In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Bart III, Section Q. Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C. Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B; C: A lower TSS benchmark of 50 mgjl for HOW: ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections d {:: fhe monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, ether
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Advetse weather is defined
in the "Definitions" section of the permit.
• sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. sec}.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

Dear Permittee:
Your facility is currently covered for stormwater discharge under General Permit NCG100000. This permit expires
on August 31. 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 l categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed

Your facility is currently covered for stormwater discharge under General Permit NCG 100000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.

Enclosed is a copy of the Follow-up Compliance Evaluation Inspection (CEI) report for the inspection conducted
at the subject facility on August 5, 2009, by Ms. Erin Hall of Charlotte -Mecklenburg Storm Water Services
(CMSWS). This inspection was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of
Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. Thank you for your
assistance and cooperation during the follow-up inspection. .
The follow-up inspection found that City Salvage I, Inc. has implemented the corrective actions as stated in your
response letter dated May 9, 2009. This letter was submitted on behalf of the subject facility. The corrective
actions included:
• Implementing and conducting an employee training program related to stormwater,
• Implementing and conducting qualitative and analytical monitoring, and
• Relocating the dumpster undercover so it is not exposed to stormwater.

Facility Description:
City Salvage 1, Inc. is in operation from &00 a.m. to 5:00 p.m., Monday through Friday. This facility buys vehicles from
auto auctions and from the public. Vehicle parts are resold or scrapped and sent to a metal salvage yard to be recycled.
The facility is located on approximately eight acres of property consisting of one building, two covered areas, and a gravel
lot where salvaged vehicle shells are stored The facility is currently in the process of adding more gravel to the site. All
Industrial processes are conducted within the main building or outside under cover. Ahoveground storage tanks (AST) ara
withal seccridart; containment. Rainwater within secondary containment, used gas, used hydraulic fluid, and used
motor oil are pumped out and disposers of by M & M Waste Cali. According to €acuity personnel, this is conducted
approximately once per week
Compliance History:
On January 21, 2003, a Notice of Violation and Recommendation for Enforcement was issued by the Division of Water
Quality to City Salvage for a discharge of oil to the ground on December 12, 2002. The facility complied with
recommended actions and no enforcement action was taken.
On January 17, 2004, Charlotte Fire Department requested response from MCWQP to the facility due to a vehicle fire
associated with a fuel spill. The fuel and water were contained and the facility had the wastewater properly disposed of by
M & M Waste Oil,
A Stormwater Compliance Evaluation Inspection was conducted by Ms. Erin Hall of CMSWS on March 31, 2009, A
Notice of Violation was issued to City Salvage I, Inc. on April 16, 2009, by the Division of Water Quality.

Trash Dumpster —
During the initial inspection it was noted that the facility had two trash dumpsters that were used for general household
waste products. The dumpsters are owned by BFI. The dumpster located adjacent to the used tire area appeared to be in
poor condition with heavy rusting, holes, and a missing drain plug. Per facility personnel, BFI has stated that the dumpster
would be replaced. The permittee was advised to contact BFI and request a new dumpster if the current one was not
replaced in a timely manner.
During the follow-up inspection conducted on August 5, 2009, the dumpster located adjacent to the used tire area had
been relocated undercover on a concrete pad. A new dumpster has now been placed in the used tire area. This dumpster
had rain lids and a drain plug in place.

Comment: Per facility personnel during the initial inspection, employee training is
conducted, but documentation could not be provided. The Stormwater Pollution
Prevention Plan (SPPP) was completed in 2009; therefore annual updates/reviews have
not been performed for previous years. The permittee conducted a Stormwater Facility
Inspection on February
12, 2009, but no prior inspections had been documented. The SPPP had not been fully
implemented due to the lack of documentation of employee training, annual
updates/reviews to the SPPP, and qualitative and analytical monitoring.
During the follow-up inspection conducted on August 5, 2009, an employee roster was
provided showing employee training had been conducted on July 13, 2009. The
employee training manual was also reviewed. The facility's Stormwater Pollution

However, per facility personnel, the contracted lab only sent bottles for one outfall

