Facility (C & D Landfill) COC Number NCG120085 Union County Dear Permittee: In response to your renewal application for continued coverage under stormwater General Permit NCG120000 the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG120000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections 8, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. A measurable storm event is defined in the permit. • Section D: if the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Outfalls 001, 002, 004, 005, and 006 appear to be well maintained and monitored. Outfall 003 was well removed from the industrial activity at the site and traversed an extensive overland ranee before discharging to Richardson Creek. It is recommended that the monitoring/sampling point for Outfall 003 be moved closer to the industrial activity so actual site contributions are reflected in the samples. Outfall 008 was also well removed from the industrial activity. It is recommended that Outfall 008 site be moved closer to the industrial activity to reflect actual site contributions. Outfalt 007 had no discrete conveyance to the property line. Stormwater flow at this outfall is considered to be sheet flow. Monitoring at this outfall can cease as discussed during the inspection. A Tier 1 response had not been documented at the time of the inspection. Monitoring: The stormwater discharge forms (SDO) were not filled out correctly. Please put dates in the 'Date Sample Collected' column. if there is no flow at a particular outfall when a sample is collected, please put 'No Flow' under the sample results column. If a particular outfall has has not reached Tier 1/Tier 2 status and does not require monthly sampling, please put 'Not Tier 11Not Tier 2' under the sample results column. The benchmark valve exceedences were for Fecal Coliform at Outfall Nos. 3, 5 and 7 and Total Suspended Solids (TSS) at Outfall No. 5_ Due to the benchmark exceedences the NPDES Stormwater General Permit requires a Tier One response which includes the following: 1. Conduct a stormwater management inspection of the facility within two weeks of receiving sampling results. 2. Identify and evaluate possible causes of the benchmark value exceedence. 3- Identify potential, and select the specific: source controls, operational controls, or physical improvements to reduce concentrations of the parameters of concern, or to bring concentrations to within the benchmark range. 4. Implement the selected actions within two months of the inspection. 5. Maintain on site a written summary record of each instance of a Tier One response_ Include the date and value of the benchmark exceedence, the inspection date, the personnel conducting the inspection, the selected actions, and the date the selected actions were ixnplemented. A review and analysis of the landfill site and operations was completed to determine possible causes and remedies to the stormwater outfalls benchmark values exceedences. The outcome from the review and analysis is as follows: For TSS benchmarks value exceedence at Outfall No_ 5 which is the discharge for the sediment basin north of the active construction and demolition (C&D) landfill. To possibly remedy the Outfall No. 5 TSS exceedence, modifications/improvements are proposed to be made to the sediment basin to reduce sediment from discharging the sediment basin thru the basin riser pipe. This can be done by iocreaszug the stone around the riser pipe making sure all holes within the riser pipe are covered by stone. Pdso to place silt fence baffles within the basin to increase sediment collection before stormwater reaches the riser pipe_ These remedies for TSS exceedences will also help in removal of any fecal matter and possible reduction in fecal coliform at the Outfall. For the fecal coliform benchmark value exceedence at Outfall No. 3, No. 5 and No. 7, the benchmark threshold for fecal coliform is I UOO colonies per 100 ml which is not veryhigh for i� Aug 18 11 07:55a Union County Landfill 704-233-0255 o.3 MEMO R At4'---; UM September 9, 2010 Poge 2 stormwater surface run-off for a rural area_ To possibly remedy Outfall No. 3, which is a stormwatcr discharge point for the Transfer Station, modifications should be done to the Transfer Station stormwater collection points and ditches to help remove any fecal matter that may be influencing the stormwater run-off_ This can be done by excavating and re -grading stormwater ditches downgradient of the Transfer Station and placement of silt fence along the perimeter of the pavement and curbing to filter out any solid matter before leaving the site. To possibly remedy the fecal coliform benchmark value exceedence for Outfall No. 7 the stounwater sampling location should be moved to the north side of Olive Branch Road. The location for the July 13, 2010 sampling event was on the South side of Olive Branch Road which additionally collects stormwater from off -site and is not representative of storruwater run-off from the landfill property_ Other possible remedy to the fecal coliform exceedences is providing more storagefdetention of the storm,water before