A copy of the Compliance Inspection Report is enclosed for your review, Amy Dorney, Health, Safety & Environmental Manager, Madison Mercer, Environmental Engineer and Donna Locklear, Document Control were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG060000, Certificate of Coverage-NCG060114 Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Peddlers Branch, a class C stream, in the Cape Fear River Basin. As a result of the inspection, the facility was found to be fully in compliance with the conditions of the NCG060000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. The inspection was conducted with the assistance of Amy Dorney, Safety, Health and Environmental Manager, Madison Mercer, Environmental Engineer and Donna Locklear, Document Control. The facility had applied for and obtained representative outfall status in June 2006, Outfall #2 is the representative outfall where monitoring/sampling is occurring. The Stormwater Pollution Prevention Plan (SPPP) was reviewed and found to contain all of the necessary components. Analytical and Qualitative monitoring forms were also reviewed. Monitoring frequency is being done in accordance with the General Permit. The facility grounds were observed, including Outfall #2 and all ASTs to ensure that there was proper secondary containment around the ASTs. Everything appeared in order on the grounds of the facility. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (0&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections 8, C: The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Failure to properly comply with conditions of the permit, like those bulleted below, constitutes violations and is subject civil penalty assessment of up to $25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NO]) must be submitted and a Certificate of Coverage issued prior to any discharge of stornwater associated with the industrial activity, process wastewater, and/or mine dewatering. . • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point source discharge to surface water of the state is prohibited unless it is an allowable non-storni'water discharge or is covered by another permit, authorization or approval. • There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the permits have following condition requirements (you must read your entire permit to ensure full compliance): o Development and compliance with the Storm,,vater Pollution Prevention Plan o Collection, reporting, and recording of Analytical Monitoring o Collection and recording of Qualitative Monitoring o Collection, reporting and recording of Vehicle Maintenance Monitoring o Records — Visual monitoring shall be documented and records maintained at the facilitv along with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall also be maintained on -site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and ail original strip chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of least 5 years for the date of the sample measurement, report or application. o Expiration— The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation. o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. OFFICE State of North Carolina Department of Environment, Health, and Natural Resources Fayetteville Regional Office Wachovia Building, Suite 714 Fayetteville, NC. 28301-5043 Dear Mr. Rawls: This letter is submitted as a follow-up notification to the phone call you received on June 6th,' 1995 reporting a spill of *18 rap *shampoo" (off specification shampoo/conditioner) from the Raeford facility of Chesebrough-Pond's USA (CPUSA) into a storm water conveyance and the Fire Protection Lagoon at the facility A brief description of the spill follows: On June 5th, at. approximately 6:30 pm, some foam was noted at the south end of the Fire Protection Lagoon. The foam was coming from a storm drainage pipe. To prevent the foam from spreading out into the lagoon and possibly reaching Outfall #002, oil. booms were tied together and placed around the foam at the point where the piped enters the lagoon. No foam reached outfall #002, and the foam was contained at approximately 9:00 pm. At approximately 9:30 pm, samples were caught from the lagoon and the outfall. An analysis of the water in the lagoon, at the point of entry of the storm pipe, showed 200 ppm COD. An analysis of the water flowing through outfall #002.showed 10 ppm COD. By 7:30 cam on June 6th, all of the. Loam i;i the storm drainage pipe and the lagoon had dissipated. Upon investigation, the origin of the -foam was found to be a Non - Hazardous storage area used to store scrap shampoo. A number of 55 gallon drums of scrap shampoo were stored in an outside diked area. Due to heavy rains, shampoo residue was washed off the drums onto the floor of the diked area. i�lthough the drain valve on the diked area was closed, the heavy r�iin.s caused the diked area to overflow into an adjace.it storm water -Ir_ain, causing foaming in the drain pipe. The residue flowed down the storm drain to t-he Fire Protection Lagoon. As m.:ntioned above, . sol7Le foaming was also noted where= the drain pipe empties into the lagoon. It. is CPUSA's belief that only a small amount of scrap shampoo entered the storm drainage pipe and lagoon. Unfortunately, it only takes a small amount of shampoo to create 2 a large amount of foam. To prevent re -occurrence of this incident, the Non -Hazardous storage area mentioned above will be eliminated. Scrap shampoo will be stored inside the Main Plant building. The application processing fees are the same for individual stormwater permits and General Permits ($400.00); however, the individual permits have an additional annual administering and compliance monitoring fee of $600.00 (reduced to $450.00 if compliance is maintained), the General Permits do not have any annual fee.
