Scotland County
On 14 November 1995, you requested a 401 Water Quality Certification from the
Division of Environmental Management for your project (pond construction) located near
SR 1619 near Johns in Scotland County. We wrote to you on 28 November 1995
discussing concerns that we have regarding the design of the project and placing it on hold
until those concerns are addressed. As of today, we have not received a response to our
earlier letter. Unless we receive a response from you by 1 April 1996, we will consider
that you have withdrawn this application and are not interested in pursuing the project at
this time.

permit for construction of a pond, Scotland County. Your application was not complete since
the enclosed application form was not completed. Please provide information regarding the
location of your project. This information is needed by DEM in order for us to decide
whether this modification is practicable. I apologize for the delay in our response. The
Division of Environmental Management was never notified of your 8 September letter to Mr.
Grady Dobson. We will expedite review of your project as soon as we receive the completed
forms.
I can be reached at 733-1786 if you have any question. Until this information is
received, I will request (by copy of this letter) that the Corps of Engineers place this project
on hold.

Dear Mr. Gibson:
Reference your application of September 8, 1995, for Department of the
Army (DA) authorization to construct a pond impacting 0.75 acres of wetlands
above the headwaters of Bridge Creek, on your property located on the east
side fo SR 1619, soth of Johns, Scotland County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title
33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided by Nationwide
Permit No. 26 for discharges of dredged or fill material into headwaters and
isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM). You should contact Mr. John
Dorney, telephone (919) 733-1786, regarding water quality certification. This
nationwide permit does not relieve you of the responsibility to obtain other
required state or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation, to complete the activity under the present
terms and conditions of this nationwide permit.

I have an old partly filled abandoned livestock watering pit on my
farm located on Hwy 501 one half mile South West of Johns in Scotland
County. The pit is approximately 30 feet wide and 80 feet long. The
attached wetland information by USDA - Natural Resources Conservation
Service shows less than one half acre of wetland.
Please permit me to enlarge the above for a desirable fish pond.
will spread the old spoil, clear privet hedge, and three willow oaks.
The planned pond will be one half to three quarter of an acre in size.
Attached are a sketch of the pond, location map, and geological
survey map.
