Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C. Discharge of Stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $25,000 per day. "No exposure exclusion" is now available to industrial facilities in any of the categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of ..no exposure", i.e. the facility industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. J11' 1 5 208 In your letter we were asked to respond to your office, in writing, within 30 calendar days with a description of our Plan of Action (POA) to address the issues and deficiencies that were discovered during the inspection, and a time -frame as to when we expect to have all the corrective actions completed. Our Plan of Action to address the issues/deficiencies that you identified and a time -frame by which we hope to complete this work are as follows: Analy!ical monitoring - We have made arrangements with ENCO Laboratory in Cary, NC to have them perform the required analytical tests. ENCO Laboratory has provided all necessary materials to collect and deliver the samples and we have these materials at our plant. We plan to collect these samples as soon as we have a rainfall event meeting the requirements of the permit. Gas tank with earthen berm and bottom - It is our intention to replace this tank with a 500 gallon tank, which will have no containment requirement, within the next 90 days. Diesel tank with concrete wall but an earthen bottom - The tank is now full of diesel fuel. We will pull out the tank and pour a concrete bottom as soon as we use -up enough fuel to be able to safely move the tank This will likely be sometime in December of this year. Corn syrup tank has no secondary containment - Any containment wall built around this tank will have to be fairly large to match the capacity of the tank, and designed to allow for personnel to have access to the filler ports, flow valves and controls associated with the tank's regular use. Due to the tank's location, there is a possibility that building a containment wall around it could block access to a loading dock that is located to the side of and just past the tank. We are considering the possibility of just relocating this syrup tank into some area where any spills or leaks would be contained within our factory's wastewater system. If we decide to move this tank, we will need to remove most of the corn syrup currently in the tank, and, most practically, that would mean a time -frame to complete this job near mid -December, 2008. We are still considering alternate solutions. This deficiency will be corrected as soon as possible. Boiler blowdown into stormwater drain - This will be changed so that the boiler water blowdown discharges into our factory's wastewater system. This will be completed no later than August 30, 2008. Please let us know if we need to reconsider an alternate Plan of Action to correct any of the deficiencies you identified during your inspection. A copy of the Compliance Inspection Report is attached for your review. Along with yourself, Mr. Dave Adkins, Quality Assurance Director, was also present during the inspection and both yours and his time and assistance is greatly appreciated. Stormwater from this facility drains to an unnamed tributary to Black River, a Class C,Sw water located in the Cape Fear River Basin. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG060089. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. That said; please see the above -mentioned ,veb site in order to obtain a copy of the permit such that you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, constitutes violations and is subject civil penalty assessment of up to S25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permtttee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point source discharge to surface water of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization or approval. • There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the permits have following condition requirements (you must read your entire permit to ensure full compliance): o Development and compliance with the Stormwater Pollution Prevention Plan o Collection, repotting, and recording of Analytical Monitoring o Collection and recording of Qualitative Monitoring o Collection, reporting and recording of Vehicle Maintenance Monitoring o Records — Visual monitoring shall be documented and records maintained at the facility along xvith the Stonnwater Pollution Prevention Plan. Copies of the analytical monitoring results shall also be maintained on -site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of least 5 years for the date of the sample measurement, report or application. o Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permlace shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to expiration date. A tour of the facility was conducted where an evaluation was made of the outfalls identified by facility personnel as well as observations of exposure areas and the facility's above -ground storage tanks (ASTs). Please refer to the comments under the Permit and Outfalls section of the inspection checklist for determinations made regarding outfalls. During the tour, it was noticed that the facility's above -ground gasoline tank has secondary containment, but consists of an earthen berm and bottom. Also, the facility's above -ground diesel tank has a concrete wall, but an earthen bottom. Facility personnel were advised of the current recommendation for secondary containment to consist of poured concrete walls and floor. The capacity of the gasoline tank is currently 1000 gallons, however Mr. Austin suggested that the company may replace it with a 500 gallon tank, which would then not require secondary containment. In observing one of the storm drains on the property, it was seen that a pipe entered the drain that according to Mr. Austin carried boiler blowdown water, This facility does not have coverage under the NCG500000 general wastewater permit for such a discharge and therefore the discharge should either be eliminated or permit coverage obtained. After touring the grounds of the facility with Mr. Austin and Mr. Adkins, a review of the facility's Stormwater Pollution Prevention Plan (SPPP) and monitoring records was conducted with the assistance of Mr. Adkins. The current SPPP appeared to be well organized and contain all permit -required components from the previous permit cycle. According to Mr. Adkins, the SPPP is in the process of being updated by an engineer to comply with the conditions of the recently renewed general permit in which some changes were made concerning monitoring frequency. Records of Qualitative Monitoring were reviewed, however Analytical Monitoring records were not available as explained in the comments under the Analytical Monitoring section of the inspection checklist. Facility personnel are to begin conducting Analytical Monitoring per the schedule in the current general permit. It was also discussed during the SPPP review that the facility has an AST of corn syrup that is without secondary containment. This needs to be addressed as soon as possible.
