Skvada, III Secretary July 18, 2014 Subject: Biomerieux, Inc. - Durham NPDES STORMWATER PERMIT NCG030210 Durham County On July 11, 2014, Dave Parnell, of the Raleigh Regional Office of the North Carolina Division of Energy, Mineral and Land Resources (DEMLR), conducted a compliance evaluation inspection (CEI) at the above referenced facility. The site lies in the watershed of an unnamed tributary (UT) to Flat River, Class WS-IV, NSW waters, which lies in the Neuse River Basin. The following observations were noted during the NCG030210 DEMLR inspection: This facility is an invitro dianostic substance manufacturing' facility, which does not conduct vehicle maintenance on site. Thank you for your assistance during the inspection, it was appreciated. The inspection began in your office, where a thorough review of the Stormwater Pollution Prevention Plan; as well as, the qualitative and analytical monitoring results, was conducted. All aspects of the Stormwater Pollution Prevention Plan are being implemented. Analytical and Qualitative monitoring data were reviewed and found to be in order and compliant with the NPDES Stormwater Permit. Following the monitoring data review, all secondary containment, and the Stormwater Discharge Outfalls (SDO) were observed. You are knowledgeable, with respect to the sample site and sampling techniques. As we discussed during the inspection, it appears that this facility is not operating under the correct NPDES permit. Correspondences since the inspection indicate that you and the Stormwater Permitting Program are working out this issue. This facility produces reagents used for healthcare and product safety. 2. This facility has five outfalls. Monitoring is currently being performed at all five outfalls. During the time of the inspection, discharge was clear and all outfalls were accessible for monitoring, 3. All monitoring is performed as required by individual Stormwater General Permit NCG030210. Analytical and qualitative results are recorded on the forms provided by DWQ. 4. Samples are collected and analyzed by Stormwater Services Group, LLC of Raleigh, NC. S. The facility provide all necessary secondary containment as required. 6. All drains within the plant are connected to sanitary sewer. Loading docks, roof drains and yard surface drains are the only sources of stormwater. 7. The Stormwater Pollution Prevention Plan is updated once per year, and include employee training. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would he eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial facilities in any of the l 1 categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the faeilty industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion.
