Tier One Response due to concentrations of Fecal Coliform ((FC) 2900 CPU/100ml) detected in sample collected from SDO-4 on 11/26/2014. Elevated FC levels as identified in sample SDO-4 collected on 11/2612014 are very likely not attributed to landfill activities rather originating from wild animal waste in and around the SDO-4 drainage. In fulfillment of permit requirements this Tier One response was initiated in response to the analytical benchmarks. A sample of raw leachate (water that has percolated through the waste mass) was taken from the leachate lagoon in flow on 12/8/2014. -This sample was tested for fecal coliform and was found to have only a trace, I 1 CFU100ml. This result offers additional evidence, to confirm the source is not originating from the landfill activity but instead comes from wildlife activity. However as recommended in a letter received from NCDENR Land Quality dated January 21, 2015 Iredell County will initiate"Tier One response as detailed below. Identification and Evaluation of Potential Causes of Exceedance On 1/28/2015 area between SDO4 and the landfill was inspected by David Lambert. and Teddy Boller of Iredell County. During the inspection, possible causes of the exceedances were identified, evaluated, and specific physical improvements were considered which may potentially decrease concentrations of the contaminant of concern. The drainage area upstream of SDO4 is controlled by an extensive E&SC system previously approved by NCDENR Land Quality Section. The E&SC 9B system upstream of O-4 consists of a ditch line and plastic culvert pipe that discharges onto a rock overflow spill way. The benchmark exceedarice at this specific outfall is likely not attributed to landfill activities but rather originating from wildlife excrement that has been consistently observed between the outfall and the landfill. Fresh raw/untreated leachate samples collected from the landfill leachate collection system at the lagoon (LAGOON) has never exceeded the benchmark. Levels of FC in the LAGOON samples in colonies per 100 ml were (<1 on February 26, 20,13 and i 1 'on„December 18, 2014) which are much lower than detected in sample SDO-4 (2,900 on November 26' 2014) Which indicates leachate is likely not a significant enough source of FC to contribute to the levels identified in sample SDO-4. Concentrations of FC in raw leachate samples at other lined facilities has also been consistently lower in relation to stormwater outfall samples and the benchmark. A full Tier One response for this FC exceedance.at SDO-4 can/will not be prepared at this time since the source of FC as identified in SDO4 is likely not attributed to landfill activities and controls/improvements to mitigate'FC levels at a landfill are realistically impractical. The facility plans to continue following permit conditions including semi-annual analytical/qualitative monitoring. In the future raw leachate samples may also be tested for stormwater sample comparison purposes. If the NCDENR does not accept this alternative source demonstration in lieu of a Tier One response please provide us a list of acceptable FC control measures or case studies which have been proven effective in a landfill setting. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HOW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. (MESCO) has prepared a written response as requested by the Division of Water Quality (DWQ) in the notice of deficiencies report dated October 3, 2007. The response pertains to two (2) separate permits for activities that occur at the same contiguous facility. NCG200434 (Scrap Metal Permit) The Iredell County Landfill facility operates a white goods temporary storage area. The scrap metal/white goods storage area is required by the NCDENR. The white goods are accepted upon a paved area comprising less than 0.25 acre. All refrigerants are reclaimed and the appliances are placed directly into dumpsters and than taken off site when full. Since this facility is primarily a landfill and the metal recycling activity is a secondary, non -voluntary, not for profit endeavor it is categorically not required to maintain a NCG200000 permit. The exemption of the NCG200000 permit for facilities that are.not "primarily" engaged in the scrap metal processing activities have previously been verified by Ms. Lau of the Central Permitting office and Mr. Warren 'of the Washington regional office. Since the NCG200000 permit is not required for this facility all of the deficiencies in the compliance evaluation report including the development of a SPPP are inapplicable. We request that the the permit NCG200434 be rescinded and the deficiencies pertaining to this permit be stricken from the facility record. NCG120042 (Landfill Permit) The Iredell County Landfill facility primarily operates a Subtitle D Lined MSWLF and an unlined C&D Landfill. Vehicle and equipment maintenance in support of the landfill is also completed within a covered maintenance building located within the facility property. The deficiencies, concerns and comments concerning the NCG120042 permit are addressed below. All sedimentation basins were designed and constructed to withstand a 25 year storm as required by the Solid Waste Section. Therefore it is very rare that any of the basins will discharge stormwater into the surface waters surrounding the facility_ All outfall numbering is now consistent and future discrepancies will be avoided. The county is also contemplating placement of signs at the basins in order to avoid any future. confusion. Although some basins and outfalls are located from closed and stabilized areas we contend -that it is less confusing to remain consistent and visually monitor all of the basins especially when he active landfill areas change locations. Further by consistently monitoring all basins the facility can determine if any releases have occurred that would potentially impact the both the ground water and surface waters surrounding the landfills. A new Subtitle D Lined MSWLF Phase 4 -is about to be constructed. The approved erosion and sedimentation plan will be implemented during construction until the area is stabilized with ground cover. Upon commencement of operation the basin(s) collecting any stormwater originating from the new landfill will be numbered and monitored accordingly. The sediment basin that was observed to be compromised by a storm event has been repaired by regrading, enlarging, and replacement of gravel. All basins in the future will undergo routine maintenance and will be immediately repaired when needed. The facilities maintenance area now uses greater than 55 gallons of new oil when averaged over a year period. All maintenance is completed within the confines of a covered building and waste oil is retained and recycled or used as a fuel oil for on site heating. All stormwater originating from the maintenance building, parking areas, and the paved access road flow to a curb gutter in the far north east portion of the facility. The stormwater combines with runoff originating from the basin west of the baler facility that contains runoff from only the roof. The stormwater flows within a culvert which discharges into a tributary of Fourth Creek. This outfall will be both qualitatively and analytically monitored for now on unless the arithmetic oil consumption mean drops below the requirement. MESCO completed both the analytical and qualitative monitoring of the outfall during a representative storm event on October 25, 2007. The analytical results are pending but the qualitative results were good with no visual indication of pollution originating from the maintenance building. Analytical Monitoring Due to the designed capacity of the sediment basins/ponds to withstand a 25 year storm they very rarely discharge. MESCO inspected all of the basins during an intense representative rain event on October 25, 2007 and none of the basins were discharging and appeared as though they have not for a long time. The maintenance building area is the only location that is not controlled with an erosion'control device. Since the basins very rarely discharge and the drought conditions the region is experiencing collection of effluent for analytical monitoring will likely not occur very often except for the outfall serving the maintenance building. Iredell County has received all of the sampling containers and instructions and will complete the analytical monitoring per the permit requirements if a representative storm event occurs that yields effluent. Qualitative Monitoring Since the stormwater at the facility is controlled by sediment basins/ponds that are very large in order to withstand a storm in excess of a 25 year event they very rarely discharge. Qualitative monitoring will be conducted per the permit requirements and recorded for the effluent and not the standing water in the basins. If the basin is not discharging it will be noted in the facility record book(s). i The Iredell County Solid Waste Facility is a very well run operation that is dedicated to protecting the environment. They strive to ensure that all permit requirements are consistently met and are always looking for ways to improve. The facility will strive to stay in complete compliance with all requirements set fourth in NCG120042.
