Dear Mr. Kerbs:
This letter is in response to your letter dated May 31, 2011 regarding NOV-2011-PC-0332.
The City of Mount Holly hired a private contractor (Chris Heyward, State Utility Contractors -Monroe NC) to
install a bar screen at the Waste Water Treatment Plant (WWTP) located on Broome Street, On May 2"d, while
under construction, their Bobcat tractor had a hydraulic line fail. Their mechanic drove the Bobcat across the road
(see attached map) to fix the hydraulic line and in doing so, a small amount of hydraulic fluid deposited on the
road. The estimated amount is < 100 milliliters. We immediately put sand down to absorb what was on the road.
This sand application was cleaned up and disposed of properly. And then more sand was placed on the affected
area. The sand absorbed most of the fluid but left a stain on the road. A rain event of 0.23 inches occurred on
May 3rd A minimal amount of residual hydraulic fluid entered the catch basin closest to the initial spill.
On May 171h, we performed our SDO Report (see attached). Outfall # 2 is located approximately 260 feet from
the catch basin near the spill. No oil sheen was denoted at the outfall.
At our May 24"' inspection, Brad Anthony (Mount Holly's WWTP ORC) described our cleanup procedure to
John Lesley (NCDENR). John inspected the catch basin closest to the initial spill location. The drainage
structure had dirt/debris with some visual oil sheen. Following the inspection WWTP staff cleaned out all
dirt/debris in all the catch basins.
For additional information, attached are copies of our Stormwater Pollution Prevention Plan with the most recent
staff training sheet and our June 6'h Facility Inspection report.

Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection conducted at the
subject facility on May 24, 2011 by John Lesley of this Office. '
The report is being issued as a Notice of Violation (NOV) due to the failure to properly follow the City
of Mount Holly's Stormwater Pollution Prevention Plan. Documentation of illicit discharges is required by
NPDES General Permit No. NCG 110124. In addition notice was not given to the Department of Environment
and Natural Resources as required by the Oil Pollution and Hazardous Substances Control Act, GS 143-215.83
and GS 143.215.85 (a) and (b), as required for the discharge of any amount of oil to surface waters, including
any sewer or surface water drain. The cited violation had not previously been cited under either a Notice of
Violation (NOV) or a civil penalty assessment document. Pursuant to G.S. 143-215.6A, a civil penalty of not
more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails
to -act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-
215.1. Furthermore, violation of the Oil Pollution and Hazardous Substances Control Act may also be subject
to a civil penalty assessment.

addressing the above noted violation. In responding, please include actions taken for additional cleanup of the
spill site (removal of oil contaminated soil from the drain etc.) and measures taken to ensure proper
documentation and reporting procedures for illicit discharges in the stormwater collection system.

New site maps and updates to the plan were made on 8/23/2010.
Stormwater Facility Inspection Program: a stormwater facility inspection has not been
performed in 2011. Be advised that a the inspection of the stormwater collection system
must be done twice yearly at least 60 days apart, one in January - June and one in July
- December 2011. Oil stains were found during the site inspection in a stormwater
collection drain located near the maintenance shop area. The City's contractor
contained the spill in the storm drain; however, the oil spill was not documented as
required by the permit. Contaminated soil was present in the stormwater collection
drain. All contaminated soil must be removed immediately. Furthermore be advised
that any amount of petroleum or other hazardous material spilled to surface waters must
be reported to the Department within 24 hours.

NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of.Agreement between North Carolina and the US
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after. notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, Coastal Area Management Act or any other federal or local governmental

new permittee during this'NOI review, but it affords you the opportunity to log
the permit into your regional database and add the facility to a future monitoring