discharging to the outfalls. Also to continue a storrnwater collection protocol to ensure a representative sample is collected in accordance with the NDPES Stormwater General Permit "A representative storm event is a storm event that measures greater than 01 inches of rainfall and that is preceded by at least 72 hours in which no storm event measuring greater than 0.1 inches has occurred A single storm event may contain up to 10 consecutive hours of no precipitation. For example, if it rains for 2 hours without producing any collectable discharge, and then stops, a sample may be collected if a rain producing a discharge begins again within the next 10 hours. " The following schedule will be used for the Tier One Response: 1. Implement the selected remedy actions outlined above within two months. 2. Maintain on -site a written summary record of each implemented remedy outlined above. When this property is sold, leased, conveyed or transferred, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument, a statement that the property has been used as a sanitary landfill. 2, The operating life of Cells 2, 3, and 4 is approximately one and half years; however, the permit shall expire on July 1, 2008. If this unit plans to operate beyond July 1, 2008, the owner/operator must submit a permit application in accordance with 15A NCAC l 3B, Rule .0547(4) of the recently adopted C&DLF rules. 3. The approved plan is described in Attachment 2, Part III, Documents 1-10_ Where discrepancies may exist, the most recent submittal and the Conditions of Permit shall govern. Some components of the approved plan are reiterated in the Conditions of Permit. 4. This permit is not transferable. 5. The Financial Assurance Instrument (FAI) for this facility shall be amended when Closure Certification has been completed and the Closure/Post-Closure Care portion ofthe instrument is amended. The FAI shall be reviewed and updated annually for this facility. 6. K during the operational life of the C&D unit, it becomes apparent that the operations at the facility are impacting ground water adversely, the Solid Waste Section will require landfilling activities to cease and closure of the operating unit. CONSTRUCTION AND OPERATION 7. This permit is for the continued operation of Cells 2, 3, and 4 of the Union County Construction and Demolition Landfill Unit, in accordance with the approved plans, Attachment 2, Part III, Documents 9 and 10. 8. This solid waste management facility is permitted to receive the following waste types: a_ Land-clpgrn _debris as defined in G. S. 130A-290, specifically, solid waste which is generated solely from land -clearing activities, such as stumps, trees, etc_; b. ID No. RC0915 6 of 9 C. Asphalt in accordance with G. S. 130-294(m). d. Construction and demolition debris defined as solid waste resulting solely from construction, remodeling, repair or demolition operations on pavement, buildings, or other structures. e. C&D like waste that are similar to wastes typically found in the land clearing -inert debris and C&D waste streams consisting ofwastes at this time: roofing shingle waste from the manufacturer, waste building materials from mobile home/modular home manufacturer and wooden pallets. Other wastes MAY be approved by the Division upon receipt of a written request with the specific waste type, how its generated, how much is generated, along with any additional information the Division may request to render a final decision on the disposal options for the waste. Yard trash as defined in G_S. 130A-290, shall not be disposed in the landfill area. However, yard trash, along with land -clearing debris, may be accepted for processing in a separate yard waste composting area. All sedimentation/erosion control activities will be conducted in accordance with the Sedimentation Control Act codified at 15 NCAC 4. Native vegetation shall be established on the completed landfill. Operation of the C&D landfill unit shall conform to the operating procedures described in the approved plan, in accordance with the Solid Waste Management Rules, and in accordance with the following requirements: to Acceptance and Disposal a. The facility shall accept only those solid wastes which it is permitted to receive. b. No municipal solid waste, hazardous waste, industrial waste, liquid waste or waste not characterized as LCID or C&D shall be accepted for disposal. C. The permittee shall implement a program at the facility for detecting and preventing the disposal wastes listed in item b of this section. The program shall include, at a minimum: (I) Random inspections of incoming loads or other comparable procedures_ (ii) Records of any inspections; (iii) Training of personnel to recognize hazardous and liquid wastes; (iv) Development of a contingency plan to properly manage any identified wastes listed in item b of this section; the plan must address identification, removal, storage, and final disposition of waste. Operational soil cover of at least six inches shall be placed at least once per week or when the active area reaches'/2 acre in size or more often as necessitated by