Dear Ms.Walata:
On December 5, 2014 the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG060107. In accordance with your request,
Certificate of Coverage Number NCG060107 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stormwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

® Other: GSK pharmaceutical activities ceased at the site in December 2011 all GSK staff were relocated from the site at this
time and the majority of buildings subsequently demolished. GSK conducted sail excavation remediation at the site under the direction
of NCDENR.DWM Hazardous Waste Section and.EPA Region 4. In support of this work, a 90-day RCRA storage area was established
in the event that hazardous waste was generated during the excavation. The excavation was completed in. September 2014 and the
90-day area closed. Thus industrial activities have ceased

Based on emails below, subsequent to the June 2011 request to rescind, she changed her mind, and despite
contacting us (DP or KBP or both), we didn't react as intended.
So, it looks like she sent in paper in June 2011 requesting rescission, and then verbally requested that we not rescind. If
that verbal or email request came to me, I should have made a paper copy and put it in the file to prevent just this sort
of result. Looks like that didn't happen. Looks like a disconnect between initial written instructions, and subsequent
verbal instructions or perhaps lack of my follow through with an email communication.
i'II chat with Brian (he handles our rescissions) to see what makes the most sense in rectifying. Don't reply to Ms W,
yet. I'll get back to you. I'm not sure BIMS will allow us to 'unrescind' a permit.

I hope you are doing well. Per our discussions in October of last year, GSK is vacating one of its properties; staff have
been relocated and demolition%remediation activities are underway. In June 20111 had requested rescission of our
stormwater permit NCG060107; however, after planning for site demolition and remediation activities became more
detailed, it became apparent that GSK would need to establish a 90-day hazardous waste area on the property to
manage potentially hazardous wastes generated during 2012 activities. Thus, in October 2011 we agreed to leave the
permit in place until GSK identified a more accurate date for permit rescission, as noted in the emails below.
Today I received a Feb. 9, 2012 letter (attached) which rescinded the permit. I also received a 2012 invoice for the
permit, which I've also attached. Can you please provide an appropriate direction for GSK in order to remain compliant
with NCDENR stormwater requirements? Our site activities are ongoing, and we expect to need a 90-day storage area
until probably third quarter 2012. In regard to this activity, waste containers are kept closed, stored on pallets,
inspected frequently in order to minimize any potential environmental concerns, and transported offsite for disposal on
a routine basis. I've submitted an internal request for invoice payment as well.
I'd appreciate any assistance and direction you can provide.

Hi Dave,
Per our discussion earlier today, I'm requesting that NCDENR postpone excision of GSK's stormwater permit NCG06017
until a later date in 2012. However, after we spoke I realized that we also will need to request modification to limit the
property to which the permit applies.
The permit is issued for GSK's South Campus, located at 3030 East Cornwallis Drive (i.e., the South Campus Main
Complex); the campus also includes GSK property at 3025 East Cornwallis Drive (i.e., the South Campus, North Complex),
across the street, and this property is included in the South Campus permit as well.
As part of GSK's footprint reduction project in RTP, the South Campus is being vacated and all of the property has been
offered for sale, both as one unit and as individual tracts. It appears that GSK has a prospective buyer for the Main
Complex (i.e., the tract at 3030 East Cornwallis) and it may be sold in the next 60 days. Thus GSK will shortly notify DWQ
of an expected change to the site boundary, per E.5 of our permit. I'll provide a revised figure for the site boundaries —
please let me know if I need to provide any additional information or take additional action for this. We have not had
any industrial activities on the Main Complex that required stormwater permitting. We do not plan to transfer the
permit to a new owner.
The North Complex, while for sale, is still owned and operated by GSK. We currently have two RCRA hazardous waste
storage pads on the North Complex that we believe meet the definition of 'industrial activity' and have been managed
accordingly. We have notified NCDENR Division of Waste Management, Hazardous Waste Section of our intent to begin
closure of these pads in the near future, with all staff relocated from the property and hazardous waste storage at these
locations ending by the end of 2011. This is what has prompted our June 9, 2011 request to excise the stormwater
permit.
However, some additional site activities at the North Complex will necessitate establishing up to two 90-day RCRA
hazardous waste storage areas on the property_ One will support a groundwater remediation construction project
expected to commence this month and last until spring 2012; a second may be set up to support laboratory
decommissioning and decontamination in a building scheduled for demolition in 2012; this effort may extend until fall
2012. Based on these anticipated activities, GSK is requesting postponement of our request to excise the stormwater
permit until a later date in 2012, to be better determined in the future.

