Training has been documented.
The facility is studying the feasibility of a permanent NaOH feed system (an A to C has
been submitted for approval). The pilot facility does not have adequate containment in
place; however, the main storage tank (5,500 gallons) only contains about 30 inches of
liquid 25% NaOH. Any spill that may occur would be likely to stay on the gravel area
due to the limited amount of NaOH in the storage tank. Be advised that containment
must be constructed adequate to hold the contents of the main storage tank and any
auxillary totes that may be used.

Comment: Alt outfalls included in the plan were monitored; however, two additional
outfalls must be added to the plan. A ditch carries storm water between the fence and
the chlorine contact chambers before it turns to discharge under the fence to the creek.
A second ditch carries stormwater from the area of the clarifiers to the fence and
discharges into a separate smaller stream prior to its confluence with the larger creek.

Comment: Alf outfalls included in the plan were monitored; however, two additional
outfalls must be added to the plan. A ditch carries storm water between the fence and
the chlorine contact chambers before it turns to discharge under the fence to the creek.
A second ditch carries stormwater from the area of the clarifiers to the fence and
discharges into a separate smaller stream prior to its confluence with the larger creek.

Our records indicate that you have been issued the subject Certificate of Coverage (COC)
under General Permit (GP) No. NCGI 10000 from the North Carolina Division of Water Quality to
discharge stormwater associated with industrial activities performed at your facility. The purpose of
this letter is to advise you of the importance of the GP and the liabilities in the event of failure to
comply with the terms and conditions of the GP. If you have not already done so, it is suggested that
you thoroughly read the GP. Of particular importance are Part II and Part 111, Sections A & B.
Part II is titled "MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED
DISCHARGERS". Part 11, Section A discusses the need to develop a Stormwater Pollution
Prevention Plan (SPPP), which includes, but is not limited to the following components: a site plan, a
stormwater management plan, a'spill prevention and response plan, preventative maintenance and
good housekeeping program, and employee training. Specific guidance as to the information to be
included in each plan is also listed in this Section. Section B sets forth the qualitative monitoring that
should be performed at all outfalls that discharge stormwater runoff. Section C establishes analytical
monitoring requirements for facilities that have vehicle maintenance areas and use more than 55
gallons of new motor oil per month.
Part III of the GP consists of general conditions and definitions consistent with all GPs, which
are applicable to your SW discharge. These conditions also include special reporting requirements in
the event of noncompliance, bypassing of treatment works (if applicable), and other conditions that
pertain to your stormwater discharge. In Part III, Section B (2), please note that GPs are not
transferable. If you, as the permittee, cease to need this COC (for example: your facility has closed),
then you should request that the COC be rescinded. It should also be noted that the GP requires that
any monitoring data be retained by the permittee for a period of three (3) years and made available to
a Division representative upon request. If you haven't already done so, please note that any analytical
and/or qualitative monitoring as required by this GP should begin upon commencement of your SW
discharge as a result of a representative storm event.

Failure to comply with the terms and conditions of any NPDES Permit may subject the
permittee to enforcement action pursuant to Section 143-215.6 of the North Carolina General Statutes
in the form of civil penalties of up to $25,000 per violation. Criminal penalties may also be
recommended for violations determined to be intentional or willful. If you find that you are unable to
comply with the terms and conditions of the GP, you should contact this Office immediately.
Lastly, when representatives from this Office contact you in order to conduct an inspection of
your facility, you should be prepared to demonstrate compliance with all terms and conditions
included in the GP. If an inspection is scheduled at your facility, the inspection will focus on
evaluating the following items (if applicable): Stormwater Pollution Prevention Plan, stormwater
outfall locations, a review of any qualitative and/or analytical monitoring data required by the GP,
and any other activities that may be required by the GP that are unique to your discharge. This
information should be readily available if requested by a Division representative.

Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and directs the
Environmental Management Commission of the Department of Environment & Natural Resources to
protect and preserve the water resources of the State. The Division of Water Quality (DWQ) has the
delegated authority to enforce adopted pollution control rules and regulations.
On April 2, 2008, Samar Bou-Ghazale of this Office conducted an inspection at the subject facility.
During this inspection, it was learned that this facility did not obtain a stormwater permit that is required by
G.S.143-215.1
Please be advised that G.S. 143-215.6A provides for a civil, penalty assessment of not more than
twenty-five thousand dollars ($25,000.00), or twenty-five thousand dollars ($25,000.00) per day when
the violation is of a continuing nature, against any person who is required but fails to secure a permit
required by G.S. 143-215.1. Penalties may also be assessed for any damage to the surface waters of the
State that may result from the Unpermitted discharge.
To comply with G.S. 143-215.1, you must submit a completed application form and supporting
fee to the Division for the stormwater discharges at Pilot Creek WWTP, facility for coverage under
Stormwater General Permit NCG110000. The application form and supporting fee should be completed
by May 15, 2008.

Not sure about: the "Pilot Branch of Potts Creek" as the USGS map we have doesn't
identify such a segment, but nevertheless, the WWTP is located on Potts Creek and it
discharges into Buffalo Creek. From conversations with Kings Mountain staff over the
years, it has been assumed that whoever named the WWTP when it was built mistakingly
thought Potts Creek was Pilot Creek - and the name just stuck. It is confusing, and
to be quite honest, RIMS probably should be amended to take out the reference to the
"Pilot Branch of Potts Creek" since such a segment doesn't: actually exist (at least
on any map we have it doesn't exist).
Whatever the case, feel free to issue the COC.

*Note: This WWTP is actually located on the Pilot Branch of Potts Creek according
to BIMS. Their map and mine do not identify any Pilot Branch, but BIMS mentions
it. This is not significant, but it is a little confusing.*
If you need any more info, give me a call. If you could send me a recommendation
to issue the permit by 6/12/2008, I'd appreciate it, so I can issue their COC. I
am not allowed to issue the permit until the respective regional office reviews
and comments back to me with a recommendation to isse the permit.
