Dear Mr. Gordon:
On May 20, 2004 Jerry Rimmer of the Raleigh Regional Office —DWQ conducted a stormwater
and irrigation permit compliance evaluation inspection of the Eastern Mineral, Inc. facility
Permit # WQ0003075 & NCG060142. A copy of the inspection checklist is attached. The
assistance you and Mr. Gary Tucker provided during the inspection was greatly appreciated. The
knowledge of the irrigation system and stormwater program demonstrated the commitment that
your company has made to this and other environmental permit programs. Findings listed on the
checklist were as follows:
1. The permits, SPPP documentation, site plan, site chemical inventory, analytical
records, site inspection records and procedures were compliant.
2. George Yankey of Enviromatters, Inc is operating the irrigation system as designated
ORC. Gary Tucker has completed training and will take the test for certification
soon, after which he may be designated as ORC with proper notification to DWQ.
3. Water had been applied to the spray field May 19, 2004 and a rain event followed that
evening. The fields were free of standing water and there is no evidence of runoff.
4. The grass cover crop is adequately maintained, buffer areas meet permit
requirements, the field is protected with fencing and access to two monitor wells is
well maintained. The pump and portable spray nozzle are operational and appear to
function properly.
5. Analyses of groundwater are per permit. Sludge in the pond has been analyzed and
can be removed for proper disposal to allow system closure if you decide to do so.
6. The process pipe to the holding pond has been removed and the area graded so no
more stormwater runoff enters the pond. The contents consist of rainwater that falls
directly into the pond. Freeboard exceeded three feet at time of inspection.
7. Permit WQ0003075 renewal has been drafted to allow continued use of the irrigation
system. The expired permit will remain in effect until your renewal request review
can be finalized and the permit reissued.
8. The stormwater certificate of coverage was on file as was stormwater monitoring.
9. Most stormwater is collected in a silt retention basin. This system is maintained and
accessible. There is a rain gauge on site.

10. Review of the analyses indicates that you are sampling per stormwater permit. The
sample points are acceptable and data has been submitted in compliance with the
permit. You must record rainfall events and total rainfall with all monitoring events.
11. Annual updates are being made to the SW plan.
12. Training documentation was on file.
13. The General Permit COC # NCG060142 expires 08/31/2007.
The possibility of closure for this system was discussed, but Eastern prefers to continue spraying
rainwater instead of removing and disposing the sludge in the lagoon. Several analyses indicate
the presence of barium, chromium, lead, cadmium and arsenic in some of the sludge samples
from the lagoon. The chromium, cadmium and lead concentrations are above groundwater
standard limits thus requiring removal of sludge and groundwater monitoring for closure.
Your continued attention to the operations of the irrigation system and stormwater protection
program is appreciated. The irrigation system and stormwater program appears well
organized, sufficiently documented and is being managed in a timely manner. The commitment

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

Your facility is currently covered for storinwater discharge under General Permit NCG060000. This permit expires
L-
on August 31. 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4. 2002 in order to assure continued
coverage under the general permit -
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10.000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "no exposure". i.e. the facilty industrial
materials and operations are not exposed to storinwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http:Nh2o.enr.state.nc.us/su/stormwater.html
if the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the

December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are

application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS §143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. serf.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

Your facility is currently covered for stormwater discharge under General Permit NCG060000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit. you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must he completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the l t categories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
