CMU has implemented improvements to the stormwater drainagelcontainment around the sludge loading and storage areas by the installation of additional curbing (sludge storage area) and trench drains (upgradient driveways). This Office commends these improvement efforts initiated by CMU and the facility staff. All stormwater outfalls were accessible and the discharges from Outfall #3 and Outfall #6 were clear with no foam. No discharges were observed from the remaining stormwater outfalls. The stormwater drainage area (Outfall 006) had been properly remediated of the sludge accumulations noted in the previous inspection Several small accumulations of sludge were observed in the vegetated area adjacent to the truck scale and a downgradient stormwater drain in the Outfall 006 drainage system. The facility staff should initiate the appropriate corrective actions (including site cleanup) to ensure all sludge is contained and properly disposed. Tracking #: NOV-2008-PC-0040 Dear Mrs. Allocco: This letter is in response to the above Notice of Violation (NOV) letter dated January 1 G,' 2008 and received by me in our office on Monday, January 28, 2008, As stated in the NOV letter, "This report,is being issued as a Notice of Violation (NOV) due to the discharge of sludge into a stormwater drainage system and the facility's failure to implement a good housekeeping program as part of the Stormwater Pollution Prevention Plan which are violations of the subject Stormwater Permit and North Carolina General Stature (G.S.) 143-215.1....... We are contesting this NOV based on the facts below: During an internal staff ston-nwater inspection on 12/27/07, staff discovered that there was a trench drain near the biosolids storage pad and the loading area that was connected to a storm water catch basin that leads to a pipe outlet on the other side of the fence. Per the existing Stormwater Pollution Prevention Plan, this is labeled as Outfall No. 12. This outfall discharges to a man-made ditch that flows to a sediment trap installed during construction of the expansion of the Mallard Creek WRF. During our internal inspection we discovered a small amount of material at the outfall and approx 30 feet down the ditch. We could not really determine if this material was biosolids or some other inert material. There was no evidence of any solids found near the sediment trap either immediately upstream or downstream. Mallard staff took immediate steps to correct this situation and prevent any further possible runoff from the solids storage from entering the storm drain system. The initial corrective action included plugging the trench drain and pumping down the sediment trap just as a precaution. The Mallard staff installed a sump pump at the trench drain to pump stormwater from the low area at the plugged drain to a plant drain for treatment. The pump was necessary in order to prevent stormwater from rising above, the curb and entering a near -by catch basin. The purpose of the pump was for stormwater CHARLOTTE-MECKLENBURG UTILITIES Environmental Management Division 4000 Westmont Drive Charlotte, NC 28217 PH: 704/357-1344 collection and not to pump solids. This took place on December 27, 2007. A qualitative monitoring report was completed for all current outfalls including Outfall No. 12 on 12/28/07 (please see attached report, page 24). The monitoring report included a listing and description of indicators of stormwater pollution as required. At the same time, we are in the process of completing a project to improve the wash down area of the biosolids facility thus cleaning the area more effectively and capturing the residual solids for treatment through the plant. With the plug in place to prevent water from going through the drainage system, it is very difficult to maintain the sludge loading area until the piping system can be redone to drain to the head of the plant. However, we felt that first priority was to ensure that no more solids would enter the storm water system. This was all brought to Mr. Wes Bell's attention during his inspection of the Mallard WRF on January 7, 2008. During the inspection, Mr. Bell and the plant supervisor Mr. Darrell DeWitt viewed the material on the other side of the drainage pipe but did not verify what it was but that it should be removed. The material was removed on January 8, 2008. The amount of material collected was less than 500 gallons. This information was reported to Mr. Wes Bell on January 8, 2008, in a phone call to the Mooresville Regional office by Mr, Darrell DeWitt. . An engineering firm, Black & Veatch, who did the original design of the storm piping and drainage system as part of the Mallard WRF expansion was also contacted upon discovery of the drainage problem. We requested that they complete engineering work to redesign the piping system. As you are aware, as the City of Charlotte, we are required to develop contract documents with the consultant to complete this work. This was in progress beginning on January 15, 2008, and the scope was finalized on January 22, 2007. Black & Veatch is actively working on the re -design of the piping system. The cost of engineering work is estimated at $20,000. Charlotte Mecklenburg Utilities worked in good faith to make corrections upon discovering this drainage problem at the Mallard Creek WRF. Although there were some temporary housekeeping problems that arose, we felt that it most important to prevent any possibility of runoff from the biosolids storage area from entering the stormwater system. We believe there should be consideration for allowing reasonable time to make corrections without being penalized. Regarding the two secondary containment structures (sugar water storage tanks) leaking. These tanks are not leaking. In fact, there was seeping rainwater not sugar water. We also have place portable pumps at each containment structure so we can keep the water pumped out. Further, on January 3, 2008, the City of Charlotte Stormwater Services completed a stormwater inspection of the Mallard Creek WRF as part of their NPDES permit requirements. Section B sets forth the qualitative monitoring that should be performed at all outfalls that discharge stormwater runoff. Section C establishes analytical monitoring requirements for facilities that have vehicle maintenance areas and use more than 55 gallons of new motor oil per month. Part III of the GP consists of general conditions and definitions consistent with all GPs, which are applicable to your SW discharge. These conditions also include special reporting requirements in the event of noncompliance, bypassing of treatment works (if applicable), and other conditions that pertain to your stormwater discharge. In Part III, Section B (2), please note that GPs are not transferable. If you, as the permittee, cease to need this COC (for example: your facility has closed), then you should request that the COC be rescinded. It should also be noted that the GP requires that any monitoring data be retained by the permittee for a period of three (3) years and made available to a Division representative upon request.
