Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Rowans Branch (Chestnut Pond), a Class C;Sw waterbody in the.Cape Fear River. Basin, The site visit and file review revealed that the subject facility. is covered by NPDES Stormwater General Permit-NCG030000, Certificate of Coverage- NCG030373. Dear Mr. Miller: In response to discussions with Mr. Wayne Naylor, Vice President and General Manager, concerning one exceedance of the benchmark value for copper and two consecutive exceedances of the benchmark value for zinc at the subject facility, NCDENR-land Quality Section staff conducted a site inspection on April 25, 2014. The inspection was conducted to determine compliance with the conditions of the NCO030000 General Permit and to discuss any actions that.have been or could be taken to identify and -eliminate potential sources -of copper and zinc related to facility operations. Please keep in mind that benchmark exceedances are NOT limit violations or.violations of permit conditions; however,.you are obligated to foliow the tiered response actions outlined in your permit. At the.time of the inspection, the facility was found to be incompliance with the tiered response actions and other conditions of the NCG030000 General Permit. During the inspection, Mr. Naylor relayed that he had identified some . galvanized materials (likely sources of zinc) that were used.in facility operations and exposed to stormwater, which he subsequently removed.or relocated indoors. Other potential sources of zinc were identified such as the numerous metal buildings that are located within and adjacent to.the site as well as a roof coating containing zinc oxide, which had been previously applied to the roof of the main building to address rust. It was determined during the inspection that these other potential sources are not directly related to facility operations and cannot. be reasonably addressed. Based on the aforementioned items, we are granting'regulatory. relief in. the form of a collapsed Tier 2 -Tier 3 response. Upon receipt of this letter, Miller Control and Manufacturing Co., Inc. may resume the permit specified semi-annual analytical. monitoring for the remainder of the current permit term. Your current permit is. set to expire on October 31, 2017. This decision applies only to the copper and zinc benchmarks. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG03000O • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances.