Comment: During the initial inspection four outfalls were identified. Outfall 001
consists of a concrete pipe and discharges -70% of the site's stormwater. Outfall 002
and 003 discharge -10% each of the site's stormwater. Stormwater from these two
outfalls consisted of sheet flow across a gravel surface where it formed a puddle at the
edge of the facility's property. When the puddle filled, the-stormwater would overflow
into a vegetated area. Outfall 004 collects -10% of the site's stormwater that discharges
to a vegetated area. Since the initial inspection, the area consisting of Outfall 002 was
graded and gravel was added. Stormwater that would have discharged from Outfall 002
now discharges from Outfall 003 which now discharges --20% of the site's stormwater.
No significant impacts due to the grading were observed within this area. At the time of
the follow-up inspection the facility had a total of three outfalls. Facility personnel are in
the process of updating the SPPP to reflect these changes.

In response of your Notice of Violation/Recommendation For Enforcement dated
January 21, 2003, City Salvage 1 has retained the services of Earth Tech of North
Carolina, Inc. to conduct a soil assessment of reported discharge areas at their
Charlotte facility.
City Salvage 1 had advised Earth Tech that they have instituted the administrative
control of draining oil and fuel from vehicles prior to flattening thus, in the
interim, removing the source of the petroleum products discharge_ To provide for
permanent control of future discharges, City Salvage 1 is evaluating options for
instituting engineering controls such as performing the flattening operation on a
sheltered concrete pad with appropriate curbs and collection sump, or modifying
the flattening press to include drain holes and collection sumps. City Salvage 1
will advise you of their selected method for provide permanent controls by April
1, 2003.
City Salvage 1 plans to excavate petroleum impacted soil in the former area of the
flattener and at the gas task emptying area. The excavated soils will be staged on
plastic in accordance with Groundwater Section Guidelines, Earth Tech will
collect soil samples from the bottom of the excavation and have the samples
analyzed for gasoline and diesel range petroleum constituents by EPA Methods
3550 and 5030 respectively and for oil and grease by EPA Method 9071. A
composite samples will be collected from the staged soils, and the composite

sample will be analyzed for petroleum constituents (EPA Methods 3550, 5030, and 9071)
and for toxicity characterization leaching procedures (TCLP) metals. After receipt of
analytical results, a report will be transmitted to your office that describing the excavation
and the results of the soils analysis.
To allow City Salvage 1 to move scrap from the discharge areas, Earth Tech plans to
mobilize the site by the week of February 17, 2003 to assist City Salvage 1 in the soil
excavation. It is expected that the assessment analytical results would be received during
the week of March 3, 2003, and that the summary report will be transmitted to
Mooresville Regional Office during the week of March 11, 2003.

directs the Environmental Management Commission of this Department to protect and preserve
the water resources of the State. The Division of Water Quality has the delegated authority to
enforce adopted pollution control rules and regulations.
On December 12, 2002, James Wilson of the Mecklenburg County Water Quality
Program (MCWQP) conducted an investigation of your, property located at 3628 Northerly Road
in Charlotte, N:C. This investigation was conducted as part of a cooperative working agreement

any contaminated soil, and to restore all affected areas as nearly as may be to the conditions
existing prior to the discharge. It is recorrunended that you implement corrective actions to
eliminate the potential for recurrent illegal discharges.
Be advised that, pursuant to G.S. 143-215.88A, any person who intentionay or
negligently discharges oil or other hazardous substances, or knowingly causes or permits the
discharge of oil in violation of G.S. 143-215.83(a), or who fails to report a discharge as required
by G.S. 143-215.85. or who fails to comply with the clean-up requirements of G.S. 143-
215.84(a), shall incur, in addition to any other penalty provided by law, a penalty in an amount
not to exceed five thousand dollars ($5,000.00) for each such violation. Penalties may also be
assessed for any damage to the surface waters of the State that may result from the unpermitted
discharge.
It is requested that you respond, in writing, to this Notice, indicating the measures taken
to collect and remove the discharge, to prevent future discharges, and to restore all affected
areas. The response should also indicate the disposal location for any removed discharge
material, contaminated soils, or waters and include a copy of the analytical documentation for the
site remediation. Please address your response to me by no later than February 7, 2003! Also,
please send a copy of this response to Mr. Rusty Rozzelle of MCWQP at 700 North Tryon
Street, Suite 205, Charlotte, N.C. 28202.

