This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG030000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. The more significant changes in the General Permit since your last COC was issued are noted either in the Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.ort,/web/wq/ws/su/current- notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are posted on the Stormwater Permitting Unit's website with the new General Permit. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections 8, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections e, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections e, C: The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. Some elements of the plan are present at the facility, but a formal plan has not yet been documented nor implemented. However, the facility has built BMP's to treat stormwater runoff taht were operational the day of the inspection. The facility plans to start the inspections as required. The option of submitting TTO solvent management plan was discussed and remains an option, as the site has minimal opportunity for solvent spills to reach surface waters. The highest risk is the area of the wastewater treatment package plant which does have secondary containment and is located inside the buidling. This wastewater goes to the City of Mebane. Production of condensors is assembly and clean only, with most products held in warehouse except during loading for shipping. The other area of risk observed was stormwater drain by the covered metal shavings container. Special attention in preventative measures and training should be given to both of these areas ie. storm drain covers and adequate emergency response procedures. Outfall 002 is a rip -rap outlet for roof drainage and some street drainage. The outfalls are newly constructed and in good condition. A plumbing shop is located next door and also drains to outfall 002. This shop has old metal plumbing stacked at the corner of the lot, most of which is stored in trash containers, but the permittee needs to consider this as a possible source of metals if sampling at outfall 002 shows cause for concern with regards to water quality. A complaint can also be filed for the plumbing company, if their property runoff contributes to a water quality concern with regards to AKG's NCG03 permit. Forty-six types of metal finishing operations are listed, appearing to be a comprehensive list of the types of activities that might be labeled, metal finishing.' a. Subpart A presents wastewater and pretreatment effluent limitations in 433.13, 433.14, 433.15, 433.16, and 433.17 for BPT, BAT, PSES, NSPS, and PSNS respectively. These paragraphs uniformly present a TTO effluent limitation of 2.13 mg/L maximum for any one day. No monthly average effluent limitation is established. b. TTO for the metal finishing category includes 111 toxic organics, including solvents, chlorinated hydrocarbons, pesticides, PCBs, and dioxin. The reportable value for the TTO analysis is the sum of all concentrations for the 111 analytes greater than 0.01 mg/L. c. Paragraph 433.12(a) provides that in lieu of TTO monitoring the permitting authority may allow the permittee to certify on each DMR that there has been no dumping of concentrated TTO into the wastewater stream. d. Further, 433.12(a) provides that if TTO monitoring is required, the permittee may 'analyze for only those pollutants that would reasonably be expected to be present.' e. Paragraph 433.12(b) provides that if the permittee selects the certification alternative to TTO monitoring, he must submit a solvent management plan to the permitting authority's satisfaction, and that the plan shall be incorporated as a part of the permit. 2. As an aside on the TTO benchmark question, note that 40CFR433 provides for effluent or pretreatment limitations on seven metals and cyanide. Of these eight parameters, NCG03 requires testing only for Pb (not one of the seven listed metals.) 3. DWQ has established stormwater benchmark values for sixteen of the 111 toxic organics: benchmark values of 0 ug/L for dioxin and for the 7 PCBs; anthracene - 0.005 mg/L; pentachlorophenol - 0.019 mg/L; toluene - 0.055 mg/L and 0.0018 mg/L in trout waters; 1.0 mg/L for 2,4-dimethyl phenol and for naphthalene; acrylonitrile - 3.8 mg/L; phenol - 4.5 mg/L in trout waters; and benzene - 6.7 mg/L. 4. The current draft permit provides as follows: a. The permittee may elect to develop a solvent management plan and incorporate it in his SPPP. All in imitation of the federal effluent guidelines for wastewater and pretreatment discharges. Consistent with the previous version of the permit. b. DWQ is willing to work with the permittee on alternate analyses to satisfy the TTO monitoring requirement. This provision is parallel to, but not identical to, the federal provision establishing that wastewater permittees need only analyze for the pollutants reasonably expected to be present. c. The benchmark is set at 1.0 mg/L. This is not a limit value in the sense of an exceedence constituting a permit violation. This is more like an action level value. DWQ has benchmark values set for only a very small portion of the TTO suite. A value of 1.0 mg/L corresponds to our benchmarks for naphthalene and 2,4- dimethylphenol. Three benchmark values are above 1.0 mg/L, and 11 benchmark values are below 1.0 mg/L.
