DWQ ID # 960569. Staff biologists with the North Carolina Wildlife Resources Commission have not been able to complete review of this project. The maps are illegible. Furthermore the application is incomplete. No information is provided on several important questions (1 U, 11, and 14). The project appears to be located in the Town of Yam wbere we asmurrne that residents are provided with public water supply. if a public water supply is available, we n1List questions the need to convert wetlands to a pond "to water grass & garden". We recommend that the applicant reapply with legible maps and complete information and justification for the project. However, if the decision is made to issue a certification , we request that it be ccutditioncd as follows: 1. Place deed restrictions on any remaining wetlands on-site to prevent any Further impacts by current or future owners. 2. Require the applicant to minimize impacts and mitigate for unavoidable impacts. It may tie possible to create sonic wetlands along the edge of the pond to replace some lost fivnctions or values. Box 245 Lakeview, NC 28350 Dear Mr. Blue: You have our approval to place fill in and flood 1.0 acres of wetlands or waters for the purpose of creating an irrigation pond at 135 Texas Lane in Lakeview, NC, as you described in your application dated 11 June 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. A conservation easement or deed restriction shall be placed on the reaming wetlands on this property to prevent future fill. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. As you can see it isn't much better than the first one I sent. After they Xerox the original its hard to read. I included a map given to me by the man I bought the property from several years ago. It shows the property broken down in lots and the way they are numbered in the tax office. I highlighted our property in green. Hopefully you can use it to identify the location on the county map.
