Your assistance was greatly appreciated. The inspection report is attached. Findings during the inspection were as follows: 1. Certificate of Coverage (COC) No. NCG060229 of NPDES general permit NCG130000 was issued to Procter and Gamble Pet Care (Henderson) to discharge stormwater runoff to the State waters. 2. The facility has developed a Stormwater Pollution Prevention Plan (SPPP). A review of the plan was conducted. The plan covered all component required by the general permit. 3. All six stormwater outfalls were observed during the inspection and were in good condition. 4. Qualitative and analytical monitoring was conducted at the all six storm water discharge outfa is semi-annually. However, due to the exceedences of fecal coliform bench mark, the facility has been in the process of implementing a Tier Two response. It was noted that the facility had continually struggled to meet the fecal coliform bench mark in the past years. The facility did hire contractors to explore feasible treatment approaches to solve this chronic problem. Mr. Myrl Nisely and 1, both of the NC Division of Water Quality (DWQ), Raleigh Regional Office (RRO), conducted a stormwater compliance evaluation inspection (CEI) at P&G's Henderson plant on 30 August 2007. Your assistance and cooperation, as well as that of Greg Fears, Steve Gittis, Frank Ayscue and Tyrone Green, were greatly helpful and appreciated. Inspection results are summarized below and an inspection checklist is attached for P&G's records. 2. This facility has six stormwater discharge outfalls (SDO) all of which discharge to Lynch Creek, which is currently classified as a class C, nutrient sensitive water (NSW), in the Tar Pamlico river basin. All six SDOs were identified and inspected. The right-of-ways were clear and accessible. Several of the drainage ditches leading up to the SDOs had a considerable amount of sediment, which according to Mr. Gittis and Mr. Ayscue was the result of recent site work to recondition the ditches. Several areas of the ditches had recently been lined with rock and/or rip rap. At the time of the CEI, sediment had not left the site and entered the receiving streams, and we suggested to Mr. Gittis and Mr. Ayscue that the sediment be cleaned out soon in order to prevent that from occurring. We also suggested that they may wish to place several layers of silt fence, or several check dams, across the ditches in order to help confine the sediment to the site until it could be removed. 3. The rest of the site was clean and well maintained. There were several. secondary containments and those with drain lines had manual drain valves that were properly secured. No other areas of concern were noted. 4. All analytical and quantitative monitoring has been accomplished as required by the permit. 5. DWQ received a letter from you dated 12 June 2007 that voiced P&G's concerns about the presence of bacteria at the SDOs. According to the letter, P&G has had difficulty in meeting its stormwater permit benchmarks for Fecal Coliform and recent efforts to identify the cause(s) have failed. By the time of this CEI however, conditions had improved somewhat, with bacterial levels decreasing or disappearing altogether at various outfalls. 6. In your letter, you requested that DWQ add E. Coli as a parameter to P&G's permit to better characterize the stormwater runoff and hopefully help identify the source(s) of bacterial contamination. DWQ has no issue with P&G testing for E. Coli, but it must still test for each of the parameters specified in the permit regardless. Please remember that the values specified in the permit are benchmark values that are intended to gauge the overall success of the stormwater pollution prevention plan (SP3)/program at the site. In an effort to assist P&G in resolving this issue, Mr. Nisely forwarded your letter and technical data to DWQ laboratory's biological unit for consultation. Any further information we get from the lab that may assist in this matter will be forwarded to your attention as it becomes available. Please continue your diligent efforts to resolve the issue in the meantime. 8. The SP3 was reviewed. All the required components were present and met requirements. Only minor discrepancies were noted as listed below: a. Latitudes and longitudes of the individual SDOs were not listed on the site map. They were however, listed in the narrative text of the SP3. b. The percent of impervious surface for each drainage area was not noted on the site map. However, the percentages were listed in the narrative text of the SP3. c. There were no arrows illustrating the direction of stormwater flow from each drainage area on the site map. d. P&G has not experienced a reportable spill over the past three years and none were therefore reported or recorded in the SP3. It was suggested that P&G make an annual notation of some kind within the SP3 if no spills have occurred during the previous year. This annotation could be made in conjunction with annual SP3 reviews and other annual SP3 requirements. e. It was also suggested that P&G add a checklist of some kind to the SP3, which lists the different requirements in the SP3 according to frequency. Such a checklist would help those responsible for implementing the SP3 to ensure that all requirements are met at the proper frequencies. 