On May 18,.2012,.Heather:Sorensen of Charlotte -Mecklenburg Storm Water Services (CMSWS)
conducted an investigation of your property located at :3.301 Robinson Circle in Charlotte, North
Carolina. The investigation was conducted by authority granted under the City of Charlotte
Storm Water Pollution Control Ordinance ("Ordinance"), Section 18-82 Powers and Authority
for Inspection. As a result of that inspection, the conditions described below were found on the
property in violation ofthe Ordinance, Section 18-80(a), Illicit Discharge(s) and Disposal(s):
Salvage- Auto Supply personnel were observed pressure washing a motor vehicle engine
outside in an area that drains to a storm water conveyance system. Oil and other
automotive fluids were observed discharging into the storm drain conveyance system.
No containment or proper disposal measures were in place. Dark stained soil was
observed in an adjacent area where auto parts are stored outside on the ground and
exposed to storm water. This area drains to Little Sugar Creek, a Class C Water of the
State. The :facility has been issued a NPDGS Stormwater Pert mit C0C NCG100207
which only permits the discharge of storm water froria theyroperty.
You were verbally, notified of the yiolation on May, 2012- and directed to immediately cease
.the discharge(s) causing,the violation. To achieve compliance with the,legal requirements of the

• Immediately teas any discharge contributing to the violation if you have not
done'so already, f
• Educate employees on the proper collection, containment, and disposal of
wastewater.
• Restore areas affected by the violation, as described above, to their pre -discharge
condition.
• Take appropriate remedial or preventive actions -to prevent future illegal
discharges.
• Submit a written response to this office within five (5) business days following a
successful compliance inspection. Your response should outline why the
violation occurred, actions taken to restore the affected areas, and actions taken to
prevent a similar occurrence in the future. Your response will be taken into
consideration in penalty decisions. Send your response to the address on the
letterhead to the attention of John McCulloch.
Section 18-83(c)(4) of the Ordinance authorizes CMSWS to assess penalties concurrently with a
notice of violation (NOV) for willful or repeat violations or for obstructing an authorized
CMSWS representative in carrying out official duties. The maximum civil penalty for each
violation is Five Thousand Dollars ($5,000.00) per day beginning with the first day of violation
up until you complete all corrective actions listed above. This notice also serves to inform you
that a civil penalty will be assessed for each day of violation starting May 18, 2012. Since the
penalty will accrue at a rate of up to Five Thousand Dollars ($5,000.00) for each clay the
site remains in violation, it is in your best interest to take corrective action immediately. It
is your responsibility to request an inspection from the Inspector (Heather Sorensen, 704-432-
1969) immediately upon completing corrective actions in order to document compliance with the
Ordinance and to minimize your total penalty. Unless scheduled earlier by you, a follow-up
inspection will occur no later than June 22, 2012 to verify progress towards compliance. Please
note that until that verification occurs, you will continue to be in violation of the Ordinance.
CMSWS will take any steps necessary to secure compliance with the Ordinance. One such step
is that CMSWS or a contractor designated by CMSWS may abate a violation and/or restore
impacted areas to their pre -violation condition should you fail to do so, and any expense incurred
for such restoration work in addition to the civil penalty shall be charged to you.
If you have any questions or would like to request a meeting with CMSWS to discuss the
violation, please contact me at 704-336-5455. Please be aware that a meeting request does not
relieve you from completing the corrective actions listed above and does not negate the accrued
penalty amount.
Compliance under this section of the Ordinance does not relieve you from complying with other
local, state, or federal regulations.