Certificate of Coverage Number NCG060107. In accordance with your request, Certificate of Coverage
Number NCG060107 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Dear Mr. Patterson:
During a recent stormwater inspection by Mr. Mack Wiggins of DWQ, we were unable to locate a copy
of correspondence requesting that our South Campus outfall 001 be given representative status with
regard to stormwater quality and sampling requirements. GlaxoSmithKline is in the process of closing
our South Campus; staff have been relocated from the properties, which are for sale; and we are
finalizing plans for demolition of some of the existing structures. I believe that we may have temporarily
mis-filed correspondence that requested/approved outfall 001 as representative of during recent staff
and documentation relocations. We expect to cease operations at the South Campus sometime in 2012,
and will contact the DWQ Stormwater Permitting Unit in advance to request rescission of our permit,
when we can better identify the appropriate time for this.
In order to ensure that we are consistent and compliant with DWQ requirements, I'm requesting DWQ
approval to consider outfall 001 as our representative outfall for the South Campus. This is the only
outfali that could potentially receive impact from industrial activities at the South campus, as it is
topographically downgradient of hazardous waste storage facilities, which represent the only industrial
activities at the South Campus. These storage facilities are constructed and operated to minimize the
potential for such a release, and none have occurred. The remaining South Campus outfalls are not
associated with any industrial activities.

Mack Wiggins of the North Carolina Division of. Water Quality, Surface Water Protection Section,
Raleigh Regional Office, conducted a stormwater compliance evaluation inspection of the Glaxosmith
kline Facilities at 3030 and 3029 Cornwallis Road in Durham, on October 17, 2011. Your assistance
and the assistance of Mr. Norm Anderson of Clean Harbors were very helpful and appreciated during
the inspection process.
The following observations were made during the stormwater inspection:
Glaxosmithkline facility primarily engages in the manufacturing of prescription medicines
and healthcare products. Glaxosmithkline has two adjacent campus sites under stormwater
Certificate of Coverage NCG060107. The sites are 3029 and 3030 Cornwallis Road,
Durham. This site does not do any vehicle maintenance and does not use more than 55
gallons of new motor oil when averaged over a calendar year. At the, time of the inspection,
95% of the staff from both sites had been relocated to the 5 Moor Drive campus. By the end
of November, 2011 100% of staff will have been relocated form 3029 and 3030 Cornwallis
Road to the 5 Moore Drive campus in Durham.
2. The two adjacent Glaxosmithkline locations (3029 &3030 Cornwallis Road) combined has
27 stormwater outfalls.
3. Glaxosmithkline 3029 Cornwallis Road site has 12 outfalls. Stormwater outfalls 001,
002,004 and 012 receives stormwater from the incinerator area, parking area and warehouse
B area. Outfall 001 is representative of all other outfalls from both sides at the time of the
inspection. Stormwater outfalls 011, 003 receives stormwater from the boiler room and
energy center area. Stormwater outfall 005 received stormwater from the parking and energy
center area. Stormwater outfall 006 received stormwater from the campus and road area.
Stormwater outfall 007 received stormwater from the parking and neutralization area.
Stormwater outfal1010 received stormwater from the parking, warehouse C, road and tennis
court area. Stormwater outfall 009 received stormwater from the parking area. Stormwater
outfall 008 received stormwater from the cafeteria area.

4. Glaxosmithkline 3030 Cornwallis Road (Main campus) has 15 stormwater outfalls. This
facility is 98 % vacant. This property is scheduled to be sold by end of 2011. The new
owners may demolish the site. No pharmaceutical and manufacturing processes was going
on at this site location at the time of the inspection. Stormwater outfall 014 received
stormwater from the parking area, main research and main administrative building area.
Stormwater outfall 015 received stormwater from the parking area. Stormwater outfalls 028,
027,026 received stormwater from the parking area and front campus area. Stormwater
outfall 025 received stormwater from the west parking lot area and campus area. Stormwater
outfall 022 received stormwater from the road and generator area. Stormwater outfalls 023,
021 and 024 received stormwater from the campus area and west parking lot area.
Stormwater outfalls 016, 017 and 019 received stormwater from the above ground storage
tank area. Stormwater outfalls 018 and 013 received stormwater from the parking areas. The
abandoned Hibernation building on this side has six stormwater outfalls that discharges to a
man-made pond.
5. The BMPs. to be used at the Glaxosmithkline facility are Procedural management and
vegetative swales.
6. All chemicals and hazardous materials currently on the site are secondary contained. The
3029 site currently is in the process of removing a pod which stores hazardous chemicals to
another Glaxosmithkline site. This site has secondary containment and no exposure to
stormwater. The same identical pod set-up will be at the 5 Moore Drive site.
7. Clean Harbors does the sampling, stormwater inspections and stormwater plan
implementation.
8. All monitoring is performed as required by NCG06000. Qualitative monitoring was
performed at all outfalls. Qualitative and analytical monitoring was performed at the
representative outfall. The facility did not have documentation of representative outfall status
for outfall 001. Glaxosmithkline is required to show documentation of representative outfall
status for outfall 001 or apply for representative outfall status for outfall 001. To apply

9. The Stormwater Pollution Prevention Plan contained all items as required by General Permit
NCG080000 with the exception of the feasibility study. Please address Part 11, Section A, 2
(a) Feasibility study in your plan.
10. The plan has been implemented and is updated once a year.

