Tracking 4: NOV-2008-PC-0102 Enclosed is a copy of the Compliance Evaluation Inspection Report for the stormwater inspection conducted at the subject facility on January 30, 2008 by Mr. Wes Bell of this Office. This report is being issued as a Notice of Violation (NOV) due to the facility's failure to update and implement the Stormwater Pollution Prevention Plan which are violations of the subject Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in the Stormwater Pollution Prevention Plan Section of the attached report. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per violation, per day, may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215,1. Wastewater solids (adjacent to the new RAS pump station) and bar screenings (adjacent to the new bar screenlheadworks area) had been discharged onto the ground without adequate cleanup. The facility staff had not incorporated any barriers or diversions around the leaking RAS pump station structure to prevent any stormwater contamination. The inspection also revealed potential stormwater impacts at the uncovered grit collection dumpster and the leakages observed at the new bar screen area.