the nature of the waste so as to prevent the site from becoming a visual nuisance and to prevent fire, windblown materials, vectors or water infiltration. b. Areas which will not have additional waste placed on them for 12 months or more, but where final termination of operations has not occurred, shall be covered with a minimum of one foot of soil cover. C. After final termination of disposal operations at the site or major part thereof or upon revocation of a permit, the fill areas shall be covered with a cap in accordance with Rule.1627(C) and the approved closure plan or with the pertinent rules at the time of closure_ Access and Safety 13. a. The facility shall be adequately secured by means of gates, chains, bezins, fences, or other security measures approved by the Section to prevent unauthorized entry. b. An attendant shall be on duty at the site at all times while it js open for public use to ensure compliance with operational requirements. C. The access road to the site shall be of all --weather construction and maintained in good condition. d. Dust control measures shall be implemented when necessary. e. Signs providing information on dumping procedures, the hours of operation, the permit number, and other pertinent information shall be posted at the site entrance. f. Signs shall be posted stating that no MSW, hazardous waste or liquid waste can be received. g_ Traffic signs or markers shall be provided as necessary to promote an orderly traffic pattern to and from the discharge area and to maintain efficient operating conditions. h. The removal of solid 'waste from the facility is prohibited unless the owner/operator approves and the removal is not performed on the working face. i. Barrels and drums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazardous waste is contained therein, except fiber drums containing asbestos. j. Open burning of solid waste is prohibited. k. The concentration of explosive gases generated at the facility shall not exceed: i. twenty --five percent of the limit for gases in site structures (excluding gas control or recovery system components); and ii. the lower explosive limit for gases at the facility boundary. ID No. RC0915 8of9 Erosion and Sedimentation Control 14. a. Adequate sedimentation and erosion control measures shall be practiced to prevent silt from leaving the site. b. Adequate sedimentation and erosion control measures shall be practiced to prevent excessive on -site erosion. C. Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of C&D landfill development. Drainage Control and Water Protection Requirements 15, a. Surface water shall be diverted from the operational area. b. Surface water shall not be impounded over or in waste- C . Solid waste shall not be disposed of in water. d. Leachate shall be contained on site or properly treated prior to discharge_ An NPDES permit may be required prior to discharge of leachate to surface waters. 16. All. pertinent landfill operating personnel will receive training and supervision necessary to properly operate this landfill. 17. Ground water quality at this facility is subject to the classification and remedial action provisions referenced in Rule .1634 thru .1637 of 15A NCAC 13B. 18. A closure and post -closure plan must be submitted for approval at least 90 days prior to closure or partial closure of any landfill unit_ The plan must include all steps and measures necessary to close and maintain the facility in accordance with all rules in effect at that time. At a minimum, the plan shall address the following: a. Design of a final cover system; using the cap requirements outlined in Rule .1627 b. Construction and maintenance/operation of the final cover system and erosion control structures; C. Surface water, ground water, and explosive gas monitoring. MONITORING AND REPORTING REQUIREMENTS 19. Ground -water monitoring wefts and monitoring requirements for the C&D landfill unit shall be in accordance with the monitoring system approved in the Transition Plan for the facility and these additional conditions: a_ Monitoring well design and construction shall conform to the specifications outlined in the Water Quality Monitoring Guidance Document for Solid Waste Facilities. b. In order to determine ground -water flow directions and rates, each monitoring well shall be surveyed, and hydraulic conductivity values and effective porosity values shall be established for the screened intervals for each new monitoring well. d. The permittee shall sample the monitoring wells semi-annually or as directed by the SWS Hydrogeologist. e. A readily accessible unobstructed path shall be initially cleared and maintained so that four-wheel drive vehicles may access the monitoring wells at all times. 20. The permittee shall maintain a record of all monitoring events and analytical data. Reports of the analytical data for each water quality monitoring sampling event shall be submitted to DSWM in a timely manner. 21. The permittee shall maintain a record of the amount of solid waste received at the facility, compiled on a monthly basis. Scales shall be used to weigh the amount of waste received. 