We offer this letter to satisfy our written reporting obligations under NPDES General Permit No. NCG060000. This letter contains details about the incident that reflect the most current information available to us. We will continue to provide updates to you as our investigation continues and as we gather new or different information. The spill was also reported to the NRC (4 Ll 192657) on October 81h at 3.34,PM. 1. Description oflncident and Cause On Sunday October 81h at 1:05 PM, approximately 400 gallons of used oil was pumped out of the secondary spill containment structure around a used oil tank to the adjacent ground. The spill was a result of inadvertently leaving an energized sump pump with a built-in float switch in the secondary spill containment structure. When a rain event occurred in combination with an active leak inside the containment structure, it raised the liquid level to the point where it activated the sump pump and pumped the oil to the adjacent ground and proceeded to sheet flow to an adjacent storm water detention pond on our property. The storm water pond discharges to an unnamed tributary of the Black River. Under normal conditions, the pump would have not been in the containment area. Period of Potential Noncompliance Telephone (910) 567-5604 Fax (910) 567-5241 Immediately following the discovery of the spill, site personnel constructed earthen dams, plugged outfalls and used absorbents to contain the spill. JGH Industrial Services was also called to assist in spill containment and to remediate the spill. JGH deployed additional oil pads and booms in the creek and used a VAC truck to begin recovering free product from the storm water pond and creek. The contaminated soils were removed and put on plastic sheets for disposal. The storm water pond and creek are currently dammed up and cleanup activities are ongoing and nearly complete. 3. Steps Taken To Reduce, Eliminate and Prevent Reoccurrence As a result of this spill, a Standard Operating procedure for managing liquid in the secondary spill containment structure has been developed which mandates that pumps will only be placed in spill containment areas during planned secondary. containment pump out operations and these pump out operations will only be completed with constant human supervision. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG060000 under Certificate of Coverage NCG060100. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as South River, a Class C;Sw water in the Cape Fear River Basin. As a result of the site inspection, the following deficiencies are noted: 1) Stormwater Pollution Prevention Plan (SPPP) Although a Stormwater Pollution Prevention Plan (SPPP) has been developed for the facility, it was found to be incomplete and outdated and not properly implemented. 2) Qualitative Monitoring Qualitative monitoring has not been conducted and recorded in accordance with permit requirements. Other Observations: Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Requested Response: You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your written response should include a reasonable explanation as to why the aforementioned deficiencies have occurred as well as a Plan of Action to prevent these deficiencies from recurring. Facility's SPPP was last revised in 2011 and is missing several required components such as a Feasibility Study, BMP Summary, Spill Prevention & Response Plan as well as the documentation of an annual review/update, which should include all items listed under Part II, Section A, item 8 of the permit. According to Mr. Bullard, facility operations changed in 2014 when ownership changed from Martin's Abattoir and Wholesale Meats, Inc. to Kansas City Sausage Company, LLC dba Coastal Protein. Since 2014, the facility no longer processes meat and the processing plant has recently been demolished with plans to rebuild on hold. Current operations, since 2014, consist solely of rendering animal by-products from other processing plants as animal feed. This change in operation removes the requirement to monitor for fecal coliform as noted in Footnote 4 under Table 1 Analytical Monitoring Requirements found under Part 11, Section B of the permit. However, this change triggers the requirement of an Assessment of Best Management Practices (BMPs), which is detailed under Part 11. Section E of the permit. Analytical monitoring records from the second half of 2014, first and second half of 2015, and first half of 2016 were reviewed and showed one exceedance of the benchmark value for COD at outfall 2 for the 2014 sampling event. Qualitative (visual) monitoring records from second half 2014 and first Half 2015 were reviewed, but there were no records available for second half 2015 or first half 2016. After the records review, observations of site conditions were made including portions of the stormwater collection system, secondary containment structure, loading/off-loading areas and the facility's two stormwater outfall locations. The management team at Coastal Protein has reviewed the deficiencies and has developed a plan to resolve the issues documented during the site inspection. As noted in the site inspection notes during the visit on 8-25-16 there was an ownership change in 2014. After that change work began on the demolition of the old beef plant and preparation to design build a new processing facility on the site. A new storm water system and plan would have been part of that design. In November of 2015 the project got put on hold and all plans were discontinued. Employees at the Godwin site continued to monitor the parameters of the permit but did neglect to document the visual results of the monitoring in the first half of 2016. After reviewing the site and permit with Mr. Lawyer I now have a much better understanding of the requirements of the permit and will ensure that we work to maintain compliance. We have addressed the specific deficiencies as follows: 1. Stormwater Pollution Prevention Plan (SPPP) — Coastal Protein has contracted Gannett Fleming Engineers and Architects. KC to develop a new Stormwater pollution prevention plan specific for the current site and train the employees at the site in Godwin to implement the new programs. Gannett Fleming is already under contract and is currently gathering the information needed to develop the plans and programs. They estimate the new programs to be in place by January 1, 2017. 2. Qualitative Monitoring — After the site review with Mr. Lawyer I have trained additional personnel at the site to collect the monitoring samples to ensure the proper documentation is completed. Coastal Protein places the utmost importance on environmental standards at our facility. We will continue our efforts to improve our facility and our environmental impact. Excluded Assets. Excluded Liabilities. This Agreement may be executed in one or more counterparts, each of which shall be deemed to be an original but all of which shall constitute one and the same instrument. 9. Modification and Waiver. None of the provisions of this Agreement may be waived, changed or altered except in a writing executed by each of the parties hereto. 10. Governing Law. The initial purpose of the site visit was to perform an inspection to ensure compliance with the conditions of NPDES Stormwater General Permit NCG060000. However, it was determined during the file review prior to the site visit that permit coverage was not renewed during the 2002-2007 permit cycle nor has it been renewed for the current 2007-2012 permit cycle. Based on this information, you are receiving this Notice of Violation (NOV) for discharging stonnwater from your facility without coverage under a valid NPDES Stormwater General Permit. Please refer to § 143-215.1(a)(1 1) of the North Carolina General Statutes, which states in part: "(a) Activities for Which Permits Required. -No person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in the permit:", "(11) Cause or permit discharges regulated under G.S 143-214.7 that result in water pollution." General Statute 143-214.' is entitled "Stormwater runoff rules and programs." and encompasses the program by which the Stornnvater General Permits for industrial activities are governed. Due to the lack of permit coverage at the time of the April 23rd site visit, a compliance evaluation could not be conducted and instead Mr. Lawyer conducted a tour of the facility property to determine the need for renewed coverage under the NCG060000 permit. During this tour, Mr. Lawyer explained the conditions of the current general permit including the appropriate Qualitative and Analytical Monitoring requirements at each of the facility's stormwater outfalls. Upon returning to the office, Mr. Lawyer relayed the information regarding the lack of permit coverage to personnel of the Division's Stormwater Permitting Unit in Raleigh and an e-mail with an attached renewal form was sent to Ms. Angie Martin of your staff for subsequent completion and submittal to obtain valid permit coverage.
