Less than 1 gallon of the spill conveyed across the parking lot and reached the stormwater drain on the east side of the facility that is on property. A section of the stormwater creek downstream of the spill was diked off and the contaminated water was pumped out and transferred back into the facility wastewater drain system. Other affected areas were cleaned up using pumps and pigmat absorbents. The location contacted the emergency response number listed on the facilities stormwater permit. As a result, the incident was reported to the North Carolina Department of Environmental Quality. Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. The assistance of yourself and Mike Perry, EMS/PSM Coordinator was appreciated as it facilitated the inspection process. The following observations were made: Tyson Foods, Inc is authorized to discharge stormwater from the facility located at Tyson Foods, Inc., 800 East Main Street, Sanford in Lee County. The permit expires October 31, 2012. The facility discharges into the receiving waters designated as unnamed tributary to Carrs Creek, waters in the Cape Fear River Basin. 1. Our review of,your Stormwater Pollution Prevention Plan Manual (SP3) revealed the following: • The Plan contained a general location map that included outfall locations and drainage areas. However it is suggested to obtain or create a map with legible marking. It was extremely difficult to see the locations of the outfalls due to the color of the ink being yellow and illegible. • Employee training documented were updated annually. It was indicated that only a select amount of employee were trained with spill response. We highly recommend that all employees receive spill response training. • List of responsible parties for Emergency spill response notification. • No spills were noted for the 3 year period, suggestion to add documentation to indicate any spill activity. If none, state that once annually and add it to the manual. 2. Outfalls # 1 was observed to contain slight grease at sampling point, please clean out grease and properly dispose of same. Trim vegetative growth near outfall to enhance future inspections and allow for easier sampling. 3. Outfall # 2 was observed no flow was observed. 4. Outfail # 3 had heavy vegetative growth making it extremely difficult to access outfall for inspection. Maintain area clear of vegetative growth. Suggestions to add signage designating outfalls on fence to assist personnel not aware of locations to aid spill response activities. The Division does not have any documentation indicating this. It is noted that Outfall #3 does not meet the qualifications for representative sampling and must be sampled along with the other stated outfalls. 7. Review of analytical data revealed Total Settleable Solids (TSS) over benchmark for Outfall (2) on December 2009. Results from July 2010 indicate that Chemical Oxygen Demand (COD) for Outfall (1) was over benchmark. Please conduct a Tier 1 or Tier 2 investigation to determine the cause of the reading to be out of range. These investigations must be documented and added to the SP3 (Stormwater Pollution Prevention Plan manual.) 8. Qualitative sampling must conducted two (2) times a year, inspection indicated sampling has been annually. 9. Attached to the report is the Stormwater Discharge Outfall (SDO) Qualitative Monitoring Report form. Complete this report and add it to your SP3 manual. This permit expires on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2(X)2. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued coverage under the gencral permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal lcoislation has extended the "no exposure exclusion" to all operators of industrial facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial materials and operations are not exposed to stormwater, you can apply fix the no exposure exclusion. The driver tried to reconnect cap as quickly as possible. The event led to spilling approximately 30 gallons onto concrete area. Nearby storm drain was not adequately covered to prevent release to the nearby stream. An estimated 10 gallons entered into the storm drain.
