As requested, Eastem Minerals, Inc. is providing response to the above NOV and, with this letter,
requesting rescission of Certificate of Coverage NCG060142 (Item 5, Case No. NOV-2011-PC-0168).
Certificate of Coverage NCGO60140 under General NPDES Permit No. NCG060000 will be continued
for discharge of stormwater associated with industrial activities from the entire site. The correct address
for all facilities at the site is 170 Eastern Minerals Road, Henderson, NC 27537.
The Eastern Minerals — Henderson Facility is currently updating the Stormwater Pollution Prevention
Plan (SPPP) to include the entire site, which incorporates the former Eastern Block Plant (Item 2, Case
Nos. NOV-2011-PC-0618 & 0619). Eastern Minerals expects the SPPP to be updated by the end of
January 2012. Implementation will be directed by Mr. Gary Tucker, Assistant Plant Manager, who will
be the contact for future inspections.
Mr. Tucker is also coordinating completion of qualitative and quantitative monitoring for the site as
required by the general permit (Item 3, Case No. NOV-2011-PC-0618 & 0619). Secondary containment
for the kerosene tank will be modified to increase capacity and the tank repositioned and anchored by the
end of January 2012 (Item 5, Case No, NOV-2011-PC-0619).

On November 16, 2011, I, Cheng Zhang of the Raleigh Regional Office (RRO) conducted a
Stormwater Compliance Evaluation Inspection at Eastern Minerals, Inc. The assistance provided
by Mr. Charles Gordon, the plant manager, and Mr. Gary Tucker, the assistant plant manager,
was greatly appreciated. The inspection report is attached. Findings during the inspection were
as follows:
Certificate of Coverage (COC) No. NCG060140 of NPDES general permit
NCG060000 was issued to Eastern Minerals, Inc., to discharge stormwater runoff to
Lynch Creek, a class C NSW stream, in the Tar -Pamlico River Basin.
2. Eastern Minerals, Inc. was found to have violated Part II Section A of the
General Permit for failure to implement a Stormwater Pollution Prevention Plan
(SPPP). The SPPP was developed in 1997, but has not been implemented. The
facility must review and update the plan to include the runoff from the former
Eastern Block Building (currently covered by COC NCG060412, which should
be rescinded).
3. Eastern Minerals, Inc. was found to have violated Part [I Section B and Section
C of the General Permit for failure to conduct analytical and qualitative
monitoring. The facility must start to conduct both analytical and qualitative
monitoring at the stormwater discharge outfall (SDO). The first qualitative and
analytical monitoring must be conducted no later than December 31, 2011.

4. The secondary containment for the 500-gallon kerosene tank was observed and
found not adequate, part of the tank stuck out of the containment and the
volume of the containment appeared insufficient. The Vehicle maintenance was
conducted in the workshop; used motor oil was stored in drums with adequate
secondary containment. Please record the monthly usage of new motor oil.
5. The SDO was observed during the inspection, it was well maintained and in good
condition.

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS §143.215.1 (c)(1) which
states "Ail applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

Your facility is currently covered for stormwater discharge under General Permit NCG0600(H). This permit expires
on August 31, 2001 The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued'by late summer of'2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit. you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must he completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250-00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215. l and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

Permits Unit Web Site at http://h2o.enr.sta(c.nc.us/su/stormwater.html
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.