located at 3628 Northerly Road mear Statesville Road. Mr. Downs indicated that there were oil strains observed all around the
property -

Visited the site to investigate the reported conditions. Met the facility manager, Mr. Dennis Baucom, and asked him for a tour
of the property and explanation of procedures for waste management.
Mr. Baucom stated that the business purchased or otherwise acquired junked or totalled cars for parts and scrap metal.
There is a car crusher on site where cars are processed for an eventual trip to a scrap metal buyer in Statesville, NC.
Although Mr. Baucom stated that all fluids were collected from autos before processing, the ground around the property, and
the car crusher especially, were covered with what appeared to be automobile oil and antifreeze. Auto parts littered the site,
many of them still covered or filled with fluids. Many of the cars in the lot that are being scavenged for parts are leaking oil,
gas and antifreeze. There appears to be little attempt to clean up spills as they occur and housekeeping in general seems to
be a non -concern at this facility.

Dear Mr. Kiser:
Earth Tech of North Carolina, Inc., (Earth Tech) has completed the soil excavation
and sampling conducted at the above -referenced property. The work was performed
April 2, 2003. Activities associated with the work consisted of excavating and
stockpiling potentially contaminated soil and collecting soil samples for laboratory
analysis. The purpose of this report is to document the field activities, present the
laboratory analyses, and provide recommendations regarding the property.
Excavation Activities
The City Salvage property is located at 3628 Northerly Road in Charlotte,
Mecklenburg County, North Carolina (Figure 1). This location is on the east side of
Northerly Road approximately 300 feet south of the I-85 Service Road. The property
consisted of a single building/workshop, a newly constructed concrete pad and cover,
and an automobile salvage yard On January 21, 2003, a Notice of Violation was sent
to City Salvage requesting that discharged material be collected, removed, and
properly disposed of, including any contaminated soil.
On April 2, 2003, Earth Tech mobilized to the site to conduct the excavation activities.
Visually impacted soils were removed from two areas. These included the former
crusher area, and the location where automobile gasoline tanks were emptied into an
aboveground storage tank (AST). Soils were removed using a track -hoe until there
was no visual evidence of impact.
Following removal of obviously impacted materials, soils remaining in the excavation
were screened using a combination flame -ionization and photo ionization detector
(FID/PID), and a PetroFlag field screening procedure to determine where additional
excavation was required. PID/FID field screening consisted of placing the soil sample
into a resealable plastic bag and allowing organic vapors to volatilize into the
headspace. The concentration of volatiles in the headspace was then measured.
Screening using the PetroFlag procedure consisted of placing a 10 gram aliquot of soil

into an extraction solvent. After 10 minutes, the solution was then filtered and a
reactive reagent was added. After 5 additional minutes the vial was placed into a
detector and the resulting concentration was displayed.
Excavation depths ranged from 2" to 14". A total of five soil samples were collected
from the bottom of the excavations, three from the former crusher area, and two from
the area where automobile gasoline tanks had been emptied (Figure 2/Attachment 2)_
The excavation at the former crusher area measured approximately 25' by 35', and the
excavation at the gasoline removal area measured approximately 15' by 20'. The
volume of soil removed was about 110 cubic yards. Due to the shallow depths of
excavation no sidewail samples were collected.
Upon completion of the excavation, confirmation soil samples were collected and
analyzed. Soil samples were analyzed for total petroleum hydrocarbons (TPH) using
extraction methods 5030/3550, and for oil and grease using extraction method 9071.
Excavated soil was stockpiled on -site. The stockpiled soil was placed on and covered
with plastic in accordance with North Carolina Department of Environment and
Natural Resources (NCDENR) guidelines. To assist City Salvage with disposal of the
material, a composite sample from the soil stockpile was collected and analyzed for
TPH concentrations, TCLP metals, and BTEX compounds using EPA method 8260.
Analytical Results
Five confirmation soil samples were collected for analysis from the site. Soil samples
CS-1 through CS-3 were collected from the former crusher area and samples CS-4 and
CS-5 were collected from the gasoline removal area. Based on the laboratory reports,
summarized in Table 1 and presented in Attachment 2, TPH concentrations were
detected in two of the five soil samples collected from the site (Figure 3). TPH
concentrations identified as diesel fuel were detected in soil samples CS-2 at 13 mg/kg
and CS-5 at 12 mg/kg. Oil and grease concentrations were detected in three of the soil
samples collected at the site. The analyses indicated an oil and grease concentration of
64 mg/kg in soil sample CS-1, 360 mg/kg in soil sample CS-3, and 46 mg/kg in soil
sample CS-4.
None of the TPH concentrations detected in the samples are above the NCDENR
Groundwater Section action levels of 10 mg/kg for gasoline range constituents and 40
mg/kg for diesel range constituents. One of the concentrations detected in these
samples, 360 mg/kg of oil and grease detected in sample CS-3, is above the action
level of 250 mg/kg. However, there was a significant amount of broken asphalt
present in the ground cover of the areas being excavated, and particles were likely
included in the sample matrix. The analytical laboratory suggested that most asphalt
will result in positive results for oil and grease and potentially diesel range TPH

