B Table 1 — An increased sampling frequency from once per year to twice per year.
• Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part II Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
DWO received a number of comments on a series of general permits similar to this one. A full response to comments can be
found at http://ncwaterquality.org/su/industriaigpinfo.htm. Some comments resulted iri permit modifications, others are
addressed in the response document or Fact Sheet. A few specific requests for clarification are addressed below.
1. What is the deadline for having a revised SPPP that reflects the provisions of the new General Permit? DWQ will require
that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permittee's new
Certificate of Coverage.
2. Must analytical results be by a certified tab? What about pH measurements? All analytical results obtained to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's Laboratory Section Certification Branch. This includes field pH measurements.

plan or other document filed or required to be maintained under Article 21 or regulations of the Environmental
Management Commission Implementing that Article, or who falsifies, tampers with or knowingly renders inaccurate any
recording or monitoring device or method required to be operated or maintained under Article 21 or regulations of the
Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by a
fine not to exceed $10,000, of by imprisonment not to exceed six months, or by both. (18 U.S.C. Section 1001 provides