22. On or before August 1 (or an earlier date as requested by the Solid Waste Section), the permittee shall report the amount of waste received (in tons) at this facility and disposed ofin the landfill to the Solid Waste Section and to all counties from which waste was accepted, on forms prescribed by the Section. This report shall include the following information: a. The reporting period shall be for the previous year, beginning July 1 and ending on June 3 0; b. The amount of waste received and landfilled in tons, compiled on a monthly basis, according to Condition 22 described above; and C. Documentation that a copy of the report has been forwarded to all counties from which waste was accepted. 23. All records shall be maintained on -site and made available to the Section upon request. 24. The Post -Closure plan approved in the Transition Plan and also described in the C&D Landf ll Permit Modification, Attachment 2, Part III, Document 7, shall be implemented and followed upon capping and closing the operating unit(s). The facility is permitted to receive solid waste as defined inNCGS 130A -290 (35). 2. The following, at a minimum, must not be accepted for disposal at the facility; hazardous waste, yard trash, liquid wastes, regulated medical waste, sharps not properly packaged, animal carcasses, regulated -asbestos containing material as defined in 40 CFR 61, PCB waste as defined in 40 CFR 761, and wastes banned from disposal in North Carolina by G.S. 130A-309.10(f). 3. This facility is permitted to receive municipal solid waste generated within Union County. Waste must be transported for disposal to the Chamber's Development MSWLF (Permit No. 04-03), Uwharrie Regional Landfill (62-04) or BFI-Charlotte Motor Speedway Landfill V (13-04). Proposed changes to the service area and/or the disposal facility must be approved by the Section. 4. The perm ittee must not knowingly dispose of, or accept for transfer for subsequent disposal, municipal solid waste that is generated within the boundaries of a unit of local goveniment that by ordinance: a. Prohibits generators or collectors of municipal solid waste from disposing of that type or form of municipal solid waste. b. Requires generators or collectors of municipal solid waste to recycle that type or form of municipal solid waste. A responsible individual trained and certified in facility operations must be on -site at all times during all operating hours of the facility, in accordance with G.S. 130A-309.25. 6. The permittee must develop, and use, a training and screening program at the facility for detecting and preventing unauthorized wastes from being accepted at the facility. At a minimum, the program must include: a. Random inspections of incoming loads or other comparable procedures. b. Records of all inspections. C. Training of personnel to recognize hazardous, liquid and other excluded waste types. d. Development of a contingency plan to properly manage any identified hazardous, liquid, or other excluded or unauthorized wastes. The plan must address identification, removal, storage and final disposition of these wastes. 7. The facility must not cause nuisance conditions. a. The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily in accordance with the approved Operational Plan. b. Waste must only be deposited on a "tipping floor" or directly into a transfer container. Waste must not be stored on the "tipping floor" after operating hours. C. Waste may be stored on -site, in leak proof transfer trailers, with watertight covers, a maximum of 24 hours except that a minimal amount of waste may be stored for a maximum of 72 hours when the facility is closed during a weekend or holiday. Storage of the waste must not cause any nuisance, such as odor or attraction of vectors. d. Effective vector control measures must be applied at all times to control any potential vectors including flies, rodents, insects, and other vermin. e. Control measures rhust be utilized to minimize and eliminate visible dust emissions and blowing litter. i) Fugitive dust emissions are prohibited. ii) Windblown materials must be collected by the end of the day and no windblown material may be allowed to leave the facility boundary. 8. All water that comes in contact with solid waste, including vehicle wash -down water, is leachate and must be captured and properly treated before release to the environment. a. The leachate control system, such as floor drains, leachate collection devices, sanitary sewer connections and leachate storage tanks, must be operational during facility operations. All sedimentation and erosion control activities must be conducted in accordance with the Sedimentation Control Act N_C.G.S. 1 i 3A-50, et seq., and rules promulgated under 15A NCAC 4. 10. Copies of this permit, the approved plans and all records required to be maintained by the permittee must be maintained at the facility, unless otherwise approved by the Section, and made available to the Section upon request during normal business hours. 