These inspections report forwarded to this office noted that your facility accepts an unsorted stream of recyclables generated by a private entity for on -site sorting and transfer. Stormwater flows through the site by sheet flow, discharging at two loosely defined outfalls at the facility entrance and rear fence. As a result of the site inspections the following violations, detailed below, are noted: 1. Operating this facility without an NPDES Stormwater permit. Item I. Operating a facility without a stormwater permit G.S. 143-215.1 requires that certain industrial facilities must obtain and operate under an NPDES permit for stormwater discharges. NPDES general permit NCG 130000 has been established pursuant to G.S. 143-215.1 for discharges of stormwater to surface waters of North Carolina. This general permit is applicable to owners or operators of stormwater point source discharges associated with activities classified as establishments primarily engaged in activities classified as the wholesale trade of non-metal waste and scrap [standard industrial classification (SIC) 5093]. We confirmed that this facility was operating at the time of inspection. Required Response Accordingly, you are directed to respond to this letter in writing within 30 calendar days of receipt of this Notice. Your response should be sent to the attention of James Moore at the letterhead address. Please find attached monitoring results and letters for Blythe Construction — Old Nations Ford Road plant (NCG160115), Full Stream Recycling — 2214 North Graham Street (unpermitted), and Elan Trading (NCG200461). As you'll see from the results, Blythe Construction had extremely high concentrations of TSS, turbidity, copper, zinc, and BOD. The samples also showed elevated levels of chromium and lead. I conducted a follow-up inspection at the facility yesterday, and it looks like the facility is willing to significantly increase the size of their stormwater basin to provide additional treatment. The current basin is approximately 750 square feet (with minimal depth) to treat approximately 7 acres, so increasing the basin to a reasonable size will likely make a large improvement in these results. I'd like to speak with you at some point about asphalt facilities in general. It seems like every asphalt facility we inspect, including those I inspected when I worked for you, always claim no discharge for their analytical monitoring. At this point, I'm assuming the facilities talk to each other and probably think they can save money and reduce their regulatory requirements by continuing to document "no discharge". If we continue seeing this, I think it would be appropriate for a Notice of Violation to be issued for permit violations. I'd be interested to get your thoughts on this and see what supporting facts we may need to gather to pursue a NOV. For Full Stream Recycling, the bacteria was not as high as I would have assumed but the BOD/COD were both off the charts. Metals were also elevated on this site. I've prepared a brief inspection report stating the facility appears to be operating in the same manner as when previous inspections were conducted.