Facility: Salvage Auto Supply
Inspection Date: June 24, 2010
Purpose:
The inspection was conducted as part of the Industrial Facilities Inspection
Program required by the City of Charlotte Phase I Storm Water Permit. The purpose was
to identify potential storm water pollution problems associated with this facility.
Inspections are also conducted to review maintenance, storm water and training records
to ensure the site is in compliance with all applicable local, state and federal storm water
regulations.
Background:
On June 24, 2010 at 8:30 a.m., Heather Sorensen of Charlotte -Mecklenburg
Storm Water Services (CMSWS) conducted the following activities as part of the follow-
up inspection:
• Inspected the interior and exterior of buildings
o Inspected the grounds, including material storage areas, the storm drain
system, outfalls and fence line
a Reviewed written records and documentation
e Collected photo documentation of the facility
Salvage Auto Supply, at 3301 Robinson Circle in Charlotte, NC, is located on
approximately 7.73 acres of property and has two buildings that consist of vehicle
stripping and maintenance, parts washing, storage, and sales. Total impervious (parking
lots, buildings, roadways, etc.) area of the site is estimated at 89 percent of the total site
area.
Facility operations typically occur between the hours of 8:00 a.m. to 5:30 p.m., Monday
through Friday, and 9:00 a.m. to 3:00 p.m. on Saturday. Salvage Auto Supply primarily
operates as an auto salvage facility. Wrecked vehicles are delivered to the facility, then
auto fluids are drained as the vehicles are stripped for parts. Stripped vehicles are then
stored in a six acre salvage yard. Vehicles may stay in the salvage yard for two to three
months before they are crushed and sold as scrap metal. Vehicle maintenance is also
conducted on -site.

Records:
A records review revealed the following:

A Notice of Violation was issued to Salvage Auto Supply on April 26, 2010 due
to storm water violations observed during a facility inspection conducted on
March 29, 2010,
This facility has a Standard Industrial Code (SIC) of 5015 - Motor Vehicle Parts,
Used, and 7538 - General Automotive Repair Shops, and
This facility has been issued a National Pollution Discharge Elimination System
(NPDES) storm water permit, Certificate of Coverage NCG100207.
On -Site Inspection:
Salvage Auto Supply is situated on two parcels of land that are approximately
1.65 acres and 6.08 acres. The 1.65 acres parcel consists of two buildings: a warehouse
and mechanic shop building. Vehicle storage and a loading area adjoin these two
buildings. The storm water drainage system at the site consist of sheet flow to the
municipal separate storm sewer system (MS4) along Robinson Circle to the south and
east, and a concrete swale that discharges to the MS4 along Robinson Circle to the east.
This parcel is impervious with a gravel lot around the mechanic shop building and
pavement around the warehouse. The 6.08 acre parcel is mostly impervious surface with
no buildings. Approximately 2,500 salvaged vehicles are stored in the yard that takes up
most of the parcel. The storm water drainage system at the site consist of sheet flow into
a tributary to Little Sugar Creek along the northern border of the parcel, Little Sugar
Creek to the eastern side of the parcel, and onto an adjoining parcel to the southern side
of the parcel. The surface consists mostly of pavement, gravel and concrete. There is a
small vegetative area along the eastern and northern sections of the parcel.
A 55-gallon drum of used antifreeze and a 300-gallon tank of used oil are stored
outside of the mechanic shop building exposed to storm water with no secondary
containment. These containers appeared to be rusting. The containers were labeled.
Universal Environmental Services is contracted to pick up the facility's used oil and
antifreeze. The area appeared to be in good condition.
Four auto mechanic bays are located inside the mechanic shop building. A trash
dumpster is located outside of the mechanic shop building. This area appeared to be in
good condition.
One covered scrap bin was located outside of the warehouse. The scrap bin is
used to store engine parts and alternators for same day pick up by The Scrap Man. This
area appeared to be in good condition.
The warehouse is used for storage of tires, engines, and used batteries. Several
oil spills from stored engines were observed inside the warehouse. These spills were
contained to areas inside the facility that were not exposed to storm water. The loading
area is located outside the warehouse to the north and is used for storing non -oily car