11. The permittee must maintain a record of the amount of solid waste received at the facility, including daily records of waste received and origins of the loads. Scales must be used to weigh the amount of waste received. The daily records are to be summarized into a monthly report for use in the required annual reports. 12. On or before August 1 annually, the Pen-nittee must submit an annual facility report to the Solid Waste Section, on forms prescribed by the Section. a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual facility report must list the amount of waste received in tons and be compiled: i) On a monthly basis. ii) By county, city or transfer station of origin. iii) By specific waste type - iv) By receiving disposal facility. v) By diversion to alternative management facilities. C. The completed report must be forwarded to the Regional Environmental Specialist for the facility by the date due on the prescribed annual facility report form. d. A copy of the completed report must be forwarded to each county manager for each county from which waste was received the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the Regional Environmental Specialist by the date due on the prescribed annual facility report form. PART II- MISCELLANEOUS SOLID WASTE MANAGEMENT CONDITIONS 13. Wastes received and product stored shall be maintained in reasonably sized piles with adequate fire breaks and lames in accordance with the approved operational plans and the pertinent rules. 15. Surface water shall be diverted from all operational and storage areas to prevent standing water in operational areas and under or around storage piles. Water that comes in contact with solid waste shall be contained on -site or properly treated prior to discharge. 16. These areas shall be operated and maintained with sufficient dust control measures to minimize airborne emissions and to prevent dust from becoming a nuisance or safety hazard. 17. The County makes every effort to comply with all Federal and State requirements. The Union County Solid Waste Management Facility was in operation as a municipal solid waste landfill. The Municipal Solid Waste Landfill was closed in 1997 and modified to a Construction and Demolition Debris Landfill. It has been operating as such since April 1998 (Permit 90-01). This permit included provisions for sediment and erosion control. Since the implementation of this permit, our operations have been inspected numerous times by NCDENR. At no time were we ever informed about the need for a separate NPDES Stormwater Permit. While these regulations for a separate NPDES Stormwater Permit may be obvious to you, we found them rather ambiguous which made it difficult to foresee all the separate permits applicable to this site. Nonetheless, we value your role in protecting water quality and strive to do the same. Please accept the completed Notice of Intent application form and fee with supporting documentation as our intent to comply with your regulations. The discharge of washdown water from the pavement area around the Transfer Facility was immediately discontinued upon receipt of the October 6, 2009, Notice of Violation and will no longer be allowed as part of our procedures. From our conversations with Division of Solid Waste and Division of Water Quality staff, we understand that additional coordination efforts may be underway within NCDENR to assure that local govemments receive consistent and complete information to comply with all of NCDENR's environmental regulations. When this property is sold, leased, conveyed or transferred, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument, a statement that the property has been used as a sanitary landfill. 2. The operating life of Cells 2, 3, and 4 is approximately one and half years; however, the permit shall expire on July 1, 2008. If this unit plans to operate beyond July 1, 2008, the owner/operator must submit a permit application in accordance with 15A NCAC 13B, Rule .0547(4) of the recently adopted C&DLF rules. 3. The approved plan is described in Attachment 2, Part III, Documents 1-10_ Where discrepancies may exist, the most recent submittal and the Conditions ofPermit shall govern. Some components of the approved plan are reiterated in the Conditions of Permit. 4. This permit is not transferable. The Financial Assurance Instrument (FAI) for this facility shall be amended when Closure Certification has been completed and the Closure/Post-Closure Care portion ofthe instrument is amended. The FAI shall be reviewed and updated annually for this facility. b. If, during the operational life of the C&D unit, it becomes apparent that the operations at the facility are impacting ground water adversely, the Solid Waste Section will require landfiliing activities to cease and closure of the operating unit. CONSTRUCTION AND OPERATION 7. This permit is for the continued operation of Cells 2, 3, and 4 of the Union County Construction and Demolition Landfill Unit, in accordance with the approved plans, Attachment 2, Part III, Documents 9 and 10. 