on January 26, 2009 by John Lesley.
Comment: Qualitative monitoring was performed on 3/7/08. The qualitative monitoring
required in the September -November time period was not conducted.
Response: This is a new area for the WWTP and was overlooked. I have established a
monitoring schedule and it has been listed on a calendar so it won't be over looked. It
will be done on the first rain event for the Spring and Fall.

Regarding the storm water issues at 2214 N. Graham St., we propose the
following:
1. In an effort to mitigate "residence time of material on the ground"
A. Additional personnel will be hired. Two additional personnel have
been hired since the site visit May 22, 2018.
B. A portable sort belt resulting in efficient processing will be
implemented. This is under current construction. Completion
August 20, 2018.
2. The outdoor material is in the process of being removed from the blue roll
off. Once this material is caught up, the roll off will be removed. Any
additional roll offs that are for the storage of solid waste will be placed in
the pit. This will not allow any storm water that has touched the solid waste
roll off to leave the property. Completion Date July 1, 2018
3. A concrete berm will be placed on the front perimeter of the property. This
will have a drain and catch a.11 storm water exiting the front of the property.
It will be drained back into the pit. This berm will be 12" in height.
Additionally, it will cover the front gate where the trucks enter and exit.
Project completion June 28, 2018.
4. The front half of the property will be graveled with a crush and run material
in an effort to mitigate any dirt that may be on the truck tires as it exits the
property. Completion Date is July 15, 2018

The inspection was conducted with Chad Broadway / Charlotte Mecklenburg Stormwater Services. Based on the inspection
Cynthia Payne / Full Stream Recycling was instructed to take all reasonable measures to prevent stormwater from leaving
the site. Several options were discussed during the inspection, but to prevent further action from this office a plan and
schedule must be submitted to the NCDEQ Mooresville Regional Office by June 8, 2018. If all reasonable measures have not
been1aken to prevent stormwater from leaving the site, this office has the option to request that Full Stream Recycling apply
for an Individual State Stormwater Permit. Should you have any questions please contact James Moore at 704.235.2138 or

5. All sort operations will be moved to the back eighty percent of the
property. The front twenty percent of the property with the exception of a
non- solid waste roll off will be dormant. This is to serve as a buffer zone
and to mitigate all contaminants from exiting the property. Project
completion July 15, 2018
6. The fence line will become clear of debris and remain debris free.
Project Completion July 25, 2018. This requires a fence company and
additional time for additional personnel to complete this task. Hence the
longer time line and consideration for the July 411 Holiday.

Staff from Charlotte -Mecklenburg Stormwater Services (CMSWS) conducted industrial facility
inspections at your 2214 North Graham Street in Charlotte, NC on September 29, 2015, March 10,
2016 and May 31, 2016. These inspections report forwarded to this office noted that your facility
accepts an unsorted stream of recyclables generated by a private entity for on -site sorting and transfer.
Stormwater flows through the site by sheet flow, discharging at two loosely defined outfalls at the
facility entrance and rear fence.
As a result of the site inspections the following violations, detailed below, are noted:
1. Operating this facility without an NPDES Stormwater permit.
Item I. Operating a facility without a stormwater permit
G.S. 143-215.1 requires that certain industrial facilities must obtain and operate under an NPDES
permit for stormwater discharges. NPDES general permit NCG 130000 has been established
pursuant to G.S. 143-215.1 for discharges of stormwater to surface waters of North Carolina. This
general permit is applicable to owners or operators of stormwater point source discharges associated
with activities classified as establishments primarily engaged in activities classified as the wholesale
trade of non-metal waste and scrap [standard industrial classification (SIC) 5093]. We confirmed
that this facility was operating at the time of inspection.
Required Response
Accordingly, you are directed to respond to this letter in writing within 30 calendar days of receipt of
this Notice. Your response should be sent to the attention of James Moore at the letterhead address.
Your response should address why coverage has not been obtained under Industrial Stormwater permit
NCG130000 for the noted Full Stream Recycling stormwater discharges. If you feel that a permit is not
needed for your facility, please provide justification why coverage under the general permit is not
required. If permit coverage is required for the noted facility, a NOI should be submitted within
30 days of the date of this letter.
Thank you for your attention to this matter, This Office is considering sending a recommendation
for enforcement to the Director of the Division of Energy, Mineral and Land Resources (DEMLR)
regarding these issues and any future/continued violations that may be encountered. This office
requires that the violations, as detailed above, be abated immediately and properly resolved.
Environmental damage and/or failure to secure proper authorizations have been documented on the
subject tract as stated above. Your efforts to undertake activities to bring the subject site back into
compliance is not an admission, rather it is an action that must be taken in order to begin to resolve
ongoing environmental issues.
Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a civil
penalty assessment of up to a maximum of $25,000.00 per day for each violation. Your above -
mentioned response to this correspondence, the degree and extent of harm to the environment and
the duration and gravity of the violation(s) will be considered in any civil penalty assessment

Good morning Zahid,
I was reviewing my industrial monitoring data and I think I forgot to email you the attached documents when they were
mailed to the facilities two weeks ago. Please find attached monitoring results and letters for Blythe Construction — Old
Nations Ford Road plant (NCG160115), Full Stream Recycling — 2214 North Graham Street (unpermitted), and Elan
Trading (NCG200461).
As you'll see from the results, Blythe Construction had extremely high concentrations of TSS, turbidity, copper, zinc, and
BOD. The samples also showed elevated levels of chromium and lead. I conducted a follow-up inspection at the facility
yesterday, and it looks like the facility is willing to significantly increase the size of their stormwater basin to provide
additional treatment. The current basin is approximately 750 square feet (with minimal depth) to treat approximately 7
acres, so increasing the basin to a reasonable size will likely make a large improvement in these results.
I'd like to speak with you at some point about asphalt facilities in general. It seems like every asphalt facility we inspect,
including those I inspected when I worked for you, always claim no discharge for their analytical monitoring. At this
point, I'm assuming the facilities talk to each other and probably think they can save money and reduce their regulatory
requirements by continuing to document "no discharge". If we continue seeing this, I think it would be appropriate for a
Notice of Violation to be issued for permit violations. I'd be interested to get your thoughts on this and see what
supporting facts we may need to gather to pursue a NOV.

For Full Stream Recycling, the bacteria was not as high as I would have assumed but the BOD/COD were both off the
charts. Metals were also elevated on this site. I've prepared a brief inspection report stating the facility appears to be
operating in the same manner as when previous inspections were conducted. It's attached here for the State NOV we
discussed, and the report for the previous full inspection of the facility is attached as well.
Elan Trading is a metal recycling facility and, unsurprisingly, has very high concentrations of metals. Based on an
inspection conducted last year, the facility had permit violations for not conducting monitoring. Ken Friday will be
conducting a follow-up inspection at the facility this month and I will be attending as well.
Finally, I've also attached a brief inspection report for Lucas Concrete stating in the comments that a visual inspection of
the facility shows them to still be operating in a manner consistent with the NCG14 permit. As we discussed for this
facility and Full Stream Recycling, the individual inspection items are all listed as not evaluated. I've also attached the
report from the last full inspection conducted in April of 2015, as well.

Graham Street. in Charlotte, North. Carolina. The monitoring was conducted under
authority granted'by Charlotte City Code Chapter 18, Section 18-82,
The monitoring was also iconducted. as part of -a cooperative °woi sing agreement between
'Mecklenburg County and the North Carolina Department: of Environmental Quality
(NCDEQ) — Division of Energy, Mineral and Land Resources (DEMLR). NCDEQ,
DEML'R,has been copied. on this' reportand made aware of monitoring results regarding
the facility's,NPDES permit.
Total rainfall during the rain event in which samples were collected at your'facility was
0.83 inch. Rainfall data was;reported by the United States Geologic Survey. (USES) real-
time station. CRN-15 (Charlotte -Mecklenburg Government: Center). CMSWS sampled
stormwater runoff from an outfall near:North Graham Street.
A summary table of results.,is attached to this report. Monitoring results were compared
to local and state stream standards (CMSWS Action Levels 'and,North Carolina Water
Quality Standards), Since the stormwater, sample was not collected from the stream, the.
stream standards do not necessarily apply; however, these standards can be Used to
indicate the potential of polluted runoff from. the facility to'impact the receiving stream.
The results indicate significantly elevated concentrations of biochemical oxygen demand
(BOD), chemical oxygen demand(COD), and conductivity. Compared to.hikoricaNata.
from previous industrial monitoring in Mecicleriburg County, BOD and COD were
exceptionally,high. The measured BOD from your facility was :approximately 11 times

Facility Description: Full Stream Recycling is located at 2214 North Graham Street on approximately 0.72 acre. The
facility accepts an unsorted stream of recyclables generated by a private entity for on -site sorting and transfer.
File Review/History: Charlotte -Mecklenburg Storm Water Services (CMSWS) has previously conducted a facility
inspection at Full Stream Recycling on 9/29/2015. CMSWS has conducted complaint -based inspections at the facility on
1114/2014, 7/24/2015, and 10/13/2015, An inspection by CMSWS and the North Carolina Department of Environmental
Quality (NCDEQ) was conducted at the facility on 3/1012016. The facility has been notified during each of the referenced
inspections of the need to apply for a NPDES stormwater permit.
Inspection Summary: At the time of inspection, the facility continues to operate in a manner consistent with the
non-metal waste recycling activities described in the NCG130000 general permit.