parts. This area is heavily utilized and is the access to multiple bays where car stripping
is conducted. The facility should continue to ensure proper handling of chemicals and
automotive fluids in this area. This area appeared to be in good condition.
One 300-gallon used oil tank and two 55-gallon used antifreeze drums, sitting on
the concrete surface, were labeled. The used oil tank appeared to be rusting. The area
around the containers was covered with oil dry. Secondary containment was not
provided. Staff explained that the oil dry is cleaned up daily and that a cover would be
built for the storage containers.
The concrete swale that was previously impacted by the pressure washing of car
engines appeared to be in good condition.
Approximately 2,500 cars are stored in the yard. 55-gallon drums of used motor
oil were stored in this area. All 55-gallon drums were removed from this area and
disposed.
Along the southern central side of the yard, the area used for temporary storage of
vehicles waiting to be crushed was empty and appeared to be in good condition. A
contractor picks up the pile of metal, tires and dirt every one to two months.
One large pile of greater than 150 empty gas tanks was located along the
northeastern corner of the parcel. The pile appeared to be smaller than observed on May
17, 2010. Staff personnel explained that the empty tanks are being moved into empty
trailers for storage until they can be disposed. One tank can be crushed per vehicle and
through this method the tanks are slowly being disposed. This area appeared to be in
good condition.
Conclusions/Recommendations:
At the time of the inspection the facility appeared to be in good condition. The
facility should continue to practice proper spill clean-up to prevent storm water pollution.

Dear Mr. Desiatnikov,
On March 29, 2010, Heather Sorensen and David Cornelius of Charlotte -
Mecklenburg Storm Water Services conducted an inspection of the above referenced
facility under authority granted by Charlotte City Code Chapter 18, Article III, Section
18-82. A follow-up inspection was conducted by Heather Sorensen on May 17, 2010. As
a result of the follow-up inspection, Salvage Auto Supply is being issued a Notice of
Violation and Recommendation for Enforcement for violating the City of Charlotte
Storm Water Pollution Control Ordinance, Section 18-80(a); Illicit Discharge and
Disposal.
To bring your property into compliance with the legal requirements of the Ordinance, you
must do the following corrective actions by June 15, 2010 (your "compliance deadline").
You must also provide this office with written notification explaining the actions taken.
Please send your letter to the address on this letterhead to the attention of Heather
Sorensen by June 15, 2010.
• Immediately discontinue all illegal discharge activity.
• Based upon the exposure of significant materials to storm water runoff at
the site and the facility's SIC code, Salvage Auto Supply should apply for
an NPDES Storm Water Permit with the North Carolina Division of Water
Quality.
• Radiator fluid and antifreeze chemical containers were observed sitting on
the ground. To prevent potential discharges to the ground all containers
should be properly secured and stored elevated off the ground in a covered
area or properly disposed. Containers should be labeled for their contents.
• Petroleum sheens were observed in the loading area of the warehouse. All
spills and any impacted soils shall be removed and properly disposed.
Any oil dry used should be properly disposed of in a timely manner. The
discharge of petroleum or chemicals to the ground is a violation of the

City of Charlotte Storm Water Pollution Control Ordinance, Section 18-
80(a), Illicit Discharge and Disposal.
One car engine was observed stored outside the loading area of the
warehouse and exposed to storm water. All oily or greasy auto parts and
all engines should be stored elevated off the ground and under cover to
prevent exposure to storm water. Any spills or leaks shall immediately be
cleaned up and properly disposed.
The facility should focus on preventative maintenance and good
housekeeping of the facility to prevent future exposure of pollutants to
storm water.