8. This solid waste management facility is permitted to receive the following waste types: a. Land -clearing debris as defined in G.S. 130A 290, specifically, solid waste which is generated solely from land -clearing activities, such as stumps, trees, etc.; b. Asphalt in accordance with G_S. 130-294(m). d_ Construction and demolition debris defined as solid waste resulting solely from construction, remodeling, repair or demolition operations on pavement, buildings, or other structures. e. C&D like waste that are similar to wastes typically found in the land clearing -inert debris and C&D waste streams consisting of wastes at this time: roofing shingle waste from the manufacturer, waste building materials from mobile homelmodular home manufacturer and wooden pallets. Other wastes MAY be approved by the Division upon receipt of a written request with the specific waste type, how its generated, how much is generated; along with any additional information the Division may request to render a final decision on the disposal options for the waste. Yard trash as defined in G.S. 130A-290, shall not be disposed in the landfill area. However, yard trash, along with land -clearing debris, may be accepted for processing in a separate yard waste composting area. All sedimentation/erosion control activities will be conducted in accordance with the Sedimentation Control Act codified at 15 NCAC 4. Native vegetation shall be established on the completed landfill. Operation of the C&D landfill unit shall conform to the operating procedures described in the approved plan, in accordance with the Solid Waste Management Rules, and in accordance with the following requirements: to Acceptance and Disposal a. The facility shall accept only those solid wastes which it is permitted to receive. b. No municipal solid waste, hazardous waste, industrial waste, liquid waste or waste not characterized as LCID or C&D shall be accepted for disposal. C. The permittee shall implement a program at the facility for detecting and preventing the disposal wastes listed in item b of this section. The program shall include, at a minimum: (1) Random inspections of incoming loads or other comparable procedures: (H) ' Records of any inspections; (iii) Training of personnel to recognize hazardous and liquid wastes; (iv) Development of a contingency plan to properly manage any identified wastes listed in item b of this section; the plan must address identification, removal, storage, and final disposition of waste. Operational soil cover of at least six inches shall be placed at least once per week or when the active area reaches'/z acre in size or more often as necessitated by the nature of the waste so as to prevent the site from becoming a visual nuisance and to prevent fire, windblown materials, vectors or water infiltration- b. Areas which will not have additional waste placed on them for 12 months or more, but where final termination of operations has not occurred, shall be covered with a minimum of one foot of soil cover. C. After final termination of disposal operations at the site or major part thereof, or upon revocation of a permit, the fill areas shall be covered with a cap in accordance with Rule.1627(C) and the approved closure plan or with the pertinent rules at the time of closure. Access and Safety 13. a. The facility shall be adequately secured by means of gates, chains, berms, fences, or other security measures approved by the Section to prevent unauthorized entry. b. An attendant shall be on duty at the site at all times while it.is open for public use to ensure compliance with operational requirements. C. The access road to the site shall be of all-weather construction and maintained in good condition. d. Dust control measures shall be implemented when necessary. e. Signs providing information on dumping procedures, the hours of operation, the permit number, and other pertinent information shall be posted at the site entrance. f. Signs shall be posted stating that no MSW, hazardous waste or liquid waste can be received. g. Traffic signs or markers shall be provided as necessary to promote an orderly traffic pattern to and from the discharge area and to maintain efficient operating conditions. h. The removal of solid waste from the facility is prohibited unless the owner/operator approves and the removal is not performed on the working face. i. Barrels and drums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazardous waste is contained therein, except fiber drums containing asbestos. j. Open burning of solid waste is prohibited. k. The concentration of explosive gases generated at the facility shall not exceed: i. twenty-five percent of the limit for gases in site structures (excluding gas control or recovery system. components); and ii. the lower explosive limit for gases at the facility boundary. ID No. RC0915 aOf9 Erosion and Sedimentation Control 14. a. Adequate sedimentation and erosion control measures shall be practiced to prevent silt from leaving the site. b. Adequate sedimentation and erosion control measures shall be practiced to prevent excessive on -site erosion. C. Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of C&D landfill development. Drainage Control and Water Protection Requirements 15. a. Surface water shall be diverted from the operational area. b. Surface water shall not be impounded over or in waste. C. Solid waste shall not be disposed of in water. d. Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to discharge of leachate to surface waters. 16. All pertinent landfill operating personnel will receive training and supervision necessary to properly operate this landfill. IT Ground water quality at this facility is subject to the classification and remedial action provisions referenced in Rule _1634 thru .1637 of 15A NCAC 13B. 18. A closure and post -closure plan must be submitted for approval at least 90 days prior to closure or partial closure of any landfill unit. The plan must include all steps and measures necessary to close and maintain the facility in accordance with all rules in effect at that time. At a minimum, the plan shall address the following: a. Design of a final cover system, using the cap requirements outlined in Rule . 1627 b. Construction and maintenanceloperation of the final cover system and erosion control structures; c. Surface water, ground water, and explosive gas monitoring. MONITORING AND REPORTING REQUIREMENTS 19_ Ground -water monitoring wells and monitoring requirements for the C&D landfill unit shall be in accordance with the monitoring system approved in the Transition Plan for the facility and these additional conditions: a. Monitoring well design and construction shall conform to the specifications outlined in the Water Quality Monitoring Guidance Document for Solid Waste Facilities. b. ID No. RC0915 9 of 9 established by DSWM at the time of sampling and in accordance with the approved Transition Plan or Assessment and Remediation Plan. ' C. In order to determine ground -water flow directions and rates, each monitoring well shall be surveyed, and hydraulic conductivity values and effective porosity values shall be established for the screened intervals for each new monitoring well. d_ The permittee shall sample the monitoring wells semi-annually or as directed by the SWS Hydrogeologist. e. A readily accessible unobstructed path shall be initially cleared and maintained so that four-wheel drive vehicles may access the monitoring wells at all times. 24. The permittee shall maintain a record of all monitoring events and analytical data. Reports of the analytical data for each water quality monitoring sampling event shall be submitted to DSWM in a timely manner. 21. The permittee shall maintain a record of the amount of solid waste received at the facility, compiled on a monthly basis. Scales shall be used to weigh the amount of waste received. 22. On or before August 1 (or an earlier date as requested by the Solid Waste Section), the permittee shall report the amount of waste received (in tons) at this facility and disposed ofin the landfill to the Solid Waste Section and to all counties from which waste was accepted, on forms prescribed by the Section. This report shall include the following information: a. The reporting period shall be for the previous year, beginning July 1 and ending on June 3 Q; b. The amount of waste received and landfilled in tons, compiled on a monthly basis, according to Condition 22 described above; and C. Documentation that a copy of the report has been forwarded to all counties from which waste was accepted. 23. All records shall be maintained on -site and made available to the Section upon request. 24. ATTACHMENT 3 CONDITIONS OF OPERATING PERMIT PART I - OPERATING CONDITIONS I - The facility is permitted to receive solid waste as defined in NCGS 130A -290 (35). 2. The following, at a minimum, must not be accepted for disposal at the facility; hazardous waste, yard trash, liquid wastes, regulated medical waste, sharps not properly packaged, animal carcasses, regulated -asbestos containing material as defined in 40 CFR 61, PCB waste as defined in 40 CFR 761, and wastes banned from disposal in North Carolina by G.S. 130A-309.10(f). 3. This facility is permitted to receive municipal solid waste generated within Union County. Waste must be transported for disposal to the Chamber's Development MSWLF (Permit No. 04-03), Uwharrie Regional Landfill (62-04) or BFI-Charlotte Motor Speedway Landfill V (13-04). Proposed changes to the service area and/or the disposal facility must be approved by the Section. 4. The permittee must not knowingly dispose of, or accept for transfer for subsequent disposal, municipal solid waste that is generated within the boundaries of a unit of local government that by ordinance: a. Prohibits generators or collectors of municipal solid waste from disposing of that type or form of municipal solid waste. b. A responsible individual trained and certified in facility operations must be on -site at all times during all operating hours of the facility, in accordance with G.S. 130A-309.25. 