Department of Environment, Health and Natural Resources 4401 Reedy Creek Road Raleigh, North Carolina 27607 O PP P Igg" Re: Upper Piedmont Regional Landfill, Person County, North Carolina Dear John: Approval of 401 Water Quality Certification (DEM Project #951128) was granted to Upper Piedmont Environmental, Inc. on November 20, 1995 to fill approximately 0.70 acre of wetland or waters associated with proposed development of the Upper Piedmont Regional Landfill in Person County. This facility consists of 479 acres located approximately 10 miles east of Roxboro near the Person County/Granville County line (Figures 1 and 2). Conditions associated with the issued 401 Certification indicated that deed restrictions must be placed on remaining wetlands and streams (permanent and intermittent) on the property to prevent future fill. A meeting was held on December 18, 1996 with members of the landfill planning team and DEM officials, including yourself and Mr. Pete Caldwell, to discuss 401 conditions and mitigation measures. During the meeting, a decision was made that conservation easements would be placed on selected stream segments and associated buffers (average buffer widths: 50' to 100') along southern and eastern portions of the tract. We understand that such measures would function as satisfactory mitigation for expected wetland/surface water impacts associated with this project. Platted stream segments targeted for placement under conservation easements are shown on the attached survey drawings. This agreement was contingent upon allowing access to interior reaches of the property, which will involve crossing the dedicated easements. A road crossing of a minor intermittent tributary (0.0099 acre impact) and two wetland crossings for a force main (0.011 acre) will satisfy this access need. Detailed locations for these amenities are shown on Figures 3 through 6. Total additional impact to wetlands/surface waters resulting from these actions is 0.021 acre. A modified PDN application with supplemental support information is hereby submitted for your review and approval. This application requests permission to impact a total of 0.721 acre of headwater/surface water wetlands under Nationwide Permit (NWP) #26 (33 CFR 330 Appendix B). This acreage calculation includes 0.70 acre of impact per our initial request, in addition to the 0.021 acre encroachment resulting from conservation easement crossings. Anderson, Region Coordinator Habitat Conservation Program DATE.: November 21, 995 SUBJECT: 401 Water Quality Certification for Upper Piedmont Environmental, Person County, Carolina, Cub Cek, Tar River Basin, 951128 Staff biologists with the North Carolina Wildlife Resources Commission have reviewed the subject application for 401 Water Quality Certification with respect to anticipated project impacts on aquatic habitats. Our comments are provided in accordance with certain provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 at seq.), and section 401(b) of the Clean Water Act of 1977 (as amended), and North Carolina Otmeral Statutes (O.S. 113-131 at sN.). The project involves the construction of a landfill near the intersection of NC 158 and SR 1724 that will destroy 0.70 acres of valuable wetlands. There are a total of 9.10 acres of wetlands on the project site, which is in the Cub Creek drainage of the Tar River Basin. The wetlands on this site are of spat ial si ific:ance. btx:auso they help maintain water quality and downstream habitats for several federal and state listed species, Thu species found downstream in the Tar River below the confluence of Cub Crmk include: the dwarf wedge mussel (Ak+smWnta helervdon), federally and stuto cndangcxcd; the scquawfoot (Staph1w undulaw), a state listed threatenud spocivs; the notched rainbow 07116sa cnnstrlcla) and the t:astan cruukahell (Villoaw delumbis), both significantly rare. Department of Environment, Health and Natural Resources 4401 Reedy Creek Road Raleigh, North Carolina 27607 Re: Upper Piedmont Regional Landfill, Person County, North Carolina Dear John: KIT Upper Piedmont Environmental, Inc. proposes development of a solid waste facility for Person County to be located at a currently undeveloped site approximately 10 miles east of Roxboro near the Person County/Granville County line (Figure 1). The site consists of 479 acres at the intersection of NC 158 and SR 1724 (Figure 2). Environmental Services, Inc. (ESI) has been retained to assist with environmental planning for the project. The tract was investigated in March and April, 1995. Studies were conducted to determine potential presence of protected species, wetlands, and cultural resources. ESI requested listings of federal protected species from the U. S. Fish and Wildlife Service for Person County prior to initiation of project studies. In addition, N.C. Natural Heritage Program (NCNHP) files were reviewed for known presence of natural heritage elements. No federal Threatened or Endangered species are listed for Person County. In addition, no identified sightings are on file with NCNHP, and no additional information is available for the site (see attached NCNHP correspondence dated May 22, 1995). This project has been coordinated with the N.C. Division of Archives and History, State Historic Preservation Office (SHPO). SHPO files were researched during initial planning, followed by a Phase I investigation of the property. Eight (8) archaeological sites were identified, but none were considered eligible for the National Register of Historic Places. Recent correspondence from SHPO (attached correspondence dated September 20, 1995) concurred with this determination. Wetlands and surface water areas subject to jurisdictional consideration under Section 404 of the Clean Water Act (33 CAR 320 et seq.) have been identified and delineated. Wetlands are restricted to three (3) small pockets located at the origin of minor streams on the subject property (0.28 acre). Remaining jurisdictional areas are confined to surface waters within small linear drainage channels (2.16 acres), and a series of small farm impoundments sporadically located along drainageways (6.66 acres). Wetlands were confirmed by Mr. Eric Alsmeyer, U.S. Army Corps of Engineers (COE) on May 2, 1995 (see attached wetland map signed June 7, 1995). ENVIRONMENTAL SERVICES, INC. Mr. John Dorney October 19, 1995 Page 2 Every effort has been made to avoid encroachment into jurisdictional areas whenever possible. Careful site planning has been undertaken to position landfill disposal cells on high ground sites. An erosion and sediment control plan has been prepared and submitted to the N.C. Division of Solid Waste Management. Buffers will be enforced between all construction areas and identified jurisdictional sites. Surface water and groundwater will receive regular monitoring in an effort in to insure protection of area water quality. Because of these avoidance and minimization efforts, encroachment has been limited to 0.70 acre of wetlands/surface waters on the subject property (see Figure 3). Given the extent of anticipated impacts (less than 1 acre) and the nature of these jurisdictional areas (i.e. headwater wetlands/surface waters and impoundments), we believe that encroachment can be authorized under Nationwide Permit #26 (CFR 330 Appendix B). Since impacts will be less than one (1) acre, COE notification is deemed unnecessary. However, by copy of this letter, we are requesting NWP #26 review and concurrence from the Wilmington COE District. In support of NWP #26 issuance, 401 Water Quality Certification is required from the N.C. Division of Environmental Management (DEM). We understand that DEM has review authority over NWP #26 activities where impacts exceed 0.33 acre. Therefore, we are providing a completed Pre- discharge Notification (PDN) application along with appropriate support information. Seven (7) copies are included with this request. Department of Environment, Health and Natural Resources 4401 Reedy Creek Road Raleigh, North Carolina 27607 Re: Upper Piedmont Regional Landfill, Person County, North Carolina Dear John: °15IIzg Upper Piedmont Environmental, Inc. proposes development of a solid waste facility for Person County to be located at a currently undeveloped site approximately 10 miles east of Roxboro near the Person County/Granville County line (Figure 1). The site consists of 479 acres at the intersection of NC 158 and SR 1724 (Figure 2). Environmental Services, Inc. (ESI) has been retained to assist with environmental planning for the project. The tract was investigated in March and April, 1995. Studies were conducted to determine potential presence of protected species, wetlands, and cultural resources. ESI requested listings of federal protected species from the U.S. Fish and Wildlife Service for Person County prior to initiation of project studies. In addition, N.C. Natural Heritage Program (NCNHP) files were reviewed for known presence of natural heritage elements. No federal Threatened or Endangered species are listed for Person County. In addition, no identified sightings are on file with NCNHP, and no additional information is available for the site (see attached NCNHP correspondence dated May 22, 1995). This project has been coordinated with the N.C. Division of Archives and History, State Historic Preservation Office (SHPO). SHPO files were researched during initial planning, followed by a Phase I investigation of the property. Eight (8) archaeological sites were identified, but none were considered eligible for the National Register of Historic Places. Recent correspondence from SHPO (attached correspondence dated September 20, 1995) concurred with this determination. Wetlands and surface water areas subject to jurisdictional consideration under Section 404 of the Clean Water Act (33 CAR 320 et seg.) have been identified and delineated. Wetlands are restricted to three (3) small pockets located at the origin of minor streams on the subject property (0.28 acre). Remaining jurisdictional areas are confined to surface waters within small linear drainage channels (2.16 acres), and a series of small farm impoundments sporadically located along drainageways (6.66 acres). Wetlands were confirmed by Mr. Eric Alsmeyer, U.S. Army Corps of Engineers (COE) on May 2, 1995 (see attached wetland map signed June 7, 1995). ENVIRONMENTAL SERVICES, INC. Mr. John Dorney October 19, 1995 Page 2 Every effort has been made to avoid encroachment into jurisdictional areas whenever possible. Careful site planning has been undertaken to position landfill disposal cells on high ground sites. An erosion and sediment control plan has been prepared and submitted to the N.C. Division of Solid Waste Management. Buffers will be enforced between all construction areas and identified jurisdictional sites. Surface water and groundwater will receive regular monitoring in an effort in to insure protection of area water quality. Because of these avoidance and minimization efforts, encroachment has been limited to 0.70 acre of wetlands/surface waters on the subject property (see Figure 3). Given the extent of anticipated impacts (less than I acre) and the nature of these jurisdictional areas (i.e. headwater wetlands/surface waters and impoundments), we believe that encroachment can be authorized under Nationwide Permit #26 (CFR 330 Appendix B). Since impacts will be less than one (1) acre, COE notification is deemed unnecessary. However, by copy of this letter, we are requesting NWP #26 review and concurrence from the Wilmington COE District. In support of NWP #26 issuance, 401 Water Quality Certification is required from the N.C. Division of Environmental Management (DEM). We understand that DEM has review authority over NWP #26 activities where impacts exceed 0.33 acre. Therefore, we are providing a completed Pre- discharge Notification (PDN) application along with appropriate support information. Seven (7) copies are included with this request.
