On April 25, 2014, a site inspection was conducted for the Miller Control and .Manufacturing Co., Inc. facility
located at 1006 Southwest Blvd in Sampson County, North Carolina. A copy of the -Compliance Inspection
Report is enclosed for your review. Mr. Wayne Naylor, Vice President and General Manager, was also
present during the inspection and his time and assistance is greatly appreciated. Permit coverage authorizes
the discharge of stormwater from the facility to receiving waters designated as Rowans Branch (Chestnut
Pond), a Class C;Sw waterbody in the.Cape Fear River. Basin, The site visit and file review revealed that the
subject facility. is covered by NPDES Stormwater General Permit-NCG030000, Certificate of Coverage-
NCG030373.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG030000
permit. Please refer to the enclosed Compliance Inspection Report for additional comments and
observations. made during the inspection.
Please,be advised that violations of the NPDES Stormwater•General Permit are subject,to.a civil

exceedances of the benchmark values for zinc and copper, which were added to the parameter -list during the. mostrecent
permit renewal. Reviewed facility's,Stormwater Pollution Prevention Plan (SWPPP) and monitoring records, As noted in
the previous inspection report, a d")tailed site map and documentation of an annual review/update needed tc be added to
the facility's SWPPP; which.has been done. Mr. ,Naylor is maintaining excellent records of employee'training.and -
housekeeping along. with documentation of site observations. Monitoring has been conducted and recorded per the
conditions of the.NCG030000 General Permit. There..have been no benchmark value exceedances.with the eicception of
one exceedance For copper and two exceedances for zinc'at the facility's single outfall. In responseto these
exceedances, Mr. -Naylor has been diligent about finding potential sources of copper and zinc related to, facility. ;operations
and has removed or otherwise relocated material that was exposed to stormwater. Other potential sources:such as the
various metal. buildings.within and.adjacent to the site and zinc containing roof coating for rust prevention cannot be'
reasonably addressed. Based on these site conditions and the aforementioned efforts"made by Mr. Naylor, the;facilitywill,
be excused from the .Tier Two monthly monitoring condition for any further exceedances of copper or zinc for the
remainder of the permit term unless site conditions change. A separate letter detailing this exclusion will be sent along
with the compliance inspection report to'be added to the facility's SWPPP.

In response to discussions with Mr. Wayne Naylor, Vice President and General Manager, concerning one
exceedance of the benchmark value for copper and two consecutive exceedances of the benchmark value
for zinc at the subject facility, NCDENR-land Quality Section staff conducted a site inspection on April 25,
2014. The inspection was conducted to determine compliance with the conditions of the NCO030000
General Permit and to discuss any actions that.have been or could be taken to identify and -eliminate
potential sources -of copper and zinc related to facility operations.
Please keep in mind that benchmark exceedances are NOT limit violations or.violations of permit conditions;
however,.you are obligated to foliow the tiered response actions outlined in your permit. At the.time of the
inspection, the facility was found to be incompliance with the tiered response actions and other conditions of
the NCG030000 General Permit. During the inspection, Mr. Naylor relayed that he had identified some .
galvanized materials (likely sources of zinc) that were used.in facility operations and exposed to stormwater,
which he subsequently removed.or relocated indoors. Other potential sources of zinc were identified such as
the numerous metal buildings that are located within and adjacent to.the site as well as a roof coating
containing zinc oxide, which had been previously applied to the roof of the main building to address rust. It
was determined during the inspection that these other potential sources are not directly related to facility
operations and cannot. be reasonably addressed.
Based on the aforementioned items, we are granting'regulatory. relief in. the form of a collapsed Tier 2 -Tier 3
response. Upon receipt of this letter, Miller Control and Manufacturing Co., Inc. may resume the permit
specified semi-annual analytical. monitoring for the remainder of the current permit term. Your current permit
is. set to expire on October 31, 2017. This decision applies only to the copper and zinc benchmarks. A
benchmark exceedance of any other parameter listed in your permit will trigger the tiered respohse
actions as described In the general permit.
You must notify this office, in writing, withinflve business days if you become.aware of any significant source
of copper or zinc at your facility that has the potential to be exposed to stormwater. The relief granted in this
letter . is contingent upon the current 'industrial practices at Miller Control and Manufacturing .Co., Inc. If
industrial practices change and copper or zinc does become a significant stormwaterexposure -risk then this
office reserves the right to withdraw this decision and reinstate the permit specified tiered response or other
actions that may be warranted,by the new set of circumstances.