6. The permittee must develop, and use, a training and screening program at the facility for detecting and preventing unauthorized wastes from being accepted at the facility. At a minimum, the program must include: a. Random inspections of incoming loads or other comparable procedures- b. Records of all inspections. C. Training of personnel to recognize hazardous, liquid and other excluded waste types. d. Development of a contingency plan to properly manage any identified hazardous, liquid, or other excluded or unauthorized wastes. The plan must address identification, removal, storage and final disposition of these wastes. 7. The facility must not cause nuisance conditions. a. The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily in accordance with the approved Operational Plan- b. Waste must only be deposited on a "tipping floor" or directly into a transfer container_ Waste must not be stored on the "tipping floor" after operating hours. c_ Waste may be stored on -site, in leak proof transfer trailers, with watertight covers, a maximum of 24 hours except that a minimal amount of waste may be stored for a maximum of 72 hours when the facility is closed during a weekend or holiday. Storage of the waste must not cause any nuisance, such as odor or attraction of vectors. d. Effective vector control measures must be applied at all times to control any potential vectors including flies, rodents, insects, and other vermin. e. Control measures must be utilized to minimize and eliminate visible dust emissions and blowing litter. i) Fugitive dust emissions are prohibited. ii) Windblown materials must be collected by the end of day and no windblown material may be allowed to leave the facility boundary. 8. All water that comes in contact with solid waste, including vehicle wash -down water, is Ieachate and must be captured and properly treated before release to the environment. a. The tipping floor must drain away from the building entrance and into the leachate collection system. 9. All sedimentation and erosion control activities must be conducted in accordance with the Sedimentation Control Act N.C.G.S. 113A-50, et seq., and rules promulgated under 15A NCAC 4. 10. Copies of this permit, the approved plans and all records required to be maintained by the permittee must be maintained at the facility, unless otherwise approved by the Section, and made available to the Section upon request during normal business hours. 11. The permittee must maintain a record of the amount of solid waste received at the facility, including daily records of waste received and origins of the loads. Scales must be used to weigh the amount of waste received. The daily records are to be summarized into a monthly report for use in the required annual reports. 12. On or before August 1 annually, the Permittee must submit an annual facility report to the Solid Waste Section, on forms prescribed by the Section. a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual facility report must list the amount of waste received in tons and be compiled_ i) On a monthly basis. ii) By county, city or transfer station of origin. iii) By specific waste type. iv) By receiving disposal facility. v) By diversion to alternative management facilities. C. The completed report must be forwarded to the Regional Environmental Specialist for the facility by the date due on the prescribed annual facility report form. d. A copy of the completed report must be forwarded to each county manager for each county from which waste was received the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the Regional Environmental Specialist by the date due on the prescribed annual facility report form. Wastes received and product stored shall be maintained in reasonably sized piles with adequate fire breaks and lanes in accordance with the approved operational plans and the pertinent rules. 15. Surface water shall be diverted from all operational and storage areas to prevent standing water in operational areas and under or around storage piles. Water that comes in contact with solid waste shall be contained on -site or properly treated prior to discharge. 16. These areas shall be operated and maintained with sufficient dust control measures to minimize airborne emissions and to prevent dust from becoming a nuisance or safety hazard. 17. Effective vector control measures shall be applied as necessary to control flies, rodents, insects, or vermin. 19. The facility must manage all operations according to all applicable statutes and rules of the State of North Carolina. Operational Conditions — White Goods 20. The facility is permitted to receive white goods as defined in North Carolina General Statute Article 9, Chapter 130A-290(44). 21. The facility must manage white goods according to the Operation Plan included in Attachment 1, Part 11, "List of Documents for the Approved Plan". This document is included in the approved plan. Any revisions to the approved plan shall be approved by the North Carolina Division of Waste Management (DWM), Solid Waste Section, prior to implerhentation. 22. White goods collection areas shall provide for the proper removal of chlorofluorocarbon refrigerants. Operational Conditions —Tires 23. The facility is permitted to receive tires and scrap tires as defined in North Carolina General Statute Article 9, Chapter 130A-309.53(6) & (7).
