Dear Dr. Van Campen:

You have our approval to place fill material in 0.81 acres of wetlands or waters for the purpose of
constructing a retail/commercial building at NC 132, as you described in your application dated 21
December 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit
Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application, For this
approval to be valid, you must follow the conditions listed in the attached certification. Stormwater
management will be required for this project. DEM, Wilmington Regional Office staff shall be
contacted for this purpose. In addition, you should get any other federal, state or local pennits before
you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P,O. Box 27447, Raleigh, N,C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

SUBJECT: Dr. Philip Van Campen request for 401 Water
Quality Certification involving filling of
wetlands associated with commercial\retail
building construction, intersection of Hwys 17 and
132, Wilmington, New Hanover County, North
Carolina. DEM ID: 951291.

The Wildlife Resources Commission has reviewed the
subject request for Water Quality Certification. A site
visit was made on January 9, 1996. Our comments are
provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et. seq.).

The applicant proposes to fill 0.81 acre of wooded
wetlands containing loblolly pine, magnolia, sweetgum, bay,
water oak, red maple, and common reed to facilitate
construction of commercial\retail building(s). Although the
wetlands appear to be hydraulically isolated from area
surface waters, they provide good songbird habitat in what
is becoming an increasingly urban setting. Since the
wetlands are located in a far corner of the property, we
recommend they be incorporated into the future facility's
landscaping plan as natural "green space" to the greatest
extent possible, rather than filled. Such action would
enhance the facility's aesthetic values and conserve
wildlife habitat.
