As indicated via my letter dated 8/7/96, redevelopment work is scheduled to begin as weather permits. With regard to our submittal of the plans and calculations, I submit the following for your review. SEDIMENT BASIN NO. 4 Description: Sediment Basion No. 4 is proposed to be located at the lowest landscape position (release point) available on the site. This location is selected in order to allow a single facility to serve a dual purpose. Initially, the facility will serve as a sediment basin during construction and, after site stabilization, the basin and dam will remain in place to provide a stormwater impoundment and sampling point. Due to the area's low terrain, the basin will remain as a wet pond. The position and configuation of the basin is dictated by the site's constraints and existing drainage patterns. The site is proposed to be developed as a Waste Management Campus and include a Recycling Center, District Collection Facility (Administration and Maintenance), "Transfer Station and a Woodwaste Facility. The site's selection was driven by the appropriate zoning and location adjacent to an active rail spur. Unfortunately, the existing rail spur altered the drainage pattern and redirected part of the off site flow along the rail track side ditch. The site's stormwater system was analyzed to determine the existing division of flow through the rail spur cross pipe and the rail side ditch. To prevent overloading the downstream systems, this proportional relationship was maintained. Spillway: The site's general slope and outlet channel conditions dictated the location and type of spillway required for the basin. The outlet channel slope was field surveyed and computed to be I%. In order to provide the necessary storage, the proposed basin site will be excavated. In doing so, a riser and barrel type outlet was eliminated and a dam and weir type was selected. Even with the dam and weir selection, the excavated storage cavity will remain as a wet pond. The weir elevation was set at elevation 90.0 in order to provide a positive outlet flow and maintain an outlet elevation correlated to the existing cross pipe under the rail spur. The existing rail spur cross pipe and any extension thereto were critical to maintaining the proportional outflow from the site. SDG Page 2 Dam: Due to the contributing drainage area (22.10 acres), a rock dam/spillway was selected in accordance with the NC Erosion and Sediment Control Manual. At present, only part of the impervious surfaces are in place with the "Transfer Station and Woodwaste Facility projected for future development. The final stormwater impoundment surface area will dictated by the site's build out. In support of the application to fill in the wetlands, there are several factors that we hope you consider in your review. 1. The proposed use of the area is for a regulatory driven need to eliminate wood products from the waste stream and, if possible, create a reusable material. The proposed location maintains the required relationship between the existing circulation, truck scales and the proposed site rail spur. Prior to submitting our application, the entire site was reviewed to determine the best location for the proposed Woodwaste Facility. The elimination of the wetlands would allow the stormwater impoundment to be ad enlarged to provide more surface area needed to improve the trapping efficiency. ?Y 1 3. The location of the wetland addressed in the application is an isolated pocket located along upper division line of two drainage corridors. In order to continue the development of this site as a Waste Management Campus, an additional 5.U acres of land was purchased. The added property also contains an area of wetlands that are adjacent to flowing stream and viewed as providing a more significant function. A concerted effort was made to prohibit any existing or planned development in this area. Our application to alter the wetlands is not a request to just fill and construct a Woodwaste Facility, but a request to allow an orderly development of an industrial complex that includes a stormwater impoundment as a means of providing water quality. A portion of the requested wetland area would become part of the wet pond and provide the necessary ground space to enlarge the surface area and thus, improve the performance. The addition of this facility will close the final chapter for this project and above all provide the incentive to complete the stormwater impoundment as per your approval condition. Biologists on our staff are familiar with fish and wildlife habitat associated with the proposed project area and made a site visit on July 13, 1996, Our comments are provided in accordance with certain provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), and Section 401.b of the Clean Water Act of 1977 (as amended), and North Carolina General Statues (G.S. 113-131 et seq). The applicant proposes to fill 1.226 acres of wetlands to expand an existing recycling plant. 'I here have been 1.1 acres of wetlands already filled on the site to provide for the recycling center. The 401 Water Quality Certlficatlon of May 1, 1995, stated that a permanent wet detention pond was to be constructed downstream of the wetlands, which were not to be filled. While a sediment basin is in place, we question if this is serving as the permanent wet detention pond required in the certification. A large amount of sediment has degraded the remaining wetlands that were specified not to be filled. Therefore, we believe this applicant is in violation of the previous certification. The wetlands on this site have been degraded; however, they are still functioning to remove pollutants from adjacent development and will continue to help prevent further degradation in the Ncusc River Basin if they are pratected from 1111 and excessive yadimentation, We have the following recommendations on this certification: Apply enforcement action to