requested by May 10, 2010. After several further verbal requests, this
response has not been submitted. A written response must be submitted as

discharge condition.
• Take appropriate remedial or preventive actions to prevent future illegal
discharges.
In accordance with the Ordinance, Section 18-83(c) Civil Penalties, you are subject to
civil penalties of up to Five Thousand Dollars ($5,000.00) per day from the date you
were notified of the violation forward. Each day of violation shall constitute a separate
violation. CMSWS will take any steps necessary to secure compliance with the
Ordinance. One such step is that CMSWS or a contractor designated by CMSWS may
abate a violation and/or restore impacted areas to their pre -violation condition should you
fail to do so within the established compliance deadline, and any expense incurred for
such restoration work in addition to the civil penalty shall be charged to you.
Please be advised that a previous notice of violation was issued for the same offense on
April 26, 2010. This letter is also to advise you that this office is considering proceeding
with enforcement Ifyou have an explanation for the violation thatyou wish to present,

Purpose:
The inspection was conducted as part of the Industrial Facilities Inspection
Program required by the City of Charlotte Phase I Storm Water Permit. The purpose was
to identify potential storm water pollution problems associated with this facility.
Inspections are also conducted to review maintenance, storm water and training records

Background:
On March 29, 2010 at 10:00 a.m., Heather Sorensen and David Cornelius of
Charlotte -Mecklenburg Storm Water Services (CMSWS) conducted � the" following
activities as part of the inspection:
• Inspected the interior and exterior of buildings
• Inspected the grounds, including material storage areas, the storm drain
system, outfalls and fence line
• Performed dye tests on selected drains
• Reviewed written records and documentation
• Collected photo documentation of the facility
Salvage Auto Supply, at 3301 Robinson Circle in Charlotte, NC, is located on
approximately 7.73 acres of property and has two buildings that consist of vehicle
stripping and maintenance, and parts washing, storage and sales. Total impervious
(parking lots, buildings, roadways, etc.) area of the site is estimated at 89 percent of the
total site area.
Facility operations typically occur between the hours of 8:00 a.m. to 5:30 p.m., Monday
through Friday, and 9:00 a.m. to 3:00 p.m. on Saturday. Salvage Auto Supply primarily
operates as an auto salvage facility. Wrecked vehicles are delivered to the facility, then
auto flbi&"are` dfdffied-as'th Vehicles"ar'e `shipped for parts.'- Stripped "vehicles are then
stored in a six acre salvage yard. Vehicles may stay in the salvage yard for two to three
months before they are crushed and sold as scrap metal. Vehicle maintenance is also
conducted on -site.
Sergui Kopytin, Manager, accompanied CMSWS personnel during the inspection.
Records:
A records review revealed the following:

• The facility presented one receipt for the disposal of 175 gallons of used oil and
100 gallons of used antifreeze on February 23, 2010,
• This facility has a Standard Industrial Code (SIC).of 5015 - Motor Vehicle Parts,
Used, and 7538 - General Automotive Repair Shops, and
• This facility does not have a National Pollution Discharge Elimination System
(NPDES) storm water permit.
On -Site Inspection:
Salvage Auto Supply is situated on two parcels of land that are approximately
L65 acres and 6.08 acres. The 1L:65" acres parcel consists of two buildings. a wareh6use
and mechanic shop building. Vehicle storage and a loading area adjoin these two
buildings. The storm water drainage system at the site consist of sheet flow to the
municipal separate storm sewer system (MS4) along Robinson Circle to the south and
east, and a concrete swale that discharges to the MS4 along Robinson Circle to the east.
This parcel is impervious with a gravel lot around the mechanic shop building and
pavement around the warehouse. The 6.08 acre parcel is mostly impervious surface with
no buildings. Approximately 2,500 salvaged vehicles are stored in the yard that takes up
most of the parcel. The storm water drainage system at the site consist of sheet flow into
a tributary to Little Sugar Creek along the northern border of the parcel, Little Sugar
Creek to the eastern side of the parcel, and onto an adjoining parcel to the southern side
of the parcel. The surface consists mostly of pavement, gravel and concrete. There is a
small vegetative area along the eastern and northern sections of the parcel.
A 55-gallon drum of antifreeze and a 300-gallon tank of used oil are stored
outside of the mechanic shop building exposed to storm water with no secondary
containment. These containers appeared to be rusting. The tanks were not labeled.
Universal Environmental Services is contracted to pick up the facility's used oil and
antifreeze. A 3-gallon open container consisting 'of used oil and used oil filters was
located in a car part outside. The container was not exposedAo storm water. However,
facility personnel explained that this was not a general practice and the container and oil
would be properly disposed.
Four auto mechanic bays are located inside the mechanic shop building. No floor
drains were observed in this building. General car maintenance is conducted in this area.
A trash dumpster is located outside of the mechanic shop building. The trash dumpster
was plugged with the top open, exposing the dumpster to storm water.
Two scrap bins were located outside of the warehouse. These scrap bins are used
to store engine parts and alternators for same day pick up by The Scrap Man. An oil
sheen was observed on the ground around the base of the two bins.
The warehouse is used for storage of tires, engines, and used batteries. Several oil
spills from stored engines were observed inside the warehouse. These spills were

