"x certify, under penalty of law, that the storm water outfalls covered by this Permit
have been tested or evaluated for the presence of non -storm water discharges under
my direction or supervision in accordance with it system designed to assure that
qualified personnel properly gather and evaluate the information submitted. Based
on my inquiry of those persons, to the best of my knowledge and belief, no non -
permitted discharges of non -storm water enter the storm water outfalls covered by
this Permit because of activities accurj4ng at this facility" {as specified in Part 11,
Section A, Paragraph 1(e) of the Permit).
Methods of Evaluation Used:
1. Review of building and site plans.
2. Visual inspection of the storm drain system.
3. Observation of outfalls on a dry day that was preceded by at least 72 hours of
dry weather.
4. Interview with facility personnel.

Comment: The pipe has been removed from the unnamed tributary to Lyle Creek
which allows for sheet flow to the stream (no outfall designation needed). The only
outfall is the discharge pipe from the stormwater basin located behind the WWTP. All
stormwater from the treatment area of the VWVf P is conveyed to the basins.

In accordance with youK. application for a discharge permit received on April•21, 2009, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state-
NPDES :general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-2I5.1 and the .Memorandum of Agreement between North Carolina and the
US Environmental Protection -Agency dated October 15, 2007, (or'as subsequently amended).
Please take notice that this certificate of coverage is nottransferable except after notice to
the Division of Water Quality. The Division of Water Quality may. require modification or
revocation and reissuance of the certificate of coverage.
Per the requirements of the Catawba Riparian Buffer Rule, all stormwater drainage from
portions ofthis site that have been. constructed after June 30, 2001 must be'dikfi rged through a
correctly'designed level spreader or another device that meets diffuse flow. requirements per 15A
NCAC 2B .0243. Diffuse flow requirements are described in Chapter 8 of the North Carolina
Stormwater BMP Manual; available at: http://li2o.enr.state.nc.us/su/bm forms.htm
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources,
Coastal Area Management Act or any other federal or local governmental permit that may be
required.

We've received an NOI from City of Conover !Northeast Wastewater Treatment Plant for their
site in Conover (Catawba County) for coverage of their treament facility under NCG13. The
site discharges stormwater into Lyle Creek (C). The NOI is attached.
Does the Mooresville Regional Office have any concerns about issuing this facility a COC for
this general permit, and are there any potential impacts to wetlands? If we don't receive any
objections, we'll issue the COC in 30 days.

Mr. John Lesley and Ms. Donna Hood of this office conducted an inspection during a rain event on March
27, 2009 at the City of Conover NE WWTP. The inspection was conducted in response to correspondence
received from Mr. Terry Lail, Environmental Coordinator, informing the Division that no application for a
stormwater permit would be made on the basis of an engineering study dated May 13, 2003 by AMEC Earth
and Environmental, Inc. Mr. Evan Rubins accompanied Mr. Lesley and Ms. Hood on the inspection, The
findings of the inspection are as follows:
I. The Conover NE WWTP has a design flow of > 1.0 MGD.
2. Stormwater was collecting on the paved surface outside the gate and had formed a point source
discharge to the tributary of Lyle Creek.
3. The stormwater "sedimentation basin is designed with an outlet to Lyle Creek.
4. The Engineering Study states tliii7k3 ere are "no point source discharges of stormwater runoff into a
receiving stream".lrTYusjis not correct.
5. The Engineering Study 'states that; `stormwater runoff is conveyed to five sedimentation basins which
allow the stormwate!tolpercolate that.','-stormwater
the soil and groundwater table" The inspection found that only
one "sedimentation' -'-;basin was r'ceiving stormwater. This basin is constructed with a discharge pipe to

Be advised that, based on the findings of the subject inspection, the City of Conover is
required to make application for a Stormwater Permit by filing a Notice of Intent to discharge
stormwater by no later than April 15, 2009. Failure to file the Notice of Intent may result an
enforcement action being taken against the City of Conover.
