New London, NC 28127 Dear Mr. Harris: You have our approval to place fill material in 0.25 acres of wetlands or waters for the purpose of shoreline stabilization at old North State Club at Uwharrie Point, as you described in your application dated 24 April 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be r~uired to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, yoo may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. ".I:j'"f , ~ t' ~,~~~~)I March 26, 1996 Mr. Richard Hamilton Assistant Director North Carolina Wildlife Resource Commission 512 North Salisbury St. Raleigh, NC 27604-1188 Dear Mr. Hamilton, Mr. Norm Pierson of Yadkin, Inc. has requested that we send you a set of plans detailing a shoreline stabilization project we plan to implement on Badin Lake as soon as we receive final Yadkin, Inc. approval. The area to be stabilized is referred to as the "High bank" area and Mr. Pierson has indicated Yadkin will require a review of the plans by NCWRC before giving final approval. This project has been anticipated for several years and will take place in the Southpoint neighborhood on Lots 30, 31, and partially on Lot 32. The stabilization covers 1, 100 I~ear feet along the shoreline and the bank ranges in height from 3 feet to 15 feet. During construction a silt curtain will be installed to reduce silt influx into the lake and the bank areas will be seeded and stabilized following final grading. Moffatt and Nichol engineers from Raleigh have developed the plan and they are preparing the Corps of Engineers application in co-ordination with Mr. Mike Hosey in the Wilmington office. The attached information includes the basis of design, typical cross sections, a map highlighting the impacted shoreline, and a series of shoreline profiles. Several sets are included for your convenience. Subject to your review, fmal approval from Yadkin, and receipt of the Corps permit we plan to perform this work in the April-June time period which is an optimum time from the standpoint of weather. Attn: Mr. John Butters Post Office Box 14005 Research Triangle Park, North Carolina 27709 Dear Mr. Butters: Reference your June 19, 1991 meeting with Mr. George Krishbaum of East West Partners, and Mr. Jeff Richter of my staff concerning ongoing work and wetland delineations at the Uwharrie Point development, on Badin Lake, in northwest Montgomery County, North Carolina. During this meeting, Mr. Richter determined that some wetlands had been impacted by a road crossing and ditch excavation adjacent to the existing sales office. Concerning the excavation, it appears that the ditch work was essentially ditch/stream maintenance, resulting from deposition due to erosion, although the some of the material was placed in wetlands. In discussing this matter, Mr. Richter requested removal of the spoil pile in its entirety along the side of the ditch, in some places taking the grade to that where wetlands can be formed. Mr. Richter determined that this work, less the placement of the spoil, impacts l~,~ of wetlands along a headwater stream and can be authorized by our Nationwide Permit No. 26. The road crossing appears to be in conformance with our Nationwide Permit No. 14 for minor road crossings. Nationwide Permits Nos. 14 and 26 authorization on this development has been exhausted. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. Authorization was provided for minor road crossing fills including all attendant features, both temporary and permanent, that are part of a single and complete project for crossing of a non-tidal waterbody, provided that the crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected high flows and provided further that discharges into any wetlands adjacent to the waterbody do not extend beyond 100 feet on either side of the ordinary high water mark of that waterbody. Authorization was provided for discharges of dredged or fill material into non-tidal rivers, streams, and their lakes and impoundments, including -2- adjacent wetlands, that are located above the headwaters and other non-tidal waters of the United states, inc~uding adjacent wetlands, that are not a part of a surface tributary system to interstate waters or navigable waters of the United States. Your work is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. The nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid until the nationwide permit i& modified, reissued or revoked. All nationwide permits are scheduled to be ,modified, reissued or revoked prior to November 13, 1991. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing changes when they occur. Furthermore, if you commence or are under contract to commence this activity before the date the nationwide permit is modified or revoked, you will have 12 months from the date of the modification or revocation to complete the activity under the present terms and conditions of this nationwide permit. The remainder of the meeting involved reviewing wetland delineations. Mr. Richter determined that wetlands on the development site have been located and accurately delineated in their entirety (with the exception of those associated with the above-discussed road crossing and ditch). Silt fences and/or other erosion control measures have been implemented in all areas of ongoing work, restricting sedimentation into wetlands and Badin Lake. Bridges and golf course crossings built across wetlands have been constructed in such a manner so as to avoid the placement of any fill material in wetlands or in Badin Lake itself. Mr. Richter did not observe any unauthorized activity in waters or wetlands of the United States subject to our regulatory jurisdiction. McAdams Co., and Mr. Jeff Richter of my staff, concerning a proposed golf course and residential development, at the end of S.R. 1162, on Badin Lake, in Montgomery County, North Carolina. At this meeting, Mr. Richter determined that a majority of the wetlands previously identified are considered adjacent wetlands of Badin Lake, and will therefore require individual permits prior to being impacted (including grading). He located a wetland system near the green of number 2 which had not been delineated previously. The extent of this wetland through the fairway was determined to be 20 feet wide and is considered to be adjacent to the Lake. Hole number lO requires a wetland crossing, with a proposed .4-acre wetland fill. Mr. Richter determined that this area is an adjacent wetland and as such will require an individual permit. As you walked toward the Lake, you came upon a small pond and dam. Below this dam, is a small running creek, and the proposed road crossing of this creek can be issued by our Nationwide Permit No. 14.