contained to areas inside the facility that were not exposed to storm water. The loading
area is located outside the warehouse to the north and is used for storing rear axles, empty
gas tanks, used oil and antifreeze tanks. This area is heavily utilized and is the access to
multiple bays where car stripping is conducted. Proper handling of chemicals and
automotive fluids is a concern in this area. Several 5-gallon buckets of joint compounds
were observed sitting outside and exposed to storm water. Puddles of water with a green
tint and oil sheen were observed outside the warehouse bay on concrete surface exposed
to storm water. Automotive fluid spilled to the concrete ground from leaking automotive
parts stored outside was observed. Greasy auto parts were stored on the ground in this
area located outside and exposed to storm water.
Several automotive fluid containers were located in the loading area, outside and
exposed to storm water. Heavy oil staining was observed. on the concrete surface in this
area. One 300-gallon used oil tank and two 55-gallon used antifreeze drums were
unlabeled. The used oil tank appeared to be rusting. Five 5-gallon buckets of product
were also located in this area. One bucket was missing a lid and full of product with
another bucket sitting on the topless bucket. Secondary containment was not provided.
The facility does not conduct vehicle washing onsite. However, personnel were
observed pressure washing a car engine outside in the loading area to the ground with no
containment or proper disposal for discharged wash water or oil and grease. After
directed to stop the washing and properly clean up and dispose of the waste material, staff
personnel ceased the pressure washing and applied absorbent material to the affected
area. The wash water reached a concrete swale that discharges off site to Robinson
Circle. A minor sheen was observed at this outfall.
Approximately 2,500 cars are stored in the yard. One car engine was observed
exposed to storm water. At the southeastern side of this property several chemical
containers were stored outside and exposed to storm water. One 500-gallon used oil tank
was stored on its side on the ground. The used oil tank appeared to be rusting with open
holes. Product was observed inside the tank. Five 55-gallon drums with product and
open tops with no labels were stored on the ground and exposed to storm water. The
drums appeared to be rusting. Twelve 5-gallon buckets with open tops and product were
observed stored on the ground and exposed to storm water.
A large pile of scrap metal and other debris is located along the southern central
side of the yard. A contractor picks up the pile of metal, tires and dirt every one to two
months.
Eleven 55-gallon drums containing product with open and closed tops were
observed stored outside, on the ground and exposed to storm water along the central
southern area of the yard. The metal drums appeared to be rusting. Secondary
containment was not provided.
Four large semi -trailers are on -site to provide storage for tires.and vehicle parts.
This area appeared to be in good condition.

