Comment: This inspection was to assist the operation to better understand the permit's intent.
I met with Jeremv Tvree. Facilitv Manager for SIMS Metal Management (252) 633-0892 and
discussed my interpretation and expectations. I explained how to obtain stormwater grab_
samples so that their baseline can be evaluated.
If benchmarks are exceeded, additional measures are to be implimented as directed _by this
Stormwater NPDES Permit.
Follow up inspections are expected.

Dear Mr. Dumpor:
This firm represents SMM Southeast LLC, d/b/a Sims Metal Management. We are
writing; to address the situation posed by our client's Outfall 001 and the above -referenced
General Permit and Certificate of Coverage. In summary, our client's inability to adequately
sample Outfall 001 has led to our client's decision to adopt an engineering solution allowing:; for
the closure of Outfall 001.
As noted in the enclosed Semi -Annual Discharge Monitoring; Report, our client made
repeated efforts to collect a representative stormwater sample at Outfall 001, without success.
The property is bordered by two drainage ditches, located along the northwestern and northern
property boundaries. These ditches appear to have been designed to channel water from the
south, across Neuse Boulevard, to the northeast along; the adjoining railroad tracks. Outfall 001
was designed to then discharge stormwater to the northern drainage ditch, as reflected on the site
map attached to the S&rni-Annual Discharge Monitoring; Report as Figure I.
During; our- client's attempts to collect a representative stormwater sample, the water level
in the northern drainage ditch appeared to be unusually high, subsequently flooding; Outfall 001.
Our client retained a consultant, ONE.; E.rivironinciltal, to investigate the difficulties posed by the
Outfall. ONE"s investigation concluded that water was not being allowed to transfer through the
intended culverts, due to channel erosion along; the northwestern drainage ditch. This disruption
in flow created a flux of'water, which quickly built along the northern drainage ditch at the
location 01'01,itfail 001. Attachment A to the Semi -Annual Discharge Monitoring Report
provides a photographic log of the northern drainage ditch during a June 10, 2014 rain event, as
well as of the typical drainage ditch erosion.

Given our client's inability to collect a representative stormwater sample, our client
began working with ONE Environmental to seal Outfall 001 and manage the stormwater on -site,
thereby avoiding further discharges. The June 10, 2013 rain event, as documented in the
attached Qualitative and Discharge Monitoring Reports, confirmed the continued flooding of the
northern drainage ditch, and the successful sealing of Outfall 001. With the exception of minor
engineering adjustments to the stormwater containment on -site, involving the placement of
riprap and the like, we and our client believe that scaling Outfali 001 best resolves the routine
flooding of the Outfall and the subsequent inability to collect a representative stormwater
sample. Accordingly, please treat this letter as our client's notice that our client has closed the
involved Outfall and will no longer be discharging pursuant to the Certificate.

Dear Mr. Dumpor:
SMM Southeast LLC (d.b.a.. Sims Metal Management - New Bern Facility) herein provides
the Semi -Annual Discharge Monitoring Report and Qualitative Monitoring Report for the
property located at 2912 Neuse Boulevard in Now Bern, North Carolina. These reports
cover the time period defined in the NPDE;S General Permit NC6030000 Certificate of
Coverage No. NCG030333 as Year 2 -- Period 1 for Outfall 001 (January 1, 2014 through
June 30, 2014). During that time period, "no flow" was recorded for Outfall 001.
Clarification on the "no flow" designation is provided below.
The property is bordered by two drainage ditches located along the northwestern and
northern property houndaries. The ditches appear to have been designed to channel water
from the south, across Neuse Boulevard, to northeast, along the adjoining; railroad tracks.
The property outran (Outfall 001) is designed to discharge stormwater to the northern
drainage ditch, see Figure 1 Site Map.
Multiple attempts to collect a representative stormwater sample from Outfall 001 were
completed by Sims personnel over the aforementioned reporting; period. During these
attempts the water level in the northern drainage ditch appeared unusually high
subsequently flooding; Outfall 001 and obstructing; the collection of a representative
stormwater sample froin the property. After further investigation it appears that a flux of
water quickly builds along the northern drainage ditch during rain events. This influx of
water stems from channel erosion within the bordering drainage ditches preventing
stormwater from flowing within its intended path, through culverts, and away from the
property border. Attachment A provides a Photographic log; of typical drainage ditch
erosion and the northern drainage ditch during the June 10, 2014 representative rain
event.

