Dear Mr. Auman:
You have our approval to place fill material and flood 4.5 acres of wetlands or waters for the purpose
of constructing a pond at NC 73, as you described in your application dated 14 August 1996. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 2671. This certification allows you to use Nationwide Pennit Number 26 when it is issued by the
Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local pennits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

wetlands near West End, Moore County, North Carolina. DEM ID # 960784.
SUBJECT:
Staffbio1ogists with the North Carolina Wildlift' Rt'soul'ces Commission have reviewed
the su~iect application with respect to anticipated project impacts on aquatic habitats. Our
comments are pnwided in accordance with certain provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as omended; 16 U.S.C. 661 et seq.), and section 401(b) of the
Clean Water Act of 1971 (ns amended), and North Carolina General Statutes (O.S. 113-131 ot
scq.).
The project involves the planned construction of a 4.5 acre fum1 pond in Moore County
near Pincbluff. The applIcant proposes to flll 0.5 acres and flood an additional 4.0 acres of
wctlandlJ for pond construction on the project site which contaIns an estlmated total of 167 acres
ofwellund3. The p<mu iIJ proposed (Ot pea~h tree irri"ation and livestock water supply.
This project is located in the headwaters of a small tributary to the Little River which is
classiJled us Hi~h Quality Walers (Ws.m HQ). The sma.1l stream pmpnsed for flnnding is a
direct source of water supply for the Little River and is important to maintaining good water
quality. Little River is fl medium sized stream with a highly diverse fishery and torested
swamplands. We are concerned that construction of the ponds may increase stream
sedimentation. We arc also concerned that pesticide applications on the watershed may Clluse
increased pesticiuc levels in Little River dvwnstream vf the site, The applicant has not offered
mitigation for wctblIltllo~scs.
Th" ltpplicanl'~ properly is wilhin an area that has been known to provide habitat for the
federally lmu slate tmdan~ered Red-cockaded woodpecker (l'icoides borealis). Conversations
with Mr. Mark Cantrell of the U oS. Fish and Wildlife Service indicate that there are no known
active culonies on the property but there are still some foraging areas at the upland tringes of the
proposed pond ~md luljlll,:ent. areus. However, we do not believe there will be signit1cant impacts
to RcdMcuckaded woodpeckers if disturbance to suitable pine areas is mlnimi:l.eJ.

We offer the following recommendations to protect the wetlands and downstream and
adjacent habitats:

Retain or establish a 1 OO-foot natural vegetated butler adjacent to each side uf p~rt,"nial
strc:UI11R Ilnd a SO-foot buffc:r udjucent to wetland areas aml intennittent streams. Native
trees and shrubs should be retained or establillhed in the buffers.

Reguire thut all remaining wetlands on the site be protected by dtl~d restrictions from
addItional flU, druining, flooding, excavation, or other impacts by current or future
owners.
4.
Runoff from areas treated with herbicides, pesticides nnd fertilizers should be filtered
throu~h Bra.C;~cd swales llnd routed to the irrigation pond llnd not he allowed to drain
directly t.o strewn! or vegotated wetlands.
The appHcDnt should work to minimize impacts to adjacent upland areas that may be
suilable habitat for the endangered Red-cockaded woodpecker.

I/we would like to request of the Department of the
Army a Nationwide 26 Permit to construct one farm pond. The
purpose is for irrigation and livestock watering. The
Natural Resources Conservation Service and the Moore Soil
and Water Conservation District have determined that
approximately 4.5 acres of wetland will be impacted by this
project. They have also provided me/us with information
concerning my/our specific site. The information is as
follows:
1) TOPOGRAPHIC MAPS of the area: (see attached)

3) SOILS MAP: (see attached)
4) WETLANDS IMPACTED by this project: 4.5 acres

I/we understand that a Nationwide Permit, if
granted, will be invalid if impacts to any Federally
threatened or endangered species will occur as a result of
this work. I understand that species of this nature have
been identified in Moore County.
By copy of this letter I am also notifying the NORTH
CAROLINA DEPARTMENT OF ENVIRONMENT, HEALTH AND NATURAL
RESOURCES and the U.S. FISH AND WILDLIFE SERVICE of my

DESCRIPTION OF PROPOSED WORK
The Moore Soil and Water Conservation District has provided
a preliminary survey of this pond site for planning
purposes. We have determined that this project will be of
dam safety size, therefore, it will have to be permitted by
the state Dam Safety Engineer. Due to the work and time
involved no engineering design will be provided until
permits to convert wetlands are obtained. If and when these
permits are obtained, the NRCS engineering staff has agreed
to provide assistance in the design and construction
supervision of this project.