One large pile of greater than 150 empty gas tanks was located along the
northeastern corner of the parcel. Staff personnel explained that one tank can be crushed
per vehicle and through this method the tanks are slowly being disposed.- One 55-galIon
drum of product was located in this area on the ground and exposed to storm water.
One 55-gallon drum was observed sitting on the ground and exposed to storm
water along the middle of the northern side of the parcel. This drum was inaccessible at
the time of the inspection.
Four 55-gallon drums were observed sitting on a pallet and exposed to storm
water in the northeastern comer of the parcel. These drums appeared to be sealed and
rusting.
Conclusions/Recom mendations:
Based upon the exposure of significant materials to storm water runoff at the site
and the facility's SIC code, it is recommended that Salvage Auto Supply apply for an
NPDES Storm Water Permit with the North Carolina Division of Water Quality.
Used oil, antifreeze and other chemical containers were observed sitting on the
property. All containers should be properly secured and stored elevated off the ground in
a covered area or properly disposed. Containers should be labeled for their contents: All
chemical materials that do not have a future use should be properly disposed.
Petroleum and chemical spills to the ground were observed. All spills shall be
removed along with any impacted soils and properly disposed. The discharge of
petroleum or chemicals to the ground is a violation of the City of Charlotte Storm Water
Pollution Control Ordinance, Section 18-80(a), Illicit Discharge and Disposal.
One trash dumpster was observed with the lid open. The facility should ensure
that lids to trash dumpsters be closed when not in use.
Two scrap bins were located outside of the warehouse. These scrap bins are used
to store engine parts and alternators for same day pick up by The Scrap Man. An oil
sheen was observed on the ground around the base of the two bins. The scrap metal bins
should be stored in an area not exposed to storm water to prevent the discharge of oil and
grease.
Greasy engine parts were observed stored outside in the loading area and one car_
engine was observed exposed to storm water. All oily or greasy auto parts and all
engines should be stored elevated off the ground and under cover to prevent exposure to
storm water. Any spills or leaks shall immediately be cleaned up and properly disposed.

Staff personnel were observed pressure washing an engine to the ground with no
collection or containment system. The wash water discharged into a concrete swale that
discharges to a storm water outfall. The discharge of wash water is a violation of the City

Enclosed are the monitoring results from the laboratory analyses performed on the discharge from Stormwater
Outfall #001 at the sub}ect facility. The samples analyzed were grab samples collected during the sampling
investigation performed on October 20, 2010, by Heather Sorensen of Charlotte -Mecklenburg Storm Water
Services.
This sampling investigation was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of
Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H.
The enclosed monitoring results indicate that the stormwater discharged on October 20, 2010, contained an
elevated concentration of lead, total suspended solids, and ethylene glycol compared with the benchmark
values contained in Stormwater permit NCG100000.
In addition, elevated concentrations of turbidity, biological oxygen demand (BOD), chemical oxygen demand
(COD), fecal coliform, E. coli, copper, lead, and zinc were also detected as compared with the Divison's
benchmarks developed for individual stormwater permits (turbidity — 50 NTU, BOD 30 mg1L; COD — 120 mglL;
fecal coliform and E. coli -- 1,000 CFU1100 ml; E, soli — 500 MPN/100 ml; copper — 7 pg/L; lead — 30 pg/L; and
zinc 67 dig/L.)
In addition, the copper, lead, and zinc concentrations exceeded the applicable stream standards for toxic
substances (copper — 7 pg/L; lead — 25 tag/L; and zinc — 50 pg/L). Since the stormwater sample was not
collected instream, the stream standards do not apply; however, these standards can be used to indicate the
potential of your runoff to impact the receiving stream
Please review the requirements of your stormwater permit and take the required steps/actions to reduce the
concentrations of the parameters noted above especially ethylene glycol leaving your site. Through the
development and implementation of stormwater management programs it is the Division of Water Quality's
expectation that stormwater discharges at industrial sites covered by NPDES stormwater permits do not impact
receiving waters.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was estabiished under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolira. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

The following items are a subset of permit requirements and are listed,to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOi) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering,
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

c Collection, reporting, and recording of Qualitative Monitoring
o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records —Visual monitoring shall be documented and records maintained at the facility along
with the Stcrmwater Pollution Prevention Plan. Copies of the analytical monitoring resuits shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including ail calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.