concentrations.
As a result of the contamination at the excavation, Earth Tech recommends that a copy

recommendation regarding this issue is provided in the Industrial Operations/City of
Charlotte Stormwater Ordinance Review section of the report.
It is requested that a written response be submitted to this Office by May 15, 2009,
addressing the above -noted violations highlighted in the enclosed report. In responding to the
violations, please address your comments to the attention of Ms. Marcia Allocco at the letterhead
address.
The subject facility will have 90 days from the letterhead date to come into compliance
with the above -noted violations. A follow-up evaluation will be conducted by CMSWS after
July 15, 2009, to ensure compliance with the facility's Stormwater Permit and/or compliance
with the City of Charlotte Stormwater Ordinance.

Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the
inspection conducted at the subject facility on March 31, 2009, by Ms. Erin Hall of Charlotte -
Mecklenburg Storm Water Services (CMSWS). This inspection was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water
Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. Thank you for your
assistance and cooperation during the inspection.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to comply with requirements stated in the facility's,general stormw-ater permit. This is in .
violation of the subject Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1,
as detailed in the Stormwater Management Plan, Qualitative Monitoring, and Analytical
Monitoring sections of the enclosed report. Pursuant to G.S. 143-215.6A, a civil penalty of not
more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who
violates or fails to act in accordance with the terms, conditions, or requirements of any permit
issued pursuant to G.S. 143-215.1.

could not be provided. The Stormwater Pollution Prevention Plan (SPPP) was
completed in 2009; therefore annual updates/reviews have not been performed for
previous years. The permittee conducted a Stormwater Facility Inspection on February
12, 2009, but no prior inspections have been documented. The SPPP has not been
fully implemented due to the lack of documentation of employee training, annual
updates/reviews to the SPPP, and qualitative and analytical monitoring.

Inspection Summary:
Facility Description:
City Salvage 1, Inc. is in operation from 8:00 a.m. to 5:00 p.m., Monday through Friday. This facility buys vehicles from
auto auctions and from the public. Vehicle parts are resold or scrapped and sent to a metal salvage yard to be recycled.
The facility is located on approximately eight acres of property consisting of one building, two covered areas, and a gravel
lot where salvaged vehicle shells are stored. The facility is currently in the process of adding more gravel to the site. All
industrial processes are conducted within the main building or outside under cover. Aboveground storage tanks (AST)
are within secondary containment. Rainwater within secondary containment, used gas, used hydraulic fluid, and used
motor oil are pumped out and disposed of by M & M Waste Oil. According to facility personnel, this is conducted
approximately once per week.
Compliance History:
On January 21, 2003, a Notice of Violation and Recommendation for Enforcement was issued by the Division of Water
Quality to City Salvage for a discharge of oil to the ground on December 12, 2002. The facility complied with
recommended actions and no enforcement action was taken.
On January 17, 2004, Charlotte Fire Department requested response from MCWQP to the facility due to a vehicle fire
associated with a fuel spill. The fuel and water were contained and the facility had the wastewater properly disposed of by
M & M Waste Oil.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Trash Dumpster—
The facility has two trash dumpsters that are used for general household waste products. The dumpsters are owned by
BFI. The dumpster located adjacent to the used tire area appeared to be in poor condition with heavy rusting, holes, and a
missing drain plug. Per facility personnel, BFI has stated that the dumpster would be replaced. The permittee should
contact BFI and request a new dumpster if the current one is not replaced in a timely manner.