Per our discussion earlier today, I'm requesting that NCDENR postpone excision of GSK's stormwater permit NCG06017
until a later date in 2012. However, after we spoke I realized that we also will need to request modification to limit the
property to which the permit applies.
The permit is issued for GSK's South Campus, located at 3030 East Cornwallis Drive (i.e., the South Campus Main
Complex); the campus also includes GSK property at 3025 East Cornwallis Drive (i.e., the South Campus, North Complex),
across the street, and this property is included in the South Campus permit as well.
As part of GSK's footprint reduction project in RTP, the South Campus is being vacated and all of the property has been
offered for sale, both as one unit and as individual tracts. It appears that GSK has a prospective buyer for the Main
Complex (i.e., the tract at 3030 East Cornwallis) and it may be sold in the next 60 days. Thus GSK will shortly notify DWQ
of an expected change to the site boundary, per E.5 of our permit. I'll provide a revised figure for the site boundaries —
please let me know if I need to provide any additional information or take additional action for this. We have not had
any industrial activities on the Main Complex that required stormwater permitting. We do not plan to transfer the
permit to a new owner.
The North Complex, while for sale, is still owned and operated by GSK. We currently have two RCRA hazardous waste
storage pads on the North Complex that we believe meet the definition of 'industrial activity' and have been managed
accordingly. We have notified NCDENR Division of Waste Management, Hazardous Waste Section of our intent to begin
closure of these pads in the near future, with all staff relocated from the property and hazardous waste storage at these
locations ending by the end of 2011. This is what has prompted our June 9, 2011 request to excise the stormwater
permit.
However, some additional site activities at the North Complex will necessitate establishing up to two 90-day RCRA
hazardous waste storage areas on the property. One will support a groundwater remediation construction project
expected to commence this month and last until spring 2012; a second may be set up to support laboratory
decommissioning and decontamination in a building scheduled for demolition in 2012; this effort may extend until fall
2012. Based on these anticipated activities, GSK is requesting postponement of our request to excise the stormwater
permit until a later date in 2012, to be better determined in the future.

Your facility is currently covered for stormwater discharge under General Permit NCG060000. This pert -nit expires
on August 31, 2002. ,The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger

without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and

facilities in any of the 1 I categories of "storm water discharges associated with industrial activity," (except

In accordance with your request received May 4, 2001, the Division is forwarding the subject permit modification.'
This modification documents the change in name at the subject facility. All other terms and conditions in the original permit
remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection
Agency dated December 6, 1983,
If any parts, measurement frequencies or sampling requirements contained in this permit modification are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General
Statutes, filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 2761 1-7447.
Unless such demand is made, this decision shall be final and binding.
This permit does not affect the legal requirement to obtain other permits which may be required by the Division of
Water Quality, the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local government

This annual fee is required by the North Carolina Administrative Code. It covers the administrative costs associated
with your permit. It is required of any person hdding a permit for any time during the annual fee period, regardless of
the facility's operating status. Failure to pay the fee by the due date will subject the permit to revocation. Operating
without a valid permit is a violation and is subject to a $10,000 per day fine. If the permit is revoked and you later
decide a permit is needed, you must reapply, with the understanding the permit request may be denied due to changes
in environmental, regulatory, or modeling conditions.

Subject: request to postpone excision of GlaxoSmithKline Stormwater permit
Hi Dave,
Per our discussion earlier today, I'm requesting that NCDENR postpone excision of GSK's stormwater permit NCG06017
until a later date in 2012. However, after we spoke i realized that we also will need to request modification to limit the
property to which the permit applies.
The permit is issued for GSK's South Campus, located at 3030 East Cornwallis Drive (i.e., the South Campus Main
Complex); the campus also includes GSK property at 3025 East Cornwallis Drive (i.e., the South Campus, North Complex),
across the street, and this property is included in the South Campus permit as well.
As part of GSK's footprint reduction project in RTP, the South Campus is being vacated and all of the property has been
offered for sale, both as one unit and as individual tracts. It appears that GSK has a prospective buyer for the Main
Complex (i.e., the tract at 3030 East Cornwallis) and it may be sold in the next 60 days. Thus GSK will shortly notify DWQ
of an expected change to the site boundary, per E.5 of our permit. I'll provide a revised figure for the site boundaries —
please let me know if I need to provide any add itional,information or take additional action for this. We have not had
any industrial activities on the Main Complex that required stormwater permitting. We do not plan to transfer the
permit to a new owner.
The North Complex, while for sale, is still owned and operated by GSK. We currently have two RCRA hazardous waste
storage pads on the North Complex that we believe meet the definition of 'industrial activity' and have been managed
accordingly. We have notified NCDENR Division of Waste Management, Hazardous Waste Section of our intent to begin
closure of these pads in the near future, with all staff relocated from the property and hazardous waste storage at these
locations ending by the end of 2011. This is what has prompted our June 9, 2011 request to excise the stormwater
permit.
However, some additional site activities at the North Complex will necessitate establishing up to two 90-day RCRA
hazardous waste storage areas on the property_ One will support a groundwater remediation construction project
expected to commence this month and last until spring 2012; a second may be set up to support laboratory
decommissioning and decontamination in a building scheduled for demolition in 2012; this effort may extend until fall
2012. Based on these anticipated activities, GSK is requesting postponement of our request to excise the stormwater
permit until a later date in 2012, to be better determined in the future.
