In accordance with your request, Certificate of Coverage Number NCG060107 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. She has the rescission letter in hand, as per her email below. Based on emails below, subsequent to the June 2011 request to rescind, she changed her mind, and despite contacting us (DP or KBP or both), we didn't react as intended. So, it looks like she sent in paper in June 2011 requesting rescission, and then verbally requested that we not rescind. If that verbal or email request came to me, I should have made a paper copy and put it in the file to prevent just this sort of result. Looks like that didn't happen. Looks like a disconnect between initial written instructions, and subsequent verbal instructions or perhaps lack of my follow through with an email communication. i'II chat with Brian (he handles our rescissions) to see what makes the most sense in rectifying. In regard to this activity, waste containers are kept closed, stored on pallets, inspected frequently in order to minimize any potential environmental concerns, and transported offsite for disposal on a routine basis. However, after we spoke I realized that we also will need to request modification to limit the property to which the permit applies. The permit is issued for GSK's South Campus, located at 3030 East Cornwallis Drive (i.e., the South Campus Main Complex); the campus also includes GSK property at 3025 East Cornwallis Drive (i.e., the South Campus, North Complex), across the street, and this property is included in the South Campus permit as well. As part of GSK's footprint reduction project in RTP, the South Campus is being vacated and all of the property has been offered for sale, both as one unit and as individual tracts. It appears that GSK has a prospective buyer for the Main Complex (i.e., the tract at 3030 East Cornwallis) and it may be sold in the next 60 days. Thus GSK will shortly notify DWQ of an expected change to the site boundary, per E.5 of our permit. I'll provide a revised figure for the site boundaries — please let me know if I need to provide any additional information or take additional action for this. We have not had any industrial activities on the Main Complex that required stormwater permitting. We do not plan to transfer the permit to a new owner. The North Complex, while for sale, is still owned and operated by GSK. We currently have two RCRA hazardous waste storage pads on the North Complex that we believe meet the definition of 'industrial activity' and have been managed accordingly. We have notified NCDENR Division of Waste Management, Hazardous Waste Section of our intent to begin closure of these pads in the near future, with all staff relocated from the property and hazardous waste storage at these locations ending by the end of 2011. This is what has prompted our June 9, 2011 request to excise the stormwater permit. However, some additional site activities at the North Complex will necessitate establishing up to two 90-day RCRA hazardous waste storage areas on the property_ One will support a groundwater remediation construction project expected to commence this month and last until spring 2012; a second may be set up to support laboratory decommissioning and decontamination in a building scheduled for demolition in 2012; this effort may extend until fall 2012. Based on these anticipated activities, GSK is requesting postponement of our request to excise the stormwater permit until a later date in 2012, to be better determined in the future. The 3029 site currently is in the process of removing a pod which stores hazardous chemicals to another Glaxosmithkline site. This site has secondary containment and no exposure to stormwater. The same identical pod set-up will be at the 5 Moore Drive site. 7. Clean Harbors does the sampling, stormwater inspections and stormwater plan implementation. 8. All monitoring is performed as required by NCG06000. Qualitative monitoring was performed at all outfalls. Qualitative and analytical monitoring was performed at the representative outfall. The facility did not have documentation of representative outfall status for outfall 001. Glaxosmithkline is required to show documentation of representative outfall status for outfall 001 or apply for representative outfall status for outfall 001. Page: 4 Per our discussion earlier today, I'm requesting that NCDENR postpone excision of GSK's stormwater permit NCG06017 until a later date in 2012. However, after we spoke I realized that we also will need to request modification to limit the property to which the permit applies. The permit is issued for GSK's South Campus, located at 3030 East Cornwallis Drive (i.e., the South Campus Main Complex); the campus also includes GSK property at 3025 East Cornwallis Drive (i.e., the South Campus, North Complex), across the street, and this property is included in the South Campus permit as well. As part of GSK's footprint reduction project in RTP, the South Campus is being vacated and all of the property has been offered for sale, both as one unit and as individual tracts. It appears that GSK has a prospective buyer for the Main Complex (i.e., the tract at 3030 East Cornwallis) and it may be sold in the next 60 days. Thus GSK will shortly notify DWQ of an expected change to the site boundary, per E.5 of our permit. I'll provide a revised figure for the site boundaries — please let me know if I need to provide any additional information or take additional action for this. We have not had any industrial activities on the Main Complex that required stormwater permitting. We do not plan to transfer the permit to a new owner. The North Complex, while for sale, is still owned and operated by GSK. We currently have two RCRA hazardous waste storage pads on the North Complex that we believe meet the definition of 'industrial activity' and have been managed accordingly. We have notified NCDENR Division of Waste Management, Hazardous Waste Section of our intent to begin closure of these pads in the near future, with all staff relocated from the property and hazardous waste storage at these locations ending by the end of 2011. This is what has prompted our June 9, 2011 request to excise the stormwater permit. However, some additional site activities at the North Complex will necessitate establishing up to two 90-day RCRA hazardous waste storage areas on the property. One will support a groundwater remediation construction project expected to commence this month and last until spring 2012; a second may be set up to support laboratory decommissioning and decontamination in a building scheduled for demolition in 2012; this effort may extend until fall 2012. Based on these anticipated activities, GSK is requesting postponement of our request to excise the stormwater permit until a later date in 2012, to be better determined in the future. However, after we spoke i realized that we also will need to request modification to limit the property to which the permit applies. The permit is issued for GSK's South Campus, located at 3030 East Cornwallis Drive (i.e., the South Campus Main Complex); the campus also includes GSK property at 3025 East Cornwallis Drive (i.e., the South Campus, North Complex), across the street, and this property is included in the South Campus permit as well. As part of GSK's footprint reduction project in RTP, the South Campus is being vacated and all of the property has been offered for sale, both as one unit and as individual tracts. It appears that GSK has a prospective buyer for the Main Complex (i.e., the tract at 3030 East Cornwallis) and it may be sold in the next 60 days. Thus GSK will shortly notify DWQ of an expected change to the site boundary, per E.5 of our permit. I'll provide a revised figure for the site boundaries — please let me know if I need to provide any add itional,information or take additional action for this. We have not had any industrial activities on the Main Complex that required stormwater permitting. We do not plan to transfer the permit to a new owner. The North Complex, while for sale, is still owned and operated by GSK. We currently have two RCRA hazardous waste storage pads on the North Complex that we believe meet the definition of 'industrial activity' and have been managed accordingly. We have notified NCDENR Division of Waste Management, Hazardous Waste Section of our intent to begin closure of these pads in the near future, with all staff relocated from the property and hazardous waste storage at these locations ending by the end of 2011. This is what has prompted our June 9, 2011 request to excise the stormwater permit. However, some additional site activities at the North Complex will necessitate establishing up to two 90-day RCRA hazardous waste storage areas on the property_ One will support a groundwater remediation construction project expected to commence this month and last until spring 2012; a second may be set up to support laboratory decommissioning and decontamination in a building scheduled for demolition in 2012; this effort may extend until fall 2012. Based on these anticipated activities, GSK is requesting postponement of our request to excise the stormwater permit until a later date in 2012, to be better determined in the future.