9. Either Mr. Nisely or I will contact you if we receive any helpful input from the laboratory regarding the bacteria issue. Please keep us up to date on your efforts to resolve it. I appreciate the questions you raised in the letter. Generally speaking, exceeding the cutoff concentration in a storm water permit is not viewed as violating a "permit limit". The cutoff concentrations are not like wastewater permit "limits" but are meant to be used as indicators that would trigger the permittee to evaluate the effectiveness of the Storm water Pollution Prevention Plan. Our office would view continued exceedences without attempting to identify and correcting the problem as a - violation of terms of the permit but simply exceeding the value in and of itself would not be a violation. What I would like to do is perform a site visit later this summer (late July or early August) to review the compliance with the permit as a whole rather than focus on this one issue solely. With regard to modification of your permit to include an E Coli test, I will forward you letter to our permitting staff (in the Division's Headquarters) for consideration. I spoke with the head of SW permitting and he indicated it would be unlikely they would make a change since this is a general permit but if you want to pursue an individual permit that may me something they could look at. on we can hold off on that decision until after the site visit. Background: Iams personnel have sampled storm water and subsequently reported the results to_ NCDEHNR. These results indicate that lams has had difficulty in meeting, its storm water permit limits for fecal coliform at the Henderson plant. Plant personnel developed and Executed a plan to reduce/eliminate fecal coliform by more frequent cleaning of the plant perimeter and plant roofs of droppings from the pigeons and other birds that are often densely attracted to the facility by the meal and grains managed there. In addition, we have installed electronic bird distress sounders in an effort to discourage the birds from occupying building roofs. Discussion: Despite these measures, storm water testing for Fecal Coliform Limits continues to exceed our permitted values. Iams personnel contracted the assistance of Froehling & Robertson, Inc, an environmental consulting firm, to help us better understand the issue. During F&R's initial site visit we obtained samples of bulk protein material from the parking/transfer lot and bulk storage areas. We also sampled surficial soils and water from the facility's storm water retention basins. These samples, analyzed by a third party laboratory, indicated.that fecal coliform was present in a majority of the samples. The results are compared with historical storm water samples in the attached Table 1. The patterns of resistance fit well with the local historical reference library utilized by laboratories. The current samples also were analyzed for E.coli, which was present at very low levels. This suggests the potential presence of non -fecal bacteria. Conclusions: Based on these initial findings we collected additional source samples from the protein meal and ran concurrent analyses for fecal coliform and E. coli as well as Bacteria Source Tracking (BST), using the data collected to date. The second round of sampling confirmed the bacteria sources and suggested additional possible ways to address the elevated fecal coliform levels in the storm water. The follow-up analytics yielded that the bacteria was in fact bacteria known and registered as "mimicking" bacteria for fecal coliform and expected to yield false positive results when analyzed for fecal coliform. (See Table No. 2). The bacteria identified are as follows: Brenneria rubrifacens Yersinia Enterobacter aerogenes (Kleb. Mobilis) Enterobacter cloacae Kluyvera Georgiana Pectobacterium carotovorum ss betavasculorum Proteus pennerilvulgaris Intermedia Yersinia ruckeri Recommendation: In light of the outcome of this testing we would like to discuss the possibility of augmenting our fecal coliform test with a secondary test for E. Coli. Based upon an agreed upon limit, our storm water permit would reflect the E. Coli test as the indicator if we are in violation of our Storm Water Permit. As a next step we would like to schedule a meeting that would allow us to discuss the possible modification of our storm water permit.