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG03000O
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are

Some of the changes include:
• Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical Stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HOW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections 8, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal re nest prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Item 1—We understand that our Stormwater Pollution Plan (SWPPI') does not include a detailed
site map including the outfall location and drainage areas. Information to produce a
detailed site map is presently being collected and a drawing will be made to bring our
S WPPP in compliance.
Item 2—We understand qualitative monitoring is required at the time of analytical monitoring
and on the same schedule. We will designate and train a person to perform both these
tests semi-annually and to keep appropriate records.
Item 3—We will purchase an adequate PH meter and engage Microbac—Fayetteville Division —
to test our samples. We already have a rain gauge in place. We will record and
maintain records as required by our permit.
Item 4—Our plan will be reviewed and updated annually.
We will have our plan up and running in full compliance with the conditions of the NCG030000
general storm water permit within sixty days.

On July 28, 2011, Michael Lawyer from the Fayetteville Regional Office of the Division of Water
Quality conducted a site inspection for the Miller Control & Mfg. Co., Inc. facility located at 1008
Southwest Blvd., Clinton; Sampson County, North Carolina. A copy of the Compliance inspection
Report is enclosed for your review. Mr. Wayne Naylor, Vice President and General Manager, was also
present during the inspection and his time and assistance is greatly appreciated. Permit coverage
authorizes the discharge of Stormwater from the facility to receiving -,raters designated as a UT to
Rowan Branch, a Class C;Sw water in the Cape Fear River Basin. The site visit and file review revealed
that the subject facility is covered by NPDES Stormwater General Perm it-NCG030000, Certificate of
Coverage-NCG0303 73.

Inspection Summary:
Inspection conducted to ensure compliance with the conditions of the NCG030000 general stormwater permit. Met with
Mr. Wayne Naylor, Vice President and General Manager. Mr. Naylor expressed that facility operations have decreased
significantly over the years and there has been a drop in the number of employees. In trying to maintain the business,
permit conditions have been neglected and monitoring has not occurred. Facility does have a Stormwater Pollution
Prevention Plan (SWPPP), which was made available for review.and appeared to contain all required components with
the exception of a detailed site map. Mr. Naylor has recently reviewed the SWPPP and started to make revisions
regarding personnel changes and the loss of employees. Mr. Naylor was advised to generate and add a site map to the
SWPPP and make any additional necessary revisions to reflect facility operational changes. An annual review/update
should be conducted as listed in the permit. It was relayed to Mr. Naylor that failure to conduct monitoring as required by
the permit would result in the issuance of a Notice of Violation and continued non-compliance could result in the
assessment of civil penalties. Site observations were made of storage areas and outfall location. A containment structure
is provided for the storage of a catalyst used in the process of making fiberglass components. A spill kit including a large
receptacle, shovel, broom, absorbent pads and socks, gloves, etc. is available for use in the event of a spill.

This letter serves as a follow-up to the site visit conducted by rnyseli'on Wednesday, October 08,
2008. Coverage under Stonnwater General Permit NCG030000 is required for your facility based on the
Standard Industrial Classification (SIC) Code and having a point source discharge of stormwater
through a ditch, pipe, drain, etc. During the site visit, it was determined that your facility has one outfall
consisting of two perimeter ditches that converge at the southeast corner of the property and would
convey stop-riwater from the property to an unnamed tributary to Rowan Branch, a Class C.-Sw water in
the Cape Fear River Basin. Based on this information, I have enclosed a Renewal Application Form to
be completed and submitted to our Stor nwater Permitting Unit in Raleigh in order to renew permit
coverage that expired in 2002. Our office requests that you submit the Renewal Application Form
within 30 calendar days from receipt of this letter. Please be advised that operating your facility
without proper permit coverage could result in the issuance of a Notice of Violation as well as the
assessment of civil penalties of up to $25,000 per day, per violation.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
ht order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) Ibr renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit wilt be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per clay.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). Il' you feel your facility can certify a condition of "no exposure", i.e. the facilly industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment ol' at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent Icderal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of' "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations arc not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Stal'f mernber listed below or check the Stormwater & General
Permits Unit Web Site at http:llh2o.enr.state.nc.us/su/siormwater.html
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.

In response to your renewal application for continued coverage under the subject permit, the Division
of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215 .l and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
E Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