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG030000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.ors/web/wo/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of SO mg/I for HOW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (0&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections 8, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Mr. Mike Thomas of the Winston-Salem Regional Office of the North Carolina Division of Water
Quality conducted a compliance evaluation inspection of Isometric Plant #1 and Plant #2 on 20 September
2012. The assistance and cooperation of Mr. Mike Leffew of Isometrics and James Frei of Stormwater
Services Group, were greatly appreciated. Inspection findings for both facilities are summarized below and
inspection reports are attached for your records.
Isometrics, Inc. Plant #1 NCG030033
Sight Review
This facility is located at 1266 N. Scales St., in Reidsville, Rockingham County. Stormwater related to
industrial activity is discharged from the site to an unnamed tributary to Wolf Island Creek, which is
currently classified as Class C waters in the Roanoke River basin.
The facility was clean and in good shape at the time of inspection. Many of the housekeeping issues
noted in the previous inspection have been addressed. During the inspection, Mr. Thomas pointed out that the
used oil drum still had no secondary protection. Mr. Leffew suggested relocating the tank to the former
hazardous waste site that has existing secondary containment. Relocating the tank will bring the tank into
compliance with permit conditions. Mr. Thomas also noted that there were two smaller tanks of diesel fuel that
are used in pressure testing the tanks that do not have secondary containment. In addition, all above ground
storage tanks at the facility are required to have secondary containment with manually controlled valves, which
shall be secured closed with a locking mechanism.

Plant #2 is located at 7537 NC HWY 87N, in Reidsville, Rockingham County. Stormwater related to
industrial activity is discharged to an unnamed tributary of Wolf Island Creek, which is currently classified
as Class C waters in the Roanoke River basin.
The facility was clean and in good shape at the time of inspection. Many of the housekeeping issues
noted in the previous inspection have been addressed. New structures have been built to bring most of the
industrial activity inside.
Documentation Review for Plant #1 and Plant #2
Both facilities- ave nearly identical Stormwater Pollution Prevention Plans and are well implemented.

MriThomas did- observe that there were some minor deficiencies in tracking training events and updating

Both facilities are following the appropriate schedules and protocols for qualitative and analytical
monitoring. Qualitative monitoring results are documented and retained per the permit requirements.
Analytical monitoring results showed that all parameters were within benchmark values and the
accompanying paperwork was complete.
We greatly appreciate your efforts to develop and implement an effective stormwater pollution
prevention plan. Please reply in writing to this letter within 30 days of receiving it. Your reply should detail
corrective actions and implementation schedules for each deficiency detailed above. If you have any

Dear Mr. Goldman:
The U.S. Environmental Protection Agency, Region 4 (EPA) has
made an affirmative determination of acceptability for the
receipt of non -hazardous CERCLA off -site waste at Raymond Goldman
& Company, Inc.. (Goldman), New Bern, North Carolina, North
Carolina stormwater permit number NCG 030333. Pursuant to
40 C.F.R. § 300.440(a)(4), EPA has completed an initial
assessment of Goldman, and finds the facility acceptable for the
receipt of non -hazardous off -site waste. Such off -site waste is
defined as those wastes generated as a result of activities
authorized pursuant to, or funded by, the Comprehensive
Environmental Response, Compensation, and Liability Act (CERCLA)
On September 22, 1993, EPA amended the'National Oil and
Hazardous Substances Pollution Contingency Plan, 40 C.F.R.
Part 300, by adding Section 300.440, now known as the Of
Rule. The rule implements and codifies the requirements
contained in CERCLA Section 121(d)(3), and incorporates many
provisions of the November 13, 1987, OSWER Directive
(No. 9834.11), known as the Off -site Policy. The Off -site Rule
establishes the criteria and procedures for determining if
facilities are acceptable for the off -site receipt of CERCLA
waste, and outlines the actions affected by the standard.
The Off -site Rule requires that prior to a facility's
initial receipt of CERCLA waste, EPA shall determine if there are
relevant releases or relevant violations at the facility. EPA
believes that affirmative determinations of "compliance" and
"control of releases" are necessary before a facility may be
deemed acceptable f�r the receipt of CERCLA wastes.

This affirmative determination of Goldman is based on
information provided by representatives of the North Carolina
Department of Environment, Health, and Natural Resources (NC-
DEHNR) specifically Kevin Miller, Aisha Lau, and Richard Powers.
Each of these individuals was consulted to determine Goldman's
compliance with the applicable state regulations and effective
operating permits. The preliminary results indicate that Goldman
is currently in compliance with applicable environmental
standards. Based on communication with NC-DEHNR personnel, the
U.S. EPA Regional Office has no information indicating any
environmentally significant release of hazardous substances.
Therefore, effective upon receipt of this letter Goldman is
acceptable to receive CERCLA off -site waste at the facility
described above. Should any new information affecting this
determination develop, EPA reserves its right to revisit this
decision.
Please note that this determination does not supersede the
requirements of Subtitle C of the Resource Conservation and
Recovery Act for CERCLA waste which are also hazardous.

STORMWATER DISCHARGES
In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the
Federal Water Pollution Control Act, as amended,
Dennis M: Bracy
is hereby authorized to discharge stormwater from a facility located at
Isometrics, Inc. Plant 1
1402 South Scales Street
Reidsville
Rockingham County
to receiving waters designated as an unnamed tributary to Wolf Island Creek in the Roanoke River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III
and IV of General Permit No. NCG030000 as attached.
This certificate of coverage shall become effective May 14,1993.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