have the applicant fulfill the conditions of the original certification, which implies that no additional wetlands are to be filled on this site. At present, the site contractor is preparing to re-construct the stormwater pond dam and spillway as per plans. Please note that the work schedule is being affected by the weather and all efforts are being made to bring this issue to closure. I have discussed this matter and its implications to the request to fill the on-site wetlands with the proposed facility buyer/operator. They have instructed me to continue our pursuit of the 401 Certification and provide any necessary supporting data. At present, I am focusing my activities on bringing the site into complicance and will submit our case documents prior to your 15 August, 1996 deadline. Commercial Fill Wilson County Permit No. 0000370 On July 15, 1996 Danny Smith from the RRO met Mr. Frank Braxton with Sungate Design Group in order to conduct a site visit at Waste Industries recycle station (note: this site is also a vehicle storage area and is where the trucks are repaired). Waste industries has applied for an additional 1.226 acres of wetland fill at the subject facility. On May 1, 1995 this facility originally was issued a water Quality Certification for 1.1 acres of fill for the purpose of constructing a regional solid waste management and recycling facility at Seaboard Coat Line Rail Road. This Certification contained the following conditions: "A permanent wet detention pond shall be constructed downstream of the wetlands which are not to be filled to handle runoff from the site." During the July 15, 1996 site visit not diverted into the avoided wet was not built. Specifically, Mr. diverted away from the wetlands, (unclear if this pond actually is a ditch adjacent to the rail road it was noted that stormwater was lands and that a stormwater pond Smith noted that stormwater was away from a sedimentation pond a sedimentation pond), and into tracts. This is a violation of North Carolina General Statute 143-215. (c)(1) and 15A NCAC 2H .0504 (c) which respectively states the following: 143-215 (c)(1) -In adopting effluent standards or limitations and management practices the Commission shall be guided by the same considerations and criteria set forth, from time to time, in federal law for the guidance of federal agencies administering the Federal Water Pollution Control Act. The effluent standards or limitations and management practices adopted hereunder shall be no more restrictive than the most nearly applicable federal effluent standard or limitations and management practices unless the Commission first considers, among other things, an evaluation, prepared by the Department in accordance with this subsection, of the impact of the proposed effluent standards or limitations and management practices and finds the at the environmental, public health, safety, and welfare benefits of such proposed effluent standards or limitations and management practices justify their cost. 15A NCAC 2H .504 (c) - Conditions of Certification. Any certification issued pursuant to this Rule may contain such conditions as the Director shall deem necessary to insure compliance with Section 301, 302, 303, 306, and 307 of the Federal Water Pollution Control Act Amendments. The RRO recommends that a Notice of Violation be issued to Waste Industries regarding this matter. Which should require Waste Industries to immediately abate this issue, which is subject to civil penalties of $10,000 per day under NCGS 143-215.6. In addition, this office requeststhat waste industries respond to this Notice in writing by August 12, 1996. They should explain why stormwater was not diverted into the wetlands, why a stormwater pond was not built, and what was the purpose of the depression noted at the corner of the property (that is it had no outlet, riser, or emergency structure and only held water from one corner of the lot.) With respect to the Current 401 Certification - It should not be issued until the previous problems have been specifically addressed. In addition, a stormwater pond should be built to treat stormwater from the whole drainage basin and the water should then be discharged (through a spreader device/velocity dissipator) and spread out into the remaining wetlands. Regardless if additional acreage are filled or not. It is clear that Waste Industries has in no way met any of the conditions of the 401 Certification and appears to have not even done the least they could do to try to comply with the above conditons. Further, they are now requesting the fill of an additional 1.226 acres! It should also be noted that the wetlands initially rated a 55. Currently, the wetlands rate 30 due to the removal of stormwater from the wetland (Hence, the value with respect to water quality function has been significantly reduced due to activities of Waste Industries.) - lets talk- RRO recommendation: NOV, consider whether to recommend an Enforcement Action, and require a Schedule of Compliance (with dates) for both Certifications. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, pollutant removal and wildlife habitat. Furthermore, insufficient evidence is present in our tiles to conclude that your project must be built as phmned in waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing till in these waters and/or wetlands. Specifically can you construct your facility on nearby uplands or prior converted farmland? In our earlier approval (fated 1 May 1995 we explicitly stated that the remaining wetlands on the original parcel were not to be tilled and that a permanent wet detention pond was to be built. When Mr. Danny Smith of the Raleigh Regional Office visited die site on 15 July 1996 die pond did not appear to be constructed properly and stonnwater was routed :?round die pond. My understanding from a recent telephone conversation with Mr. Frank Brixton is that the stormwater has now been routed to die pond. Based on our previous permitting decision, we are unlikely to approve additional till to wetlands on die original parcel. Before we make any final decision on additional wetland fill, we will need to review engineering and design specifications for the pond and be sure that these designs are properly built as required by die original Certification. These plans should be submitted to us by 15 August 1996. Unless the matter of the stormwater pond is adequately dealt with, we will consider actions such as a Notice of Violation and civil penalties to rectify die matter. Any documentation such is maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please respond within two weeks of die date of this letter by sending a copy of this, information to me and one copy to Mr. Danny Smith at the Raleigh Regional Office at 3800 Barrett Drive, Raleigh, NC 27611. Commercial Fill Wilson County Permit No. 0000370 On July 15, 1996 Danny Smith from the RRO met Mr. Frank Braxton with Sungate Design Group in order to conduct a site visit at Waste Industries recycle station (note: this site is also a vehicle storage area and is where the trucks are repaired). Waste industries has applied for an additional 1.226 acres of wetland fill at the subject facility. On May 1, 1995 this facility originally was issued a water Quality Certification for 1.1 acres of fill for the purpose of constructing a regional solid waste management and recycling facility at Seaboard Coat Line Rail Road. This Certification contained the following conditions: "A permanent wet detention pond shall be constructed downstream of the wetlands which are not to be filled to handle runoff from the site." During the July 15,1996 site visit not diverted into the avoided wet was not built. Specifically, Mr. diverted away from the wetlands, (unclear if this pond actually is a ditch adjacent to the rail road it was noted that stormwater was lands and that a stormwater pond Smith noted that stormwater was away from a sedimentation pond a sedimentation pond), and into tracts. This is a violation of North Carolina General Statute 143-215. (c)(1) and 15A NCAC 2H .0504 (c) which respectively states the following: 143-215 (c)(1) -In adopting effluent standards or limitations and management practices the Commission shall be guided by the same considerations and criteria set forth, from time to time, in federal law for the guidance of federal agencies administering the Federal Water Pollution Control Act. The effluent standards or limitations and management practices adopted hereunder shall be no more restrictive than the most nearly applicable federal effluent standard or limitations and management practices unless the Commission first considers, among other things, an evaluation, prepared by the Department in accordance with this subsection, of the impact of the proposed effluent standards or limitations and management practices and finds the at the environmental, public health, safety, and welfare benefits of such proposed effluent standards or limitations and management practices justify their cost. 15A NCAC 2H .504 (c) - Conditions of Certification. Any certification issued pursuant to this Rule may contain such conditions as the Director shall deem necessary to insure compliance with Section 301, 302, 303, 306, and 307 of the Federal Water Pollution Control Act Amendments. The RRO recommends that a Notice of Violation be issued to Waste Industries regarding this matter. Which should require Waste Industries to immediately abate this issue, which is subject to civil penalties of $10,000 per day under NCGS 143-215.6. In addition, this office request that waste industries respond to this Notice in writing by August 12, 1996. They should explain why stormwater was not diverted into the wetlands, why a stormwater pond was not built, and what was the purpose of the depression noted at the corner of the property (that is it had no outlet, riser, or emergency structure and only held water from one corner of the lot.) With respect to the Current 401 Certification - It should not be issued until the previous problems have been specifically addressed. In addition, a stormwater pond should be built to treat stormwater from the whole drainage basin and the water should then be discharged (through a spreader device/velocity dissipator) and spread out into the remaining wetlands. Regardless if additional acreage are filled or not. It is clear that Waste Industries has in no way met any of the conditions of the 401 Certification and appears to have not even done the least they could do to try to comply with the above conditons. Further, they are now requesting the fill of an additional 1.226 acres! It should also be noted that the wetlands initially rated a 55. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Deed restrictions shall be required on all lots with remaining wetlands to prevent future fill. Stormwater shall be directed to flow at nonerosive velocities into the remaining wetlands on site both above the stormwater pond and along Contentnea Creek. Additional written approval is required from DWQ for the stormwater pond before additional wetland filling occurs. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You most act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Commercial Fill Wilson County On April 27, 1995, I met Mr. Braxton of Sungate Design Group at the proposed regional solid waste management & recycling facility near Wilson. After a discussion of the proposed impacts, Mr. Braxton offered to avoid impacting approximately 19,675 sq ft. of wetlands (?2/3 acre). Further he explained that a spreader device will be added to an already culverted ditch in order to sheet flow stormwater onto the avoid 2/3 acre of wetland. Down slope from this avoided wetland area, a stormwater pond will be put in place to further treat storm water (resulting in most of the wetland impact).